Abstract

Abstrak Perlindungan Konsumen merupakan upaya yang menjamin  adanya kepastian hukum untuk memberikan perlindungan kepada konsumen.  Pada kenyataannya masih sering terjadi permasalahan dari akibat hukum karena  adanya wanprestasi. Perjanjian timbul suatu hukum yang dinamakan perikatan. Hubungan hukum  menimbulkan akibat hukum dan dijamin oleh Undang-Undang apabila salah satu  pihak tidak memenuhi hak dan kewajiban maka salah satu pihak dapat menuntut  melalui pengadilan. Pemberian pembiayaan kepada konsumen harus didahului  dengan adanya suatu perjanjian pembiayaan konsumen. Hal ini karena  pelaksanaanya memiliki peluang terjanjinya resiko yang tidak sesuai dengan apa  yang telah ditetapkan oleh masing-masing pihak dalam perjanjian/atau biasa  disebut dengan wanprestasi Dalam suatu perjanjian timbul suatu hubungan hukum antara dua pihak  yaitu debitur dan krediur yang dinamakan perikatan. Hubungan hukum adalah  hubungan yang menimbulkan akibat hukum dan dijamin oleh hukum dan  Undang-Undang apabila salah satu pihak tidak memenuhi hak dan kewajiban  secara sukarela maka dengan itu salah satu pihak dapat menuntut melalui  pengadilan.  Kata kunci : Perlindungan Hukum, Penarikan Objek, Jaminan Fidusia, E.Abstract Consumer Protection is an effort that ensures legal certainty to protect consumers. In reality, problems still often occur due to legal consequences due to default. An agreement creates a law called an agreement. Legal relationships give rise to legal consequences and are guaranteed by law. If one of the parties does not fulfill their rights and obligations, then either party can sue through the court. Providing financing to consumers must be preceded by the existence of a consumer financing agreement. This is because its implementation has the potential for risks that are not by what has been determined by each party in the agreement/or what is usually called default. In an agreement, a legal relationship arises between two parties, namely the debtor and the creditor, which is called an obligation. A legal relationship is a relationship that gives rise to legal consequences and is guaranteed by law and law. Abstract

ABSTRACTIn Simanindo District, Dos Roha Village, Samosir Regency, North Sumatra, in resolving customary land disputes, they still use institutions outside the court. In this area, there are still conflicting interests. The aim of the research is to examine the things that cause customary land disputes. The aim of the research is to examine the things that cause customary land disputes. The role of Traditional Heads in resolving customary land disputes through mediation. Research technique using normative juridical methods, research type through library research. Primary data obtained through secondary data consisting of primary legal materials in the form of legislation The research results show that the things that cause customary land disputes in Simanindo District, Samosisr Regency are unclear customary land boundaries, unfair practices, claims from the State, loss of historical witnesses and perpetrators, wrong understanding of customs, lack of socialization, economic value of land. The role of the traditional head is very important because he can act as a mandate for peace in land dispute. Keywords: Juridical Review, Land Disputes, Toba Batak Customary Law. ABSTRAKDi Kecamatan Simanindo, Desa Dos Roha Kabupaten Samosir Sumatera Utara  dalam menyelesaikan sengketa tanah ulayat masih menggunakan Lembaga di luar pengadilan. Di wilayah tersebut masih menimbulkan sengketa kepentingan. Tujuan penelitian untuk menelaah hal-hal yang menyebabkan sengketa tanah ulayat. Peran Kepala Adat dalam penyelesaian sengketa tanah ulayat dengan mediasi. Teknik penelitian dengan metode yuridis normatif jenis penelitian lewat penelitian kepustakaan.Data primer diperoleh melalui data sekunder terdiri dari bahan hukum primer berupa perundang-undangan . Hasil penelitian diperoleh bahwa hal-hal yang yang menyebabkan terjadinya sengketa tanah ulayat di Kecamatan Simanindo,Kabupaten Samosisr adalah batas tanah ulayat tidak jelas ,adanya praktek ketidakadilan,adanya klaim dari Negara ,kehilangan saksi dan pelaku sejarah,pemahaman salah terhadap adat,kurangnya sosialisasi ,nilai tanah secara ekonomi. Peran Kepala adat sangat penting karena bisa sebagai amanat perdamaian dalam sengketa tanah.Kata Kunci : Tinjauan Yuridis,Sengketa Tanah, Hukum Adat Batak Toba.

Abstract

Regulation of natural resource management as a pillar of life that is rooted in the welfare and balance of society is a mandate that must be carried out in good faith and with responsibility. One form of this can be found in Regional Owned Enterprises (BUMD), which is one of the channels for managing state assets. The provisions contained in the Minister of Energy and Mineral Resources Regulation Number 37 of 2016 concerning 10% Participating Interest in Oil and Gas Working Areas allow regional governments to participate in management through delegation to BUMD or regional companies. The essence of this effort is to obtain profits that can increase regional income and the welfare of its people. This 10% Participating Interest Regulation, from the start, has succeeded in creating harmony between the rights and obligations between Cooperation Contract Contractors (KKKS) and BUMD. KKKS is responsible for offering 10% participatory interest to regions, as regulated in Minister of Energy and Mineral Resources Regulation Number 37 of 2016. If regions accept this offer through BUMD, they will obtain a maximum management right of 10% in accordance with the mandate stated in the Cooperation Contract between the Special Task Force for Upstream Oil and Gas Business Activities (SKK Migas) and KKKS. In this way, cooperation between regional governments (BUMD and KKKS) can become a firm foundation for managing natural resources in order to achieve shared prosperity.

Abstract

Abstrak : Wujud demokrasi langsung di Indonesia pada pelaksanaannya ditemukan adanya pelanggaran sehingga untuk mengembalikan pelaksanaan Pemilihan Kepala Daerah yang sesuai dengan asas Pemilihan Umum yaitu Luber Jurdil, maka pihak yang kalah dalam Pilkada dapat mengajukan Permohonan Pembatalan.Metode penelitian ini adalah penelitian hukum normatif dengan pendekantan kasus dalam perkara di Mahkamah Konstitusi.Pemohon dalam permohonannya meminta Mahkamah untuk membatalkan Keputusan Komisi Pemilihan Umum Kabupaten Muna Nomor 788/PL.02.06- Kpt/7403/KPU-Kab/XII/2020 tentang Penetapan Rekapitulasi Hasil Penghitungan Perolehan Suara dan Hasil Pemilihan Bupati Dan Wakil Bupati Muna Tahun 2020 yang disahkan tanggal 16 Desember 2020. Dengan demikian penelitian ini melakukan kajian terhadap proses penyelesaian sengketa hasil pilkda di mahkamah Konsitusi untuk melihat tahapan penyelesaian.Dengan Nomor Perkara 53/PHP.BUP-XIX/2021 yang diajukan oleh pasangan calon Bupati dan Wakil Bupati Muna nomor urut 2 LM Rajiun Tumada-La Pili.Berdasarkan hasil penelitian diperoleh kesimpulan, bahwa. Prosedur penyelesaian perselisihan hasil Pemilihan kepala daerah termuat dalam ketentuan Undang-Undang Nomor 24 Tahun 2003 tentang Mahkamah Konstitusi sebagaimana telah diubah terakhir dengan Undang-Undang Nomor 7 Tahun 2020 tentang Perubahan Ketiga Atas Undang-Undang Nomor 24 Tahun 2003 tentang Mahkamah Konstitusi dan Undang-Undang Nomor 6 Tahun 2020 Mahkamah Konstitusi dan Dalam penggujian perkara Nomor 53/PHP.BUP-XIX/2021 sudah sesuai dengan aturan syarat formal pengajuan sengketa perselisihan pasal 158 ayat (2) Undang-Undang Nomor 10 Tahun 2016, syarat formal pengajuan permohonan ke Mahkamah Konstitusi adalah 0,5 persen hingga 2 persen. sedangkan yang diajukan oleh para Pemohon melebihi syarat formal sampai 6,77 Persen. Sehingga berdasarkan ketentuan norma yang berlaku Mahkamah Kosntitusi sudah tepat dan berkeadilan.Kata Kunci Demokrasi, Pilkada, Mahkamah KonstitusiAbstrack : In the form of direct democracy in Indonesia, violations were found in its implementation so that in order to restore the implementation of Regional Head Elections in accordance with the principle of General Elections, namely Luber Jurdil, the party who loses in the Pilkada can submit a Request for Cancellation.This research method is normative legal research with a case approach in cases at the Constitutional Court.The Petitioner in his petition asked the Court to annul the Muna Regency General Election Commission Decree Number 788/PL.02.06-Kpt/7403/KPU-Kab/XII/2020 concerning Determination of Recapitulation of Vote Counting Results and Results of the 2020 Muna Regent and Deputy Regent Election, which was ratified December 16 2020. Thus, this research conducted a study of the regional election dispute resolution process at the Constitutional Court to see the stages of resolution.With Case Number 53/PHP.BUP-XIX/2021 filed by candidate pair Regent and Deputy Regent of Muna serial number 2 LM Rajiun Tumada-La Pili. Based on the research results, it was concluded that. Procedures for resolving disputes over regional head election results are contained in the provisions of Law Number 24 of 2003 concerning the Constitutional Court as most recently amended by Law Number 7 of 2020 concerning the Third Amendment to Law Number 24 of 2003 concerning the Constitutional Court and Laws Number 6 of 2020 of the Constitutional Court and in reviewing case Number 53/PHP.BUP-XIX/2021, it is in accordance with the formal requirements for filing a dispute under Article 158 paragraph (2) of Law Number 10 of 2016, the formal requirements for submitting an application to the Constitutional Court is 0.5 percent to 2 percent. Meanwhile, what was submitted by the Petitioners exceeded the formal requirements by 6.77 percent. So that based on the provisions of the applicable norms, the Constitutional Court is appropriate and fair.Keywords Democracy, Pilkada, Constitutional Court
