Abstract

Program lumbung pangan atau lebih dikenal dengan food estate sebagai salah satu upaya yang diagungkan pemerintah untuk menangani problematika ketahanan pangan di Indonesia, telah ada sejak tahun 1995 pada era pemerintahan Presiden Suharto. Program food estate kembali diagungkan pada pemerintahan Presiden Joko Widodo sesuai dengan ditetapkannya PP Nomor 109 Tahun 2020 tentang Percepatan Pelaksanaan Program Strategis Nasional (PSN). Dalam program tersebut, pemerintah mengupayakan lahan food estate seluas 770.601 Hektar di Kalimantah Tengah, 235.351 Hektar di Sumatera Selatan, 30.000 Hektar di Sumatera Utara, dan 2.052.551 Hektar di Papua. Namun, mayoritas lahan yang hendak digunakan tersebut adalah lahan gambut. Tujuan dilakukannya penelitian ini untuk menganalisis terkait pelaksanaan program food estate dalam konsep good governance dan tanggung gugat pemerintah apabila terjadi kegagalan program food estate. Metode penelitian yang digunakan yaitu metode penelitian hukum normative, dengan Pendekatan Konseptual (conceptual approach) dan Pendekatan Peraturan Perundang-undangan (statue approach). Berdasarkan hasil penelitian, terdapat 2 (dua) temuan sebagai berikut: Pertama, bahwa pelaksanaan program food estate ini tidak memenuhi sepenuhnya konsep good governance, sehingga berakibat terhadap tidak tercapainya hasil yang memuaskan bagi masyarakat. Kedua, bahwa apabila terjadi kegagalan dalam program food estate, seharusnya ada mekanisme yang lebih komprehensif untuk memastikan adanya pertanggungjawaban yang jelas dari pemerintah sebagai penanggung jawab dalam program tersebut.

Abstract

This study aims to analyze whether court decisions in drug abuse cases are based on Indonesia's principles of justice and human rights. This study is important to conduct because there are quite significant differences in the sanctions received by perpetrators of drug crimes, giving rise to the perception that judges are inconsistent in providing fair decisions for perpetrators of drug crimes. In their decisions, judges often ignore the principles of human rights to provide a deterrent effect to perpetrators of drug crimes. Hence, the assumption arises that judges in many cases discriminate against defendants of drug crimes. This study uses a normative legal approach and case studies to examine the case submitted in decision number 1041/Pid.Sus/2024/PN.Sby. Based on these findings, the judge attempts to uphold a fair decision by imposing a sentence commensurate with the error and considering the economic ability of the perpetrator to pay the fine, with the option of additional imprisonment for six months if unable to pay. This decision approach aims to uphold the principles of human rights. Keywords: Drug Abuse; Human Rights; Principle of Justice

Abstract

Introduction: The stipulation of Decision Number 757/Pdt.G/2022/PN.Jkt.Pst raises many pros and cons, namely related to the decision to postpone the 2024 elections. Through the Decision, the Central Jakarta District Court decided and adjudicated the Unlawful Acts dispute filed by the Adil Makmur People's Party against the General Election Commission. The Central Jakarta District Court should not have the authority to adjudicate disputes filed by the Adil Makmur People's Party because it violates absolute competence. Purposes of the Research: The purpose of this study is to analyze the position of the Decision and its legal consequences on the people's sovereignty in the electoral system in Indonesia. Methods of the Research: The research methods used are normative legal research methods, with a conceptual approach, a statue approach and a case approach. Results Main Findings of the Research: The research found that (1) the General Election Commission was right to appeal, showing that the 2024 election must be in accordance with the constitution, and (2) the postponement of the election violates the sovereignty of the people, as the election system in Indonesia should be carried out every five (5) years, and does not recognize the term postponing the election.
