Abstract

Undang-undang No.5 Tahun 2014 tentang Aparatur Sipil Negara (ASN) merupakan wujud dari kelanjutan pelaksanaan Reformasi Birokrasi, menuju profesionalisme pegawai. Merit sistem merupakan cerminan manajemen kepegawaian yang profesional dimana penempatan pegawai dan pejabat menggunakan kompetensi kinerja dan track record sebagai alat ukur pengangkatan Tujuan penelitian ini untuk mengevaluasi implementasi sistem merit dalam Manajemen ASN pada Kantor Wilayah Kementerian Agama Prov. Sulawesi Selatan dan melihat faktor-faktor yang mempengaruhi implementasi sitem tersebut. Penelitian ini merupakan penelitian normatif empiris dengan menggunakan pendekatan kualitatif dengan tujuan mengetahui bagaimana implementasi sistem merit dalam manajemen ASN serta faktor-faktor yang mempengaruhi implementasi tersebut. Sehingga diharapkan dapat memberikan sumbangan pemikiran terhadap pemerintah dalam pengkajian dan pelaksanaan sistem merit kearah yang lebih baik. The implementation of the Act Number 5, Year 2014 on The Civil State Apparatus is entity of a sustainable successful implementation of bureaucracy reform head to officers professionalism. The Merit System is a reflection of professional staffing management. The merit system is performance assessment based on work performance. The purpose of this research is to evaluate the implementation of merit system to officers development according to the needs of South Celebes Regional Office the Ministry of Religions and the factors affecting of its implementations. It is a normatif-empiric method with qualitative approach. It is hoped to describe the implementation of merit system in civil state management and and the factors affecting of its implementations. So that it is expected to contribute ideas to the government in the study and implementation of a better Merit System.

Abstract

Abstract

This study aims to analyze the problem of legal protection for children in the perspective of human rights. The type of this research is socio-juridical or including descriptive research with a non-doctrinal approach, which views law as a socio-empirical symptom observed in experience. The research method used is descriptive research with the type of incorporation of normative legal research with sociological legal research related to the implementation of legal protection for children in the perspective of human rights. The results of the study show that the results of this study are the legal protection of children in the perspective of human rights in essence is an effort made by parents, government and society to fulfill and guarantee all children's rights that have been guaranteed in the convention of children's rights and laws Number 35 of 2014 concerning Child Protection. Legal protection for children in the perspective of human rights is less implemented because the government has not implemented its obligations in fulfilling children's rights so that there are still legal violations of children. The recommendation of this research is to implement legal protection for children in the perspective of human rights, parents should be fully responsible for the behavior of children and the government establishes policies that are in line with the wishes of the community, so that the common perception between parents, government and society is realized in fulfilling the rights child.

Abstract

Tujuan penelitian ini adalah: (1) Untuk menganalisis implementasi Peraturan Pemerintah No. 53 Tahun 2010 tentang Disiplin Pegawai Negeri Sipil pada Kantor Kecamatan Kahu Kabupaten Bone; dan (2) Untuk mengetahui dan menganalisis faktor-faktor yang mempengaruhi implementasi Peraturan Pemerintah Nomor 53 Tahun 2010 tentang Disiplin Pegawai Negeri Sipil pada Kantor Kecamatan Kahu Kabupaten Bone. Tipe penelitian ini adalah penelitian deskriptif dengan pendekatan yuridis-empiris. Hasil penelitian menunjukkan bahwa: (1) Implementasi Peraturan Pemerintah Nomor 53 Tahun 2010 Tentang Disiplin Pegawai Negeri Sipil pada Kantor Kecamatan Kahu Kabupaten Bone belum terlaksana secara efektif, disebabkan karena kurangnya pemahaman pegawai tentang Peraturan Disiplin PNS termasuk kewajiban, larangan dan sanksi hukum bagi pegawai yang melanggar ketentuan tersebut, dan juga masih kurang ketaatan pegawai pada aturan yang ada, sehingga pegawai tidak mampu melaksanakan kewajibannya secara efektif; dan (2) Faktor-faktor yang mempengaruhi implementasi Peraturan Pemerintah Nomor 53 Tahun 2010 tentang Disiplin Pegawai Negeri Sipil pada Kantor Kecamatan Kahu Kabupaten Bone, antara lain: kualitas PNS, perilaku PNS, kesejahteraan PNS, struktur hukum, budaya hukum, pengetahuan hukum, dan sanksi hukum. The objectives of this study are: (1) To analyze the implementation of Government Regulation No. 53 of 2010 concerning Discipline of Civil Servants at the Kahu District Office of Bone Regency; and (2) To find out and analyze the factors that influence the implementation of Government Regulation No. 53 of 2010 concerning Discipline of Civil Servants at the Kahu District Office of Bone Regency. This type of research is a descriptive study with a juridical-empirical approach. The results showed that: (1) Implementation of Government Regulation Number 53 Year 2010 Regarding Discipline of Civil Servants at the Kahu District Office of Bone Regency has not been implemented effectively, due to the lack of employee understanding of Civil Servant Discipline Regulations including obligations, prohibitions and legal sanctions for employees who violates these provisions, and also still lacks employee compliance with existing rules, so that employees are unable to carry out their obligations effectively; and (2) Factors influencing the implementation of Government Regulation Number 53 Year 2010 concerning Discipline of Civil Servants in the Kahu District Office of Bone Regency, among others: quality of civil servants, behavior of civil servants, welfare of civil servants, legal structure, legal culture, legal knowledge, and legal sanctions.

Abstract

Tujuan penelitian menganalisis kedudukan jaksa selaku pelaksana mewakili negara dalam sistem peradilan pidana dan independesi jaksa selaku pelaksana mewakili negara dalam sistem peradilan pidana. Metode Penelitian ini adalah penelitian hukum normatif. Hasil penelitian bahwa (1) Kedudukan dan peran Kejaksaan Republik Indonesia dalam sistem pemerintahan telah ditegaskan dalam penjelasan UUD 1945 dan Undang-Undang Nomr 16 Tahun 2004 tentang Kejaksaaan Republik Indonesia yang menyatakan bahwa kedudukan kejaksaan adalah lembaga pemerintahan yang melaksanakan kekuasaan negara terutama dibandingkan penuntutan di lingkungan peradilan umum. (2) Pelaksanaan fungsi kejaksaan dalam melaksanakan tugas dan wewenangnya Kejaksaan membina hubungan kerjasama dengan badan penegak hukum dan keadilan serta badan negara atau instansi lain. The research objective to analyze the position of the prosecutor as the executor of representing the state in the criminal justice system and the independence of the prosecutor as the executor of representing the state in the criminal justice system. Methods This research is a normative legal research. The results of the study are that (1) The position and role of the Prosecutor's Office of the Republic of Indonesia in the government system has been confirmed in the explanation of the 1945 Constitution and Law Number 16 of 2004 concerning the Prosecutor's Office of the Republic of Indonesia which states that the position of the Prosecutor's Office is a government institution that exercises state power, especially compared to prosecution in the environment. general court. (2) Implementation of the function of the public prosecutor's office in carrying out its duties and authorities. The Prosecutor's Office maintains cooperative relations with law and justice enforcement agencies and state agencies or other agencies.

Abstract

Tujuan penelitian menganalisis pengawasan Inspektorat Kabupaten Barru dalam mewujudkan tata pemerintahan yang baik (good governance) dan faktor-faktor yang mempengaruhi. Metode penelitian menggunakan tipe penelitian empiris. Hasil penelitian menunjukkan bahwa: 1). Optimalisasi Pengawasan Inspektorat Kabupaten Barru dalam mewujudkan tata pemerintahan yang baik (good governance) telah dilaksanakan dengan mempedomani ketentuan peraturan perundang-undangan, namun pelaksanaannya tidak optimal. Karena ditemukan fakta bahwa rendahnya tingkat kapabilitas serta jumlah APIP Inspektorat Kabupaten Barru yang mengakibatkan penerapan SPIP tidak berjalan sesuai denga apa yang di harapkan; 2). Faktor yang mempengaruhi Optimalisasi Pengawasan Inspektorat Kabupaten Barru dalam mewujudkan tata pemerintahan yang baik (good governance), adalah: adanya faktor peraturan perundang-undangan, faktor peranan APIP, dan faktor sarana dan prasarana. The research objective is to analyze the supervision of the Inspectorate of Barru Regency in realizing good governance and the influencing factors. The research method uses an empirical research type. The research results show that: 1). Optimizing Supervision of the Inspectorate of Barru Regency in realizing good governance has been carried out by referring to the provisions of laws and regulations, but the implementation is not optimal. Due to the fact that the low level of capability and the number of APIP Inspectorate of Barru Regency was found, the implementation of the SPIP did not work as expected; 2). Factors that influence the Optimization of Barru Regency Inspectorate Supervision in realizing good governance, are the presence of laws and regulations, the role of APIP, and facilities and infrastructure factors.

Abstract

This research aims to analyze and find out the reality of the enforcement of illegal fishing law in Indonesia as well as the enforcement of illegal fisheries law in indonesia after the introduction of the Ciptaker Act. The type of research used is normative research, i.e. research with legislative approaches and supporting literature as research source material. The results of the study indicate that (1) the enforcement of the law of illegal fishing in Indonesia as well as enforcing the law on illegal fisheries in Indonesia after the creation of the Ciptaker Act, is basically aimed at protecting fishing resources,ining the sustainability of the marine environment, and ensuring that seafood can be sustainably utilized by future generations. (2) The enforcement of illegal fishing laws in Indonesia after the introduction of the Ciptaker Act, there are some changes in regulations that affect the enforcing of illegal fisheries law in Indonesia.

Abstract

The purposes of this research are 1) to know and analyze the law enforcement for hate speech against religions and denominations in Indonesia, 2) to know and analyze the factors which influence the law enforcement for hate speech against religions and denominations in Indonesia. The research used an empirical method that reviewed the processing and functioning of law in society, specifically analyzing the law enforcement for hate speech against religions and denominations in Makassar, Polrestabes, and Pengadilan Negeri Makassar. The result of this research shows that the law enforcement for hate speech against religions and denominations in Indonesia is still ineffective, with numerous instances of hate speech occurring without any affirmative action from law enforcement agencies. Additionally, the police have been unsuccessful in enforcing the law against hate speech, and there is a lack of regulations governing hate speech against religions and denominations. The society's black-and-white mindset, which separates religious affairs from state affairs, also contributes to this issue. The recommendations are, 1) the apparatus must have an active role to get through the spread of hate speech against religions and denominations, in particular under Circular No SE/ 06 / X /2015 about handling hate speech as a procedure, 2) construct particular rules about speech and preaching involving religion and denominations, 3) create particular rules for hate speech against religions and denominations to determine any hate speech that will be determined.

Abstract

Tujuan penelitian menganalisis pengaturan sanksi pidana kurungan sebagai pengganti pidana denda pada tindak pidana korupsi. (2) Untuk menganalisis dan mengetahui penerapan sanksi pidana kurungan sebagai pengganti pidana denda pada tindak pidana korupsi. Metode penelitian yang digunakan dalam penelitian ini adalah tipe penelitian empiris. Hasil penelitian menyatakan (1) Pengaturan mengenai pidana denda tidak diatur didalam undang-undang tindak pidana korupsi tetapi mengacu terhadap Pasal 30 Kitab Undang-Undang Hukum Pidana (KUHP). Nominal denda berdasarkan Pasal 2 ayat (1) Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi Sebagaimana telah diubah dengan Undang-Undang Nomor 20 Tahun 2001 paling sedikit 200 juta rupiah dan paling banyak 1 miliar rupiah. (2) Penerapan sanksi pidana denda dalam tindak pidana korupsi dilakukan oleh jaksa dan eksekusi dapat dilakukan oleh jaksa apabila panitera sudah mengirimkan salinan surat putusan kepadanya, dan setelah eksekusi dilakukan maka jaksa mengirimkan tembusan berita acara pelaksanaan putusan pengadilan yang ditanda tangani olehnya kepada lembaga pemasyarakatan dan terpidana kepada pengadilan yang memutus perkara pada tingkat pertama, dan panitera mencatat dalam register pengawasan dan pengamatan. The research objective is to analyze the regulation of imprisonment as a substitute for fines for criminal acts of corruption. (2) To analyze and determine the application of imprisonment as a substitute for fines for criminal acts of corruption. The research method used in this research is empirical research type. The results of the research state that (1) Regulations regarding criminal fines are not regulated in the corruption law but refer to Article 30 of the Criminal Code (KUHP). The nominal fine based on Article 2 paragraph (1) of Law Number 31 of 1999 concerning the Eradication of Corruption Crimes as amended by Law Number 20 of 2001 is at least 200 million rupiah and a maximum of 1 billion rupiah. (2) The application of criminal sanctions of fines in criminal acts of corruption is carried out by the prosecutor and the execution can be carried out by the prosecutor if the clerk has sent a copy of the decision letter to him, and after the execution is carried out the prosecutor sends a copy of the minutes of the implementation of the court decision signed by him to the correctional institution and the convict to the court that decides the case at the first instance, and the clerk records it in the supervision and inspection register.

Abstract

Kejahatan penodaan agama dipandang dari sudut kebebasan berekspresi dan kebebasan berpendapat. Demokratisasi yang telah melewati batas privat dalam diri setiap individu telah menjadikan penistaan agama sebagai sebuah dilema antara kebebasan berpendapat dan tindak pidana. Penelitian ini dilakukan dengan tujuan: (1) Menganalisis dan menjelaskan penerapan peraturan hukum dan undang-undang terkait penodaan agama melalui media sosial. (2) Menganalisis dan menjelaskan faktor-faktor yang mempengaruhi terjadinya penodaan agama melalui media sosial. Penelitian ini menggunakan metode penelitian hukum empiris, bertujuan untuk mengungkap fakta-fakta lapangan yang terjadi di masyarakat. Lokasi penelitian mencakup media sosial dan Polrestabes Kota Makassar. Data yang dikumpulkan terdiri dari data primer berupa hasil observasi langsung di lapangan, serta data sekunder berupa dokumen dan jurnal-jurnal ilmiah. Data tersebut dianalisis menggunakan metode kualitatif dan disajikan dalam bentuk deskripsi. Hasil penelitian menunjukkan bahwa penerapan pasal 4 Penetapan Presiden Republik Indonesia Nomor 1/PNPS 1965 tentang Pencegahan Penyalahgunaan dan/atau Penodaan Agama sebagai aturan umum, serta Pasal 28 Ayat 2 Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik sebagai aturan khusus, telah dilaksanakan oleh penegak hukum. Tujuannya adalah untuk menciptakan sarana publik yang mempromosikan toleransi antar umat beragama berdasarkan Pancasila sebagai konstitusi negara secara serius dan bertahap.Disarankan agar pemerintah melakukan pengawasan ketat terhadap penggunaan teknologi informasi. Langkah ini bertujuan untuk mencegah dan menanggulangi tindakan penistaan agama melalui media online secara efisien dan efektif. Selain itu, penting untuk meningkatkan pemahaman dan kesadaran masyarakat tentang pentingnya berpikir dan berekspresi dengan baik dan benar. Pengawasan yang ketat dan edukasi yang tepat, diharapkan dapat mengurangi penodaan agama di media sosial dan menjaga kerukunan antar umat beragama di Indonesia.
