Abstract

The Constitutional Court of Republic of Indonesia is centralized judicial review institution which implements a posteriori and abstract control. Constitutional court decision often politically sensitive and involve important issues. On the one hand handing down strong decisions that uphold important constitutional principles can bring great benefits to citizens and can strengthen support for democracy but on the other hand, strong role of the court in judicial review tends to encroach increasingly on the territory of the law making institution. This article examines the decision of constitutional court in the framework of a tension between constitutionalism and democracy, especially from theoretical or conceptual approach. As result of examining its decisions, Indonesian Constitutional Court may reflect two characters; judicial activism as characterized by acting as law-maker and using policy in judicial decisions and/ or judicial self-restraint.  Recent  Indonesian experience shows that judicial review of legislation is not a simply of judicial control over law-making institution, as it brings  tension in the context of power relations in the scheme of separation of power. Relationship between the court and legislature, in respective of judicial review, will culminate in the philosophy of the judiciary. However, as constitutionalism and democracy are virtue, decisions of the Constitutional Court in judicial review should create mode of self-limitation within the framework of the principle of separation of powers.

Abstract

Justice in election one of the constitutional mandates expressly in Article 22E Paragraph (1) of the 1945 Constitution of the State of the Republic of Indonesia. Nevertheless the Constitution does not provide further guidance on what the meaning of justice in election. Therefore, it is necessary to search philosophically what exactly the meaning of justice in the election. An alternative system is needed as a bridge between the proportional system and the district system. An alternative system must be able to create a minimum majority party in parliament to support presidential policies, improve the accountability the member of parlements and accommodate heterogeneous groups.

Abstract

AbstractThe urgency of establishing a special court for resolving election disputes because this special court is an order of Law Number 8 of 2015 which must be formed before the implementation of the national simultaneous regional elections in 2024. Although, in its development, The Constitutional Court Decision Number 85/PUU-XX/2022, the Constitutional Court has the authority to examine and adjudicate cases of disputes over election results are no longer limited to “until the establishment of a special judicial body”, but will be permanent, because such a special judicial body will no longer be formed. However, this is considered less than ideal. This study aims to outline the urgency of a special judiciary for the resolution of regional head election results in the implementation of national simultaneous elections using conceptual and statutory approaches. The results showed that it is necessary to establish a special judicial model for national simultaneous elections, which is a special judiciary that is ad hoc under the general judicial environment of the Supreme Court. For the seat of the special judiciary for dispute resolution, the regional elections are placed on the High Court to resolve disputes over the results of elections in the province as is the model of the corruption court based in the provincial capital so that the budget for the establishment and management of this special judiciary is not too large. AbstrakUrgensi pembentukan peradilan khusus penyelesaian sengketa pilkada karena peradilan khusus ini merupakan perintah Undang-Undang Nomor 8 Tahun 2015 yang harus dibentuk sebelum pelaksanaan Pilkada serentak nasional tahun 2024. Walaupun, dalam perkembangannya Putusan MK Nomor 85/PUU-XX/2022, Mahkamah Konstitusi berwenang memeriksa dan mengadili perkara perselisihan hasil pemilihan tidak lagi terbatas hanya “sampai dibentuknya badan peradilan khusus”, melainkan akan bersifat permanen, karena badan peradilan khusus demikian tidak lagi akan dibentuk. Tetapi, hal tersebut dirasa kurang ideal. Penelitian ini bertujuan untuk menguraikan urgensi peradilan khusus penyelesaian hasil pemilihan kepala daerah dalam pelaksanaan pemilu serentak nasional dengan menggunakan pendekatan konseptual dan perundang-undangan. Hasil penelitian menunjukkan bahwa perlu dibentuk suatu model peradilan khusus untuk pemilu serentak nasional, yang merupakan sebuah Peradilan khusus yang bersifat ad hoc di bawah lingkungan peradilan umum pada Mahkamah Agung. Untuk tempat kedudukan Peradilan khusus penyelesaian sengketa Pilkada diletakan pada Peradilan Tinggi untuk menyelesaikan sengketa hasil pilkada di wilayah propinsi tersebut sebagaimana model pengadilan tindak pidana korupsi yang berkedudukan di ibukota propinsi sehingga anggaran untuk pendirian dan pengelolaan peradilan khusus ini tidak terlalu besar. Abstract

Presidential government system has its own disadvantages, one of them is the possibility a minority president presence in this system, namely a president who is not supported by a parliamentary majority, even though the President has a strong mandate from public, but with a minority position, the government’s agenda which carried out by the president could be hampered by parliament or the legislature, therefore it is needed a coalition government. The combination of a presidential system with a multi-party system is difficult to implement because whoever the president is elected will be encountered with a certain condition that it is impossible to support him in parliament without forming a coalition. In order to respond the problem in strengthening the presidential system in Indonesia, the author offers a majority general election system or district system (first Past the Post) as an effort to create an effective and responsible government. This is a legal study which used two approaches, namely statutory approach and conceptual approach. Based on the results of study, it can be concluded that the majority system was more appropriate for creating an effective and responsible government because it could encourage the simplification of political parties and the responsibilities of people’s representatives to the voters in each district.

Abstract

E-voting in post-conflict local elections is still a long debate. One of the reasons is related to the security problem e-voting. Over time, system blockchain born which is known unhackable. Therefore, will analyze, first, urgency using e-voting in post-conflict local election system and secondly the formulation use of blockchain-based e-voting in the post-conflict local election system. The method research is legal research with statute approach, conceptual approach, and case approach. As for the results of the study: first, urgency using blockchain in regional head election system, because there are still many problems, namely: 1) Multiple voter data which results in voters being able to vote more than one time, 2) There are still ballots that have been voted, due irresponsible persons, 3) Distribution of ballot boxes and ballots have problems both before and after voting, and 4) Many post-conflict local election officers died and got sick due to fatigue while on duty, and secondly, the formulation use blockchain in electronic-based regional head election system, must considered: 1) review readiness of districts/cities, 2) Making rules with stakeholders, 3) Resource training humans, 4) Socialization to the community, 5) The implementation is carried out systematically tiered, 6) Implement pilot project before implemented.

Abstract

Detention Center/Prison is an institution where defendants who are undergoing trial are held and where criminal sentences are carried out for law violators in Indonesia. In the detention center/prison there are of course rules and regulations that apply to inmates. These provisions are contained in Law 32 of 1995 concerning corrections. Placement in solitary confinement is a form of disciplinary punishment for violators. Silence is given to convicts who are proven to have committed light category offenses more than once or have committed offenses at the moderate level. The aim of implementing silent closure is so that violators can reflect well on their mistakes and are expected not to commit further violations in the future. Because after this, if they commit a violation, the consequences will be more severe.

Abstract

Saat ini, upaya mengatasi disharmonisasi peraturan-perundang-undangan masih memiliki kekurangan yakni, pengharmonisasian hanya dilakukan saat penyusunan peraturan perundang-undangan, tidak menggunakan teknologi, dan evaluasi maupun pemantauan peraturan perundang-undangan tidak dilaksanakan secara berkala. Hal demikian menyebabkan adanya urgensi cara baru untuk mengatasi disharmonisasi peraturan perundang-undangan, yakni melalui legal audit peraturan perundang-undangan. Rumusan masalah di dalam artikel ini 1) urgensi pelaksanaan legal audit untuk mengatasi disharmonisasi peraturan perundang-undangan di Indonesia, dan 2) formulasi penyelesaian disharmonisasi peraturan perundang-undangan dengan mekanisme legal audit. Metode penelitian di dalam artikel ini adalah penelitian hukum, dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil temuan artikel ini adalah pertama, terdapat urgensi pelaksanaan legal audit untuk mengatasi disharmonisasi peraturan perundang-undangan di Indonesia yakni  1) legal audit akan menekan obesitas dan tumpang tindih peraturan perundang-undangan, 2) legal audit dapat menganalisis sesuai dengan fakta dan kebutuhan masyarakat, 3) legal audit dapat berupa pemantauan/pengawasan dan evaluasi secara berkala,  4)pelaksanaan legal audit dapat mengurangi beban keuangan. Kedua, formulasi penyelesaian disharmonisasi peraturan perundang-undangan dengan mekanisme legal audit dalam ius constituendum adalah dengan pengaturan legal audit dalam Peraturan Menteri Hukum dan HAM, yang memuat  tata cara pelaksanaan legal audit yang dapat dilakukan sebelum penyusunan, saat penyusunan rancangan peraturan perundang-undangan maupun setelah pengundangan, serta kerangka kelembagaan pelaksana legal audit.

Abstract

The existence of regional autonomy in Indonesia is implemented through regional leaders who have the authority to run local government. When carrying out their duties, regional leaders are supervised by other state institutions as a form of checks and balances in government power. Hence, the procedure to dismiss regional leaders regulates to involve the Regional People's Representative Assembly, the Supreme Court, and the President through the Minister of Home Affairs as a form of right to dismiss. However, the existence of the proportionality principle in the procedure to dismiss regional leaders, through the right given to regional leaders to defend themselves, has yet to be regulated in the law. This article talks about two things: first, the procedure to dismiss regional leaders, and second, the legal consequences and the position of a chance to summon regional leaders to explain and defend themselves in the procedure to dismiss regional leaders. This article aims to find the importance of proportionality principles in the procedure to dismiss regional leaders. The method used in this article is legal research, with statutes, conceptual, and case approaches. The results of this research show that although the procedure to dismiss regional leaders has been regulated in law, applying the proportionality principle only exists in jurisprudences. Hence, an ius constituendum is needed to determine legal consequences and certainty regarding the procedure to dismiss regional leaders.

Abstract

Recall right of political parties is a process of recalling or replacing members of The House of Representatives carried out by the carrying political parties as a form of controlling the legislative members who represent their parties, which in practice often occur in disputes or legal problems. This thesis aims to find out how the Inter-Time Alternation arrangements in the laws and regulations and what authorities are possessed by the relevant parties in the Inter-Time Alternation mechanism. In this thesis the author uses a normative juridical research method which is carried out by collecting primary legal materials, namely related legislation and literature related to the discussion material in this study and the author uses a statute approach to approach the problem. From the legal research that has been carried out using the research mentioned above, the writer concludes that the regulation of recall in the legislation is regulated in Law Number 17 of 2014 concerning People’s Consultative Assembly, The House of Representatives, Regional Representatives Council and Regional Legislative Council, Law Number 7 of 2017 concerning General Elections and Law Number 2 of 2008 concerning Political Parties which explains that political parties may apply for Inter-time dismissal of The House of Representatives members and the General Elections Commission is authorized to determine Inter-time Substitute candidates.

Abstract

The Corruption Eradication Commission (KPK) is a state entity created under Law No. 30 of 2002 in Indonesia to support the prosecutor’s office and the police in combating corruption. Law No. 30 of 2002 has been subject to multiple judicial reviews by the Constitutional Court (MK). In 2019, a proposal was submitted to amend Law No. 30 of 2002. The modification of the Law has both advantages and disadvantages, with some viewing it as weakening the KPK by categorising it inside the executive branch, thereby impacting the agency’s independence. One of the main focuses of this Article is the authorisation of the KPK to issue a Warrant to Terminate Investigation (SP3). SP3 results from the legal principle of defending human rights and serves as a tool for checks and balances, but it can also be prone to misuse. The research focuses on two main issues: changes in the KPK’s authority and the KPK Institution’s deconstruction. Secondly, the consequences of the KPK issuing SP3 and the risk of authority misuse in combating corruption. This study involves legal research utilising both statutory and conceptual approaches. This paper intends to evaluate the various ways in which power abuse might occur within a corruption eradication system, specifically focusing on delegating authority to the KPK in issuing SP3 from a constitutional standpoint. The conclusions of this study provide a way to prevent the abuse of SP3 through reporting procedures and case titles at the KPK Supervisory Board (Dewas). In addition, the method should include authorising the KPK to revoke SP3.
