Abstract

This study aims to look at the Juridical Review of the Pump and Dump crime in capital market transactions on the Indonesia Stock Exchange based on the Capital Market Law. The main problem that the author discusses and analyzes in this research is the form of the Pump and Dump crime in capital market transactions on the Indonesia Stock Exchange based on the Capital Market Law and the proof of the Pump & Dump crime in the capital market (Case Study of TAXI and LUCK Issuers). The research method is a normative legal research method with a law approach and a case approach. Based on the analysis and provisions of the Capital Market Law, the author concludes that the Pump and Dump crime in capital market transactions on the Indonesia Stock Exchange, can be seen in its form based on certain patterns and methods. The form of the pump and dump pattern and method is in accordance with the elements of market manipulation as stipulated in the provisions of Articles 90 to 93 of the Capital Market Law. To prove that a pump and dump crime has occurred, evidence can be used as regulated in the Criminal Procedure Code.

Abstract

Penelitian ini membahas tentang penerapan economic analysis of law (EAL) dalam perkembangan peraturan perundang-undangan di Indonesia. Konsep EAL menganggap mikroekonomi sebagai pilihan logis dalam analisis permasalahan hukum. Metode penelitian ini menggunakan penelitian hukum. Konsep EAL telah diperhitungkan dalam pengembangan kebijakan, peraturan perundang-undangan. Penerapan EAL terdapat pada beberapa ketentuan hukum, antara lain: (1) KUHP tentang pertanggungjawaban pidana negatif; (2) Undang-Undang Nomor 5 Republik Indonesia  Tahun 1999 Tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat; (3) Undang-Undang Republik Indonesia Nomor 32 Tahun 2009 tentang Pengelolaan dan Perlindungan  Lingkungan Hidup; (4) Undang-Undang Republik Indonesia Nomor 11 Tahun 2016 tentang Pengampunan Pajak; (5) Peraturan Mahkamah Agung Republik Indonesia Nomor 1 Tahun 2020 tentang Pedoman Pemidanaan Pasal 2 dan 3 Undang-Undang Pemberantasan Tipikor; (6) Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja. Konsep EAL perlu diterapkan dalam seluruh kegiatan pengembangan kebijakan atau pengembangan standar hukum, baik dalam pengembangan peraturan perundang-undangan maupun peraturan penegakan hukum untuk menjamin efektivitas dan manfaat. Lebih lanjut, prinsip EAL juga dapat diterapkan pada prinsip tanggung jawab. Prinsip dasar tanggung jawab adalah  suatu pihak hanya dapat dimintai pertanggung jawaban apabila pihak tersebut adalah penyebab kerugian.

Abstract

The government has replaced Law Number 2 of 2022 on Job Creation, eliminating derivative provisions from Law Number 11 of 2020 on Employment and citing the principles of Legal Certainty and Protection. The terms of employment contracts are predominantly governed by Law Number 13 of 2003 on Manpower, with specific provisions from Law Number 11 of 2020 remaining intact, such as the conversion from Fixed-Term Work Agreements/ Perjanjian Kerja Waktu Tertentu (PKWT) to Permanent Work Agreements/Perjanjian Kerja Waktu Tertentu (PKWTT). Meanwhile, Government Regulation Number 35 of 2021 has been rescinded by the newly implemented Regulation, posing challenges for legal status adjustments in district courts. This investigation aims to scrutinize and elucidate the execution of converting PKWT to PKWTT before enacting the Government Regulation in Lieu of Law (Perppu) and the Omnibus Law. Subsequently, the aim is to explore and clarify the conversion of fixed-term work contracts such as PKWT into permanent work contracts such as PKWTT  following the implementation of the Perppu. This study adopts a normative/doctrinal approach. The consulted literature encompasses various legal documents, including Government Regulation Number 35 of 2021. Then, it was found that the significance of regulations concerning the PKWT to PKWTT conversion was underscored in offering clarity to workers in their daily tasks. The Manpower Law imposes restrictions on work agreements with employees, mandating written contracts in Indonesian and prohibiting multiple extensions beyond the stipulated limit.
