Abstract

Unregistered marriages have an impact on the marriage itself and on the children born caused its marriage. Even though every child is sacred born and without a sin. A child cannot choose to be born from which parents, nor they can choose to be born from the marriage of their parents. Therefore, a child must be given the protection of their human rights and other rights by their parents, family and the state.The objectives of this research is to find out the child custody status from unregistered marriage on Islamic law in Indonesia. The method used in this research is juridical-normative approach (positive law). The data collection used was classified based on each title. The result of this research showed that the law of unregistered marriage is the same as the law of legal marriage, as regulated in Article 2 paragraph (1) on Law No. 1/1974 regarding of marriage. However, the status of unregistered marriage is still not recognized by Indonesian law, which has been regulated in Article 2 paragraph (2) on Law No. 1/1974. Otherwise, the children status of parents who have unregistered marriages, their status is still not recognized by Law and their custody rights over their mother and mother's family. However, according to Islamic law, the child custody status remains to their parents.The decision of the Constitutional Court will establish the existence of jurisprudential law to realize legal certainty regarding the legal position of children out of wedlock so that they obtain complete legal protection from their parents.

Abstract

Testmonium de audito has not been accepted as evidence under the Criminal Procedure Code because its authenticity has not been tested. Under the Constitutional Court’s decision No.65/PUU-VIII/2010, testimonium de audito is considered as evidence, and can be used in both criminal and civil cases. Therefore, this research is conducted to determine the witness's position in the trial and verdict Number 115/Pid.Sus/2021/PN.Ktg. The case study of Kotamobagu District Court Decision Number 115/Pid.Sus/2021/PN.Ktg and Law No. 8/1981 on the Criminal Procedure Code become the basis of normative legal research methodology in this research, which also used primary and secondary sources. The findings of this research indicate that in Constitutional Court Decision No.65/PUU-VIII/2010, law enforcers should agree that witnesses who actually see, hear, or suffer a criminal event are not always required. On the other hand, Testimonium de Auditu witnesses cannot be used as independent witnesses in the case of Decision No. 115/Pid.Sus/2021/PN.Ktg because it does not include the requirements of the witnesses required.

Abstract

In International Civil Law, several types of breach can be found, one of which is anticipatory breach. The term anticipatory breach has its roots in the concept of repudiation, which covers a wider range of refusals. Repudiation includes not only anticipatory breach, but also every form of refusal to fulfill contractual obligations, both before and after the contract period begins. Anticipatory breach refers to actions that indicate one party's intention not to fulfill its contractual obligations to the other party. This research aims to analyze how the Contract for the International Sale of Goods or CISG and the Civil Code regulate the return of rights for breach committed by one of the parties. The method applied is normative juridical research with statute and comparative approach. The findings of this research indicated that validity of an agreement under Article 1320 of the Civil Code requires an agreement, capacity, a specific object, and a lawful cause. If these subjective and objective conditions are unmet, or if there is a breach causing harm, the agreement may be canceled, but only through a court decision as per Article 1266. Repudiation, the refusal to fulfill an agreement, has two models: the mirror image model and the differentiated model, which assess potential future losses. In international civil law, anticipatory breach, a concept linked to repudiation, is covered in Articles 71-73 of the CISG.

Abstract

This study evaluates the effectiveness of sanctions within Indonesia's legal framework for addressing illegal logging, focusing on the implementation of Law No. 18 of 2013 on Prevention and Eradication of Forest Destruction. Using a normative juridical approach, the research examines the current legal sanctions, their enforcement, and their impact on forest conservation efforts. Findings indicate that while the legal provisions establish substantial penalties, the application of sanctions suffers from inconsistency, corruption, weak enforcement mechanisms, and inadequate institutional capacity. Comparative analysis with international best practices reveals potential improvements, such as the use of satellite monitoring, stronger corporate accountability, and community-based forest management. The study proposes a series of policy recommendations, including the enhancement of penalties, the integration of advanced monitoring technologies, and the promotion of restorative justice practices. By addressing these gaps, Indonesia can strengthen its efforts to combat illegal logging and ensure more effective environmental protection.

Abstract

Aktivitas penangkapan ikan di Selat Madura menghadapi beberapa tantangan, antara lain anomali cuaca dan perubahan musim sehingga memengaruhi hasil tangkapan, terbatasnya akses teknologi perikanan yang lebih modern, dan tekanan ekosistem karena upaya tangkap berlebih. Tujuan kegiatan pengabdian masyarakat ini adalah meningkatkan pemberdayaan masyarakat nelayan kelompok mitra KUB Selat Baru Kabupaten Sampang dengan pendekatan berbasis komunitas dan pengelolaan berbasis ekosistem. Pendekatan ini berfokus pada pemetaan partisipatif area peletakan rumpon untuk meningkatkan efektivitas penangkapan ikan dan mengurangi konflik pemanfaatan ruang laut. Metode kegiatan meliputi sosialisasi peraturan, penyuluhan hukum dan lingkungan, Focus Group Discussion (FGD) dengan pemangku kepentingan, pelatihan penggunaan teknologi. Kegiatan ini menunjukkan bahwa nelayan memahami tata kelola ruang laut sesuai dengan Permen KP No.36/2023, mampu memperkirakan peta peletakan rumpon yang disepakati bersama, serta melaporkan peningkatan penggunaan teknologi sebagai alat bantu penangkapan ikan. Penerapan teknologi ini memperkuat solidaritas kelompok nelayan, mengurangi konflik, dan mendukung prinsip blue economy. Perlu kegiatan pemantauan berkala terhadap hasil tangkapan dan kondisi rumpon, penguatan kelembagaan KUB Selat Baru, dan dukungan pemerintah daerah untuk fasilitas teknologi dan tindak lanjut evaluasi. Pendekatan kolaboratif antara masyarakat, pemerintah, dan akademisi diharapkan menjadi model replikasi pengelolaan perikanan berkelanjutan di wilayah pesisir lainnya.
