Abstract

Para pelaku usaha berlomba-lomba dalam hal mengejar keuntungan sehingga terciptalah suatu iklim persaingan usaha antara perlaku usaha yang satu dengan pelaku usaha yang lain. Hal seperti ini menjadi positif apabila dalam suatu persaingan tersebut menggunakan cara-cara yang adil dan fair. Hal yang terjadi adalah tidak jarang pelaku usaha didasari oleh keinginan untuk menambah keuntungannya menggunakan cara-cara yang melanggar hukum dengan membuat suatu kesepakatan dengan pelaku usaha lain yang bertujuan untuk merusak iklim persaingan usaha yang telah berjalan baik yang salah satunya dikenal dengan istilah kartel. Melalui Undang-Undang Nomor 5 Tahun 1999 Tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat, iklim persaingan usaha dijaga oleh Negara. Komisi Pengawas Persaingan Usaha sebagai garda terdepan dalam hal pengawasan persaingan usaha. Namun terjadi beberapa permasalahan mengenai kewenangannya yang menyebabkan tetap terjadinya kartel dalam suatu persaingan usaha. Penelitian ini berusaha menjawab itu semua melalui pendekatan perundang-undangan, pendekatan konseptual maupun pendekatan kasus agar menghasilkan pemahaman atas permasalahan kartel dan penegakan hukum pidananya di Indonesia.

Abstract

The rejection of life insurance claims due to the insured’s failure to disclose health conditions often leads to legal disputes between insurance companies and beneficiaries. This study aims to analyze the legal basis for claim rejection under Article 251 of the Indonesian Commercial Code (KUHD) and the application of the good faith principle in life insurance contracts. The research employs a qualitative method with a normative juridical and case study approach, examining an actual claim rejection case by Prudential and several court decisions. The findings indicate that concealing material facts about health conditions constitutes a valid legal ground for insurers to reject claims. However, the role of insurance agents, transparency of information, and policyholder education are crucial in ensuring balanced legal protection for both parties. This study recommends strengthening regulations and establishing a more transparent risk verification system to prevent future disputes.

Abstract

The article examines the challenges and opportunities in optimizing the role of the Indonesian police (Polri) in humanistic law enforcement. It highlights structural, cultural, and technical barriers, including inefficiencies in bureaucracy, outdated leadership approaches, and inadequate adoption of modern technology. These issues hinder effective policing and diminish public trust. The article also underscores the importance of aligning law enforcement practices with community-specific cultural contexts, such as handling traditional conflict resolution practices like carok in Madura, by employing a humanistic and dialogical approach. To bridge the gap between societal expectations and on-the-ground realities, the article proposes comprehensive strategies. These include capacity-building through humanistic training, emphasizing empathy and cultural understanding, reforming recruitment processes, and leveraging technology for transparency. The implementation of community policing models, such as Polmas, is highlighted as a practical way to foster collaboration between police and communities. The study employs a combination of normative and sociological approaches, drawing on legislation, direct observation, and interviews with police practitioners. By integrating ethical guidelines, continuous training, and community-centric policies, the article advocates for a transformative policing framework that upholds justice, respects cultural diversity, and strengthens public trust. This framework aligns with Indonesia’s Pancasila values, emphasizing fairness and human dignity in law enforcement.
