Abstract

Abstrak : Penelitian ini mengkaji deklarasi keadaan darurat sebagai respons terhadap krisis dan implikasi konstitusionalnya. Penelitian ini menyoroti pertanyaan tentang legitimasi, kebutuhan konstitusi, dan perlunya mekanisme pengawasan selama keadaan darurat. Penelitian ini menekankan pentingnya memperbarui regulasi Indonesia terkait keadaan darurat, dengan merujuk pada masalah dalam kerangka hukum saat ini. Penelitian ini menekankan pentingnya menjaga prinsip supremasi hukum saat merespons ancaman dan krisis.Dengan menggunakan metode yuridis-normatif, tulisan ini juga mencatat adanya inkonsistensi dalam deklarasi keadaan darurat beberapa keadaan darurat bahkan tidak diumumkan secara resmi (de jure). Perubahan dalam regulasi dan pengawasan keadaan darurat menjadi suatu kebutuhan yang mendesak untuk memastikan perlindungan hak asasi manusia, hak konstitusional warga negara, dan penggunaan sumber daya yang terkendali selama kondisi darurat.Ditemukan bahwa Undang-Undang Keadaan Bahaya memberi otoritas pemerintah untuk tindakan darurat, namun ada ketidakpastian dalam aktivasi status darurat di berbagai daerah. Penelitian juga membahas dilema melindungi kedaulatan negara dan hak asasi manusia. Penelitian ini memberikan wawasan tentang konsep dan implementasi keadaan darurat di Indonesia.Dalam konsep keadaan darurat di Konstitusi Indonesia, terdapat ketidakjelasan dan ketidakpastian yang berpotensi merugikan supremasi hukum dan hak asasi manusia. Sejarah penerapan keadaan darurat juga menunjukkan kelemahan dalam pengawasan terhadap kekuasaan eksekutif. Diperlukan amandemen konstitusi, ketentuan yang jelas, serta pengawasan yang lebih kuat dan partisipasi masyarakat sipil selama keadaan darurat. Kata Kunci: Inkonsistensi, Kekuasaan Eksekutif, Keadaan Darurat, Hak Azasi Manusia

Abstract

General elections are pivotal moments in the dynamics of a country's democracy, including in Indonesia. Elections involve various political parties coalitioning to nominate their leaders. This study compares the coattail effect's impact on the 2019 and 2024 elections. The research method employs a normative approach with comparative, conceptual, and historical analyses. Secondary data were collected from various sources. The results indicate differences in the coattail effect's impact between the two elections. Although the popularity of presidential candidates can influence the vote share of their supporting political parties, the effects are not always consistent. In the 2024 election, Prabowo-Gibran won the majority vote, but the coattail effect only occurred for their main supporting party. Conversely, in the 2019 election, PDIP and PKB experienced a more significant coattail effect. The analysis also suggests that the ideal electoral design with a coattail effect involves changing the electoral system to a closed proportional system and removing the Presidential threshold. This study is crucial for understanding the political dynamics within Indonesia's democratic system.

Abstract

Legislation of the presidential institution has been proposed since 2001 through the draft of the Presidential Institution Law. The problem is that presidential impeachment as a mechanism for limiting presidential power is not regulated. This study aims to: First, compare the regulations on presidential impeachment and impeachment in countries. Second, examine the existence of regulations on presidential impeachment and impeachment that currently exist in Indonesia. Third, measure the urgency of carrying out legislation on presidential impeachment in the Presidential Institution Law. This study is a doctrinal legal study that conducts a literature study with a comparative, conceptual, and legislative approach. The results of this study indicate that based on the comparison there are variations in the regulation of presidential impeachment in countries. Still, starting from the important situation of regulating this in both the constitution and legislative products, the regulation of impeachment in Indonesia itself is spread among many laws and regulations which in some cases causes technical problems in resolving the impeachment mechanism. Therefore, it is necessary to codify impeachment in one Presidential Institution Law.
