Abstract

Tujuan dilakukannya penelitian ini adalah untuk mengetahui analisis hukum terhadap perubahan norma undang-undang No.34 Tahun 2004 tentang Tentara Nasional Indonesia. Dengan metode penelitian hukum normatif disimpulkan bahwa dalam rangka menyesuaikan perkembangan maka perlu ditambahkan dalam UU TNI mengenai lembaga yang dapat diisi oleh TNI aktif. Dalam perkembangannya perlu juga diubah definisi yang semula departemen Pertahanan menjadi kementerian Pertahanan. Perubahan ini didasarkan penyesuaian dengan Undang-Undang Nomor 39 Tahun 2008 tentang Kementerian Negara. Selain itu perkembangan produktivitas prajurit TNI aktif yang dianggap masih dapat berperan hingga usia 58 tahun menyebabkan perlu penyesuaian terhadap Undang-Undang Nomor 34 Tahun 2004 tentang Tentara Nasional Indonesia.

Abstract

Business activities carried out by business actors in the investment sector can have a competitive effect that can affect the economy, especially in Indonesia and South Korea. The concept of economy in Indonesia by advancing the idea of democracy with various policies and regulations issued by the government, such as policies in the field of business competition. The Indonesian government issued Law No. 5 of 1999 prohibiting unfair business practices and competition to promote the people's welfare, create fair competition and facilitate investors in doing business. That thing is based on the principle of justice in business. However, on the side, On the other hand, South Korea has the Regulation and Fair Trade Act that provides fair business and investment opportunities. This study uses a normative juridical research method using secondary data, which will then be analyzed using qualitative methods with deductive conclusions. This study concludes that the comparison of business competition law between Indonesia and South Korea implements a legal system of justice and investment opportunities with no restrictions. Both countries, with their legal and government systems, have specific policies and rules, so there are differences: Indonesia with civil law, and South Korea with civil law Inquisitorial. In regulating business competition and investment, Indonesia prioritizes foreign investors' rules and investment periods, while South Korea focuses more on income for the country's prosperity

Abstract

The Navigation Assistance Facility (SBNP) is an essential component that affects shipping safety and security, so a study was conducted to find out the role of the light tower guard in shipping and what obstacles were encountered in optimizing the part of the light guard. Normative research techniques to study the laws and regulations related to shipping implementation in Indonesia. The data came from statutes, regulations, expert theory, previous research, and books. The results showed that lighthouse keepers have two main objectives in shipping: assisting ship navigation in determining direction and location, warning ships when there is danger, and supporting shipping safety and security according to standards in SOLAS 1947 and ISM Code in the Shipping Law. The obstacles damaged buildings, electrical networks, installations, and light balloons that endangered shipping. The damage affects the performance of the light tower in determining the direction and location when the ship is sailing
