Abstract

Abstrak Koperasi Karyawan Sabilal Muhtadin Banjarmasin (Kopkar SMB) memiliki produk pembiayaan yang pada awalnya masih menerapkan prinsip konvensional, namun atas dasar kesadaran dari para anggota untuk bermuamalah secara syariah, praktik pembiayaan diubah menggunakan akad murabahah bil wakalah dengan skema akad berdasarkan arahan dari salah satu anggota. Sehingga diperlukan penelitian yang bertujuan untuk mengetahui apakah praktik akad tersebut telah sesuai dengan prinsip syariah. Penelitian ini merupakan jenis penelitian hukum empiris. Hasil penelitian menunjukkan bahwa akad murabahah bil wakalah yang dilaksanakan belum sesuai dengan prinsip syariah karena akad wakalah dan murabahah dilaksanakan berurutan dalam satu waktu, pembelian barang dilaksanakan atas nama anggota, dan barang tidak diserahterimakan saat akad berlangsung. Ketidaksesuaian ini menyebabkan tidak terpenuhinya syarat murabahah, yaitu objek jual beli dimiliki penjual secara penuh dan dapat diseraterimakan, sehingga akad menjadi tidak sah. Kata Kunci: Murabahah bil Wakalah, Koperasi, Pembiayaan.   Abstract Sabilal Muhtadin Banjarmasin Employee Cooperative (Kopkar SMB) has financing product which initially still applied conventional principles, but based on the awareness of the members to practice in accordance to sharia, financing in practice has changed to using murabahah bil wakalah contract scheme based on instructions from one of the members. Research is needed to find out whether contract practices are in accordance with sharia principles. The type of this research is empirical legal research. The research results show that the murabahah bil wakalah contract implemented is not in accordance with shariah principle because the wakalah and murabahah contracts are implemented sequentially at one time, purchase of goods is carried out in the name of the member, and goods are not handed over at the time contract take places. This discrepancy causes the murabahah terms to not be fulfilled, namely the object of sale and purchase is fully owned by the seller and can be handed over, so the contract becomes invalid. Abstract

Waqf is a significant instrument in Islamic teachings that functions not only as a form of worship but also plays a strategic role in enhancing the social and economic welfare of society. However, in practice, waqf often faces various legal challenges, such as the validity of the waqf declaration, the appointment of nazhir (waqf managers), and conflicts between heirs and beneficiaries. This study aims to provide a comprehensive understanding of the strategic position of waqf, analyze the root causes of legal issues that arise in its management, and evaluate the role of the Religious Courts in resolving waqf disputes fairly. The research method used is normative juridical, with a literature review approach focusing on Law Number 41 of 2004 concerning Waqf and various relevant legal sources. The findings reveal that waqf disputes commonly involve issues of legality, asset exchange or sale, and the annulment of waqf declarations. The study also identifies disparities in judicial decisions, influenced by differences in the judges’ educational backgrounds and legal approaches. Therefore, there is a need to strengthen national jurisprudence as a reference in waqf-related cases, provide training for nazhir to enhance professionalism, improve the capacity of judges in Religious Courts, and promote legal education among the public. These efforts are expected to create a more just, consistent, and effective dispute resolution system, thereby supporting the productive and sustainable management of waqf assets.

Abstract

Mahdah worship holds a central position in Islamic teachings as a pure form of servitude to Allah SWT. Due to its tauqifi nature, the implementation of mahdah worship must strictly adhere to the provisions of the Sharia without additions or modifications. This study aims to examine and analyze specific fiqh principles that serve as guidelines in the practice of mahdah worship. A qualitative method with a library research approach was employed, through an in-depth review of classical and contemporary literature related to fiqh principles. The findings indicate that principles such as "the default rule in worship is tauqifi," "purity is not limited by time," and "no analogy (qiyas) applies to acts of worship whose rationale is unknown" function to safeguard the authenticity of worship practices from deviation. Understanding these principles is crucial to prevent innovations (bid‘ah) and to ensure that every act of worship remains aligned with Sharia directives. Furthermore, mastery of these principles assists muftis and jurists in issuing consistent and coherent fatwas. The implications of this study highlight the significance of fiqh education in strengthening the community’s awareness of authentic worship and providing a solid framework for evaluating religious practices amidst contemporary socio-religious dynamics.
