Abstract

Setiap warga negara Indonesia berhak mendapatkan pekerjaan serta mendapat imbalan dan perlakuan yang adil dan layak dalam hubungan kerja yang dikenal dengan secara dogmatik dan normatif. Hubungan kerja diatur dalam Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan, sekarang dicabut dengan Undang-Undang No. 11 Tahun 2020 tentang Cipta Kerja, khusus klaster “ketenagakerjaan”. Terdapat isu hukum bahwasanya terdapat Tenaga Kerja Indonesia (TKI) yang bekerja di Kedutaan Asing, sementara tempatnya bekerja termasuk di luar wilayah hukum Negara Republik Indonesia. Seharusnya, jika terjadi perselisihan diajukan ke Arbitrase Internasional, akan tetapi kenyataannya diajukan ke Pengadilan Hubungan Industrial (PHI). Pemeriksaan perkara dilakukan sampai Mahkamah Agung RI. Adapun perkara tersebut telah berkekuatan hukum tetap, yaitu: Putusan Mahkamah Agung RI No. 376K/Pdt.Sus-PHI/2013, tertanggal 29 Oktober 2013 dan Putusan Mahkamah Agung RI No. 696 K/Pdt.Sus-PHI/2016, tertanggal 15 September 2016. Adapun permasalahannya, bagaimana penyelesaian perselisihan ketenagakerjaan terhadap TKI yang bekerja di Kedutaan Asing. Metode penelitian ini adalah penelitian hukum normatif. Putusan pengadilan didapat dari Kepaniteraan Mahkamah Agung RI di Jakarta. Hasil penelitian bahwasanya secara hukum tempat Tenaga Kerja Indonesia tersebut bekerja adalah berada di luar wilayah Negara Republik Indonesia. Oleh sebab itu, secara hukum tidak berlaku hukum Negara Republik Indonesia, ditambah lagi pihak yang digugat adalah Duta Besar sebagai orang yang memiliki kekebalan diplomatik (immunity). Namun, ternyata Mahkamah Agung RI tetap menghukum pihak tergugat untuk membayar hak-hak normatif pekerja.

Abstract

This research examines the employment agreements between foreign state representatives and local workers that are not related to diplomatic functions and therefore do not enjoy diplomatic immunity. While industrial relations disputes typically arise between workers and company management, there have been instances of labor disputes between workers and foreign state representatives. This creates a connection between Indonesia's legal system and the principle of diplomatic immunity in international law. Despite Indonesia's ratification of the Vienna Conventions of 1961 and 1963 through Law No. 1 of 1982, there is currently no specific national legislation governing privileges and immunities. As a result, labor disputes involving diplomatic immunity are dependent on court judgments. The focus of this research is on the severance payment obligations stipulated in labor laws and the responsibility of foreign embassies as employers in Indonesia to make severance payments. The research methodology employed is normative research with a legislative approach. Through qualitative data analysis, the following conclusions were drawn: First, the existence of pension programs does not automatically negate the right to severance pay that workers should receive upon reaching retirement age. Second, the Employment Law is inconsistent in regulating severance payments and pension guarantees as they were initially regulated separately.

Abstract

The development of blockchain technology opens up new opportunities in the digitization of legal documents, including decisions of customary institutions which have previously been documented conventionally and are vulnerable to loss, forgery, and discrepancies in recording. This study aims to analyze the potential for blockchain integration into customary law institutions' decision documentation systems and its implications for increasing legal certainty for indigenous communities and other stakeholders. The research method used is normative juridical, with legislative, conceptual, and comparative approaches, supported by secondary data in the form of literature related to blockchain, customary law, and legal certainty. The research results show that blockchain characteristics such as immutability, transparency, and decentralization can strengthen the authenticity and reliability of customary ruling documentation, making them more secure, permanent, and easily verifiable instruments. This technological integration also has the potential to clarify the position of customary rulings within the national legal system by improving documentation standards and facilitating the presentation of evidence before state institutions. However, blockchain implementation faces challenges such as digital infrastructure readiness, technological literacy among indigenous communities, and the need for regulatory harmonization, particularly regarding data protection, recognition of indigenous communities, and the validity of electronic evidence.
