Abstract

The authority to administer social security for ASN (Civil Servant) in Indonesia is an important issue that must be resolved as a form of active attitude in providing certainty of rights to social security. The emergence of regulations issued by the state through its current government has resulted in a difference in the acquisition of rights to social security for ASN and which institutions have the authority to administer it. The regulations are the ASN Law and PP 70/2015. The research aims to analyse the certainty of the authority to administer and acquire social security rights for ASN based on the laws and regulations governing the implementation of social security. This study uses a juridical-normative approach and is descriptive. Based on the research conducted, the results obtained are that the authority for administering social security for ASN in Indonesia is regulated in the SJSN Law and the BPJS Law, where two BPJS are authorised to manage social security based on SJSN, namely BPJS Health and BPJS Employment. This authority can also be seen from the legal principle of Lex Specialis Derogat Lex Generalis, where the authority to administer social security for ASN must refer to the SJSN Law and BPJS Law, not the ASN Law. The Constitutional Court Number 7/PUU-III/2005 also confirms that the implementation of ASN social security, which state-owned companies previously carried out, is contrary to the 1945 Constitution and has no binding legal force. The existence of different interpretations and practices of ASN social security protection that are not following the current SJSN creates uncertainty and the potential loss of rights to social security protection for ASN, especially JKP, which was born after the enactment of the Job Creation Law and PP 37/2021.

Abstract

This research aims to describe the changes in the provisions on the employment of foreign workers in Indonesia. In order to create job opportunities, through Act No. 11 of 2020 on Job Creation, there is a simplification of the requirements for foreign workers. It is different from the previous one based on Act No. 13 of 2003 on Manpower, which the employment of foreign workers is an exception with certain conditions. This research used a normative juridical method with a statutory approach, it can be concluded that the provisions under Act No. 11 of 2020 on Job Creation which only requires the endorsement of Foreign Workers Utilization Plan to employ foreign workers, make it easier for foreign people to work in Indonesia. As a result, there is intense competition between foreign and local workers. The government is responsible for fulfilling the rights of citizens to obtain work, lest the simplification of foreign workers requirements to work in Indonesia causing violations of the human rights of citizens. Therefore, it is necessary to strive so that local workers are not excluded from foreign workers.

Abstract

Wages are workers right that are received and expressed in the form of money as reward from the employers to the employee which is determined and paid according to an employment agreement or statutpry regulations. As a right for workers, the protection of workers against wages should be a concern. When workers are given wages below the minimum wage, it raises several problems. In some regulations, it has been regulated that employers must pay wages to their workers with minimum wage provisions. When workers have been employed and given wages below the minimum wage, it certainly does not reflect the existence of legal protection that accommodates the interests and welfare of these workers. The research method used is normative juridical, which is process to find a rule of law, legal principles and legal doctrines to answer the legal problems faced. The data analysis used is normative qualitative data analysis. Based on analysis results, information can be obtained that legal protection of wages for workers has been regulated in the legislation. However, its implementation is not optimal and there are still some deviations. Therefore, it is necessary to have a supervisory role by Dinas Tenaga Kerja on the implementation of the wage system in employment agreements so that the right of workers can be accommodated to the maximum

Abstract

Tujuan dari penelitian ini untuk memahami kedudukan Akta Notaris sebagai alat bukti dalam pemeriksaan perkara dimuka pengadilan dan mengetahui Peran Notaris sebagai saksi dalam memberikan keterangan terhadap akta yang dibuatnya dimuka pengadilan. Penulisan ini merujuk putusan Nomor 1149/Pid.B/2017/PN Surabaya. Studi ini menggunakan Metode penelitian hukum normatif dengan pendekatan perundang-undangan. Hasil Studi menunjukkan bahwa kedudukan Akta Notaris sebagai alat bukti dalam pemeriksaan perkara dimuka pengadilan hanya sebatas membuktikan saja dan sempurna serta peran notaris sebagai saksi dalam perkara pidana yaitu berhubungan dengan hal pembuktian bahwa akta autentik mempunyai kekuatan bukti formil dan materiil. The purpose of this study is to understand the position of the Notary Deed as evidence in the examination of cases before the court and to know the role of the Notary as a witness in providing information on the deed he made before the court. This writing refers to the decision Number 1149/Pid.B/2017/PN Surabaya. This study uses a normative legal research method with a statutory approach. The results of the study show that the position of the Notary Deed as evidence in the examination of cases in advance is only adequate and perfect and the role of the notary as a witness in criminal cases is related to proving that an authentic deed has the strength of formal and material evidence.

Abstract

ABSTRAK Tujuan studi ini ialah untuk mengkaji urgensi peran Notaris dalam pembuatan akta Perseroan Pemegang Saham Tunggal, pertanggungjawaban hukum Perseroan Pemegang Saham Tunggal dan peran legalitas pemegang saham tunggal sebagai upaya percepatan pembangunan ekonomi nasional. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil studi menunjukkan bahwa akta Notaris dalam pendirian akta Perseroan Pemegang Saham tidak diharuskan menurut Undang-Undang Cipta Kerja namun jika digunakan dapat memperkuat legalitas Perseroan Pemegang Saham Tunggal. Status hukum Perseroan Pemegang Saham Tunggal yaitu bertanggungjawab secara terbatas sesuai dengan ketentuan Undang-Undang Perseroan Terbatas. Dalam perspektif pembangunan ekonomi nasional, perseroan terbatas memiliki peran sebagai stimulus pengusaha dalam memulai bisnis. Kata Kunci: Notaris, Akta Notaris, Perseroan Terbatas, Pemegang Saham Tunggal, Pembangunan Ekonomi ABSTRACTThis study aims to provide readers with an understanding of the urgency of the Notary role in making deed for single member company, the legal status and the legal responsibility of a legal entity, and the role of single member company as an effort to accelerate national economic development. This study uses a normative legal research method with statutory and conceptual approach. The results of the study show that a Notary deed in the establishment of a single member company is not required according to Job Creation Law. But can be used to reinforce the legality of a single member company. A single member company has the status of a legal entity and shareholders have limited liability in accordance with limited liability company in general. In the perspective of national economic development, limited liability companies plays an important role as a stimulus for entrepreneurs in starting a business to form the ease of doing business. Key Words: Notary, Notary Deed, Limited Liability Company, Sole Shareholder, Economic Development.

Abstract

Abstrak Salah satu kewajiban seorang Notaris berdasarkan Undang-Undang Jabatan Notaris adalah menjaga kepentingan pihak yang terkait dalam perbuatan hukum. Notaris harus menjaga kepentingan klien dalam melakukan suatu perbuatan hukum dengan bantuannya. Notaris sendiri dapat rangkap jabatan sebagai seorang Pejabat Pembuat Akta Tanah atau PPAT sebagaimana diatur dalam Pasal 7 ayat (1) Peraturan Pemerintah Nomor 24 Tahun 2016 tentang Perubahan Peraturan Pemerintah Nomor 37 Tahun 1998 tentang Peraturan Jabatan Pejabat Pembuat Akta Tanah. Sertifikat milik klien Notaris maupun PPAT merupakan salah satu yang harus dijaga dengan baik oleh Notaris dan PPAT. Namun, apabila seorang pegawai kantor Notaris atau PPAT memberikan sertifikat kepada orang lain selain klien tanpa sepengetahuan mereka, maka perbuatan pegawai tersebut mengakibatkan Notaris atau PPAT tidak dapat memenuhi kewajiban profesinya. Perbuatan pegawai tersebut dapat dikatakan sebagai perbuatan melawan hukum. Oleh karena itu, perlu dianalisis lebih lanjut mengenai perlindungan hukum bagi seorang Notaris atau PPAT apabila pegawai kantornya melakukan pemberian sertifikat milik klien kepada orang lain tanpa sepengetahuan Notaris. Kata kunci: Notaris, PPAT, Kewajiban, Sertifikat, Klien, Perbuatan Melawan Hukum, dan Pegawai. Abstract One of the obligations of a Notary under Undang-Undang Jabatan Notaris is to protect the interests of the parties involved in legal actions. Notaries must protect the interests of clients in carrying out legal actions with their assistance. The Notary himself can hold concurrent positions as a Land Deed Official or PPAT as regulated in Article 7 paragraph (1) Government Regulation Number 24 of 2016 concerning Amendment to Government Regulation Number 37 of 1998 concerning Regulation of the Position of Land Deed Official. The certificate belonging to the Notary and PPAT clients is one that must be maintained properly by the Notary and PPAT. However, if an employee of the Notary's office or PPAT gives a certificate to someone other than the client without their knowledge, then the employee's actions result in the Notary or PPAT being unable to fulfill their professional obligations. The employee's actions can be said to be against the law. Therefore, it is necessary to further analyze the legal protection for a Notary or PPAT if his office employee gives the client's certificate to another person without the Notary's knowledge. Keywords: Notary, Land Deed Official, Obligations, Certificates, Clients, Tort, and Employees.

Abstract

AbstractNotaries as public officials have the function to create perfect evidence, act carefully and do their work in all honesty to maintain the dignity of a notary. In the making of an authentic deed, witnesses who participate in the making of the authentic deed are required. Witnesses and its qualification, or conditions that must be met by the witnesses have been determined by the law that can be found in Article 40 of Law Number 2 of 2014. The issue raised in this case is the Supreme Court Decision Case Number 156 K/PDT/2020. In this case, there are two deeds of sale and purchase which have the siblings of the seller stated as the witnesses . Therefore, this study will discuss what legal consequences arise from these actions and the responsibility of the notary as the party who made the deed of sale and purchase of the land. Keywords: Witness, Sale and Purchase, Deed AbstrakNotaris sebagai pejabat umum memiliki fungsi untuk menciptakan alat pembuktian yang sempurna, bertindak hati-hati serta jujur dalam bekerja dan menjaga martabat Notaris. Saksi sendiri diatur dalam Pasal 40 Undang-undang Nomor 2 Tahun 2014 Tentang Jabatan Notaris, adapun syarat yang harus dipenuhi oleh saksi telah ditentukan oleh Undang-undang. Permasalahan yang diangkat dalam kasus ini adalah mengenai Kasus Putusan Mahkamah Agung Nomor 156 K/PDT/2020. Pada kasus ini, dua orang kakak beradik menjadi saksi pada akta jual beli tanah yang dibuat oleh satu sama lain. Abstract

AbstractA Notary, is one of the professions in the law field, that truly deserves legal protection in carrying out their duties and functions as public officials that are authorized to make authentic deeds. Therefore, in the even of a notary is suspected of committing a violation of criminal law or an unlawful act, the role of the Notary Honorary Council is urgently needed to participate in providing legal protection for notaries. The duties and functions of the Notary Honorary Council itself is to give approval or refusal for the purposes of investigation in the judicial process. This also plays an important role because it aims to maintain the authority of a notary, so that there is no legal process that goes wrong or inappropriate even arbitrarily by criminalizing the act of a notary as a criminal offense, not necessarily an error in criminal law. However, in practice, this function still has several obstacles. This can be seen in the Court Verdict No. 20/PK/Pid/2020, where a notary is criminally charged, even though it is not classified as a criminal realm, but in the administrative realm. Keywords: Notary Honorary Council, criminal law, and legal protection. AbstrakNotaris, merupakan salah satu profesi di bidang hukum yang sudah sepatutnya mendapatkan perlindungan hukum dalam menjalankan tugas dan fungsinya sebagai pejabat publik yang diberi wewenang untuk membuat akta autentik. Oleh karena itu, dalam hal seorang notaris diduga melalukan suatu pelanggaran hukum pidana atau perbuatan melawan hukum, peran Majelis Kehormatan Notaris sangat dibutuhkan untuk turut memberikan perlindungan hukum bagi notaris. Tugas dan fungsi dari Majelis Kehormatan Notaris sendiri, adalah memberikan persetujuan atau penolakan untuk kepentingan penyidikan dalam proses peradilan. Hal ini juga memegang peranan penting karena bertujuan untuk menjaga wibawa notaris, agar tidak terjadi proses hukum yang salah atau tidak tepat bahkan sewenang-wenang dengan mengkriminalisasi perbuatan notaris sebagai tindak pidana, yang belum tentu merupakan kesalahan dalam hukum pidana. Namun, dalam pelaksanaannya, fungsi ini masih memiliki beberapa kendala. Hal ini dapat dilihat dalam Putusan Mahkamah Agung No. 20/PK/Pid/2020, dimana seorang notaris dijerat hukuman pidana, meskipun sebenarnya tidak tergolong ke dalam ranah pidana, tetapi dalam ranah administrasi. Kata Kunci: Majelis Kehormatan Notaris, hukum pidana, dan perlindungan hukum.

Abstract

AbstractNotaries as public officials have the function to create perfect evidence, act carefully, and be honest in their work and maintain the dignity of the notary. In the Company Law, it is regulated that shareholders either alone or based on a power of attorney have the right to attend the General Meeting of Shareholdersand use their voting rights in accordance with the number of shares owned. Through this article, we can see that if shareholders are unable to attend, they can assign someone else to represent them. The issue raised in this case is the District Court Decision Case Number 94/Pdt.G/2017/PN.Lbp. In this case, Defendant II, was present at the General Meeting of Shareholders on behalf of the Plaintiff, on the basis of the power of attorney which had been revoked. The defendant even gave a share of the party represented to him, even though he did not have the right to do so. Therefore, this study will discuss what legal consequences arise from the act of granting using a power of attorney that is no longer valid and the responsibility of the notary as the party making the grant deed. Keywords: Power of Attorney, Shares, Grants, Unlawful Acts.  AbstrakNotaris sebagai pejabat umum memiliki fungsi untuk menciptakan alat pembuktian yang sempurna, bertindak hati-hati serta jujur dalam bekerja dan menjaga martabat Notaris. Dalam UUPT, diatur bahwa pemegang saham baik sendiri maupun diwakili berdasarkan surat kuasa berhak menghadiri RUPS dan menggunakan hak suaranya sesuai dengan jumlah saham yang dimilikinya. Melalui pasal ini, dapat kita ketahui bahwa apabila pemegang saham berhalangan untuk hadir, maka mereka dapat memberikan orang lain hak untuk mewakili mereka. Permasalahan yang diangkat dalam kasus ini adalah mengenai Kasus Putusan Pengadilan Negeri Nomor 94/Pdt.G/2017/PN.Lbp. Pada kasus ini, Tergugat II, hadir dalam RUPSLB mewakili Penggugat, atas dasar Surat kuasa yang tidak memiliki kekuatan hukum. Tergugat bahkan melakukan hibah saham pihak yang diwakilkan kepada dirinya, meskipun dia tidak punya hak untuk itu. Oleh karena itu, Penelitian ini akan membahas akibat hukum apa yang timbul dari tindakan hibah menggunakan surat kuasa yang sudah tidak berlaku serta pertanggungjawaban notaris selaku pihak yang membuat akta hibah tersebut. Kata Kunci: Surat Kuasa, Saham, Hibah, Perbuatan Melawan Hukum.

Abstract

AbstrakPerjanjian jual beli tanah merupakan salah satu perjanjian yang sering ditemukan di masyarakat khususnya di Indonesia. Akan tetapi, jual beli tanah sering mengalami berbagai macam permasalahan yang mana salah satu penyebabnya adalah kesalahan yang terjadi pada saat pembuatan perjanjian itu sendiri. Dalam pembuatan perjanjian tersebut tidak jarang ditemui adanya itikad buruk dari salah satu pihak dalam perjanjian tersebut. Itikad buruk sering ditujukan untuk kepentingan pribadi salah satu pihak sehingga akan menimbulkan kerugian bagi pihak lainnya yang beritikad baik. Hal tersebut tentunya akan menimbulkan ketidakadilan bagi pihak yang dirugikan. Oleh karena itu, perlu dianalisis lebih lanjut cara penentuan itikad baik dan buruk serta bagaimana perlindungan hukum bagi pihak yang beritikad baik dalam jual beli tanah. Kata kunci: Perjanjian, Jual beli tanah, Itikad, dan Perlindungan Hukum. AbstractLand sales and purchase agreement is one of many agreements that often can be found in our society especially in Indonesia. However, land sales and purchase often get various problems that one of the cause is mistake when that agreement was made. When that agreement was made, occasionally followed with bad faith from one of the partie. Bad faith often done for their own interest so that will cause lost for the other partie that had a good faith. That situation of course will cause injustice for parties who get lost. Therefore, there needs to further analysis about how to determine good faith and bad faith also how legal protection to partie that have a good faith in land sales and purchase. Keywords: Agreement, Land sales and purchase, Faith, and Legal Protection.
