Abstract

The Financial Services Authority as an institution that controls insurance sector activities functions to create a financial system that grows sustainably and stably and increases public trust in the insurance sector. As part of supervision of the insurance sector, the Financial Services Authority has the authority to issue bankruptcy statements to insurance companies to protect the interests of policyholders. The aim of this research is to examine the role and jurisdictional perspective of the Financial Services Authority in insurance company bankruptcy cases in Indonesia. OJK is an independent institution that is free from state interference in carrying out its duties, roles and authority in the field of supervision, investigation and research in the financial services sector to create a good national economy. In supervising the insurance sector, the Financial Services Authority has the authority to file bankruptcy applications against insurance companies to protect the interests of policy holders. Insurance companies are regulated in Law no. 21 of 2011 concerning the Financial Services Authority. This research uses a qualitative descriptive approach, which is based on secondary data obtained through library research. The task of the Financial Services Authority in the bankruptcy of an insurance company is to monitor the progress of the insurance company's bankruptcy until its liquidation and to guarantee that the insurance company has paid all its obligations.

Abstract

This research aims to compare the legal framework for child protection in Indonesia and Malaysia. Child protection is an important aspect in social development and community welfare. In this context, a comparison between these two countries provides valuable insights into child protection approaches, policies and implementation. From the research results, it appears that both countries have serious efforts to protect children's rights. However, there are differences in legal approaches and implementation of child protection policies. In Indonesia, there are regulations governing child protection, such as Law Number 23 of 2002 concerning Child Protection, while in Malaysia, there is the 2001 Childhood Act which regulates children's rights. Apart from that, the comparison also covers practical aspects in the implementation of child protection, including child protection programs implemented by the government and related institutions. From the results of this research, it can be concluded that although both countries are committed to child protection, there are differences in legal approaches and implementation of child protection policies. This research provides valuable insights for policy makers, legal practitioners and other stakeholders in efforts to improve child protection in both countries. With a deeper understanding of the differences and similarities in the legal framework for child protection, it is hoped that more effective and comprehensive child protection efforts can be created in the future.

Abstract

Perkembangan dunia bisnis yang sangat cepat membuat para pebisnis memelukan alat pembayaran yang cepat, sederhana dan aman. Di dalam dunia perusahaan dan perdagangan, orang menginginkan segala sesuatunya bersifat praktis dan aman khususnya dalam lalu lintas pembayaran. Artinya, orang tidak mutlak lagi menggunakan alat pembayaran berupa uang, melainkan cukup dengan menerbitkan surat berharga baik sebagai alat pembayaran kontan maupun sebagai alat pembayaran kredit. Penggunaan surat berharga dalam lalu lintas pembayaran mempertimbangkan aspek praktis, keamanan , prestise (kebanggan), dan investasi. Praktis dalam setiap transaksi, para pihak tidak perlu membawa mata uang dalam jumlah besar sebagai alat pembayaran dalam suatu transaksi, melainkan cukup dengan membawa atau mengantongi surat berharga saja. Aman artinya tidak setiap orang yang tidak berhak dapat menggunakan surat berharga itu, karena pembayaran dengan surat berharga memerlukan cara-cara tertentu. Sedangkan jika menggunakan mata uang apalagi dalam jumlah besar banyak sekali kemungkinan timbulnya bahaya atau kerugian, misalnya pencurian, kebakaran atau perampokan, dan lain-lain. Penggunaan surat berharga menjadi pilihan bagi para pebisnis dalam duania perdagangan untuk mempercepat, mempermudah lalu lintas pembayaran dengan aman.
