Abstract

Kemajuan dalam Kecerdasan Buatan Generatif (Generative AI) telah menimbulkan kekhawatiran etika yang signifikan, terutama dalam menyeimbangkan nilai-nilai utama seperti keadilan, transparansi, dan manfaat (utilitas). Semakin banyaknya implementasi sistem AI generatif dalam berbagai aplikasi, menjadi sangat penting untuk menangani dilema etika yang muncul dari trade-off yang inheren di antara prinsip-nilai tersebut. Sistem AI generatif sering kali menghadapi trade-off etika di mana kebutuhan peningkatan satu nilai, seperti keadilan, dapat menyebabkan kompromi pada nilai lain, seperti transparansi atau manfaat. Misalnya, usaha untuk membuat model AI lebih transparan dapat mengurangi efisiensi kinerjanya, sementara optimasi kemanfaatan menimbulkan masalah bias dan ketidakadilan. Trade-off ini bukan hanya persoalan teknis, tetapi juga merupakan dilema etika mendasar yang mempengaruhi kepercayaan, akuntabilitas, dan penerimaan masyarakat terhadap sistem AI. Kurangnya pemahaman yang komprehensif tentang trade-off ini dan tidak adanya strategi praktis untuk mengelolanya menimbulkan risiko signifikan terhadap penerapan AI generatif yang etis dan bertanggung jawab. Oleh karena itu, tujuan utama dari penelitian ini adalah untuk mengembangkan kerangka kerja yang secara efektif menyeimbangkan trade-off etika dalam sistem AI generatif, dengan fokus khusus pada nilai-nilai tersebut. Penelitian ini menggunakan pendekatan multi-metode, yang menggabungkan analisis kritis dan penelitian kualitatif. Hasil penelitian menunjukkan bahwa trade-off etika dalam AI generatif sangat bergantung pada konteks dan sangat bervariasi di berbagai aplikasi. Sebagai contoh, dalam beberapa kasus, peningkatan transparansi dapat secara signifikan mengurangi kemanfaatan, sementara di kasus lain, upaya untuk memastikan keadilan dapat menyebabkan penurunan kinerja model. Hasil ini menekankan kebutuhan akan pendekatan yang fleksibel dan sensitif terhadap konteks dalam mengelola trade-off ini, daripada solusi satu ukuran untuk semua.

Abstract

Environmental destruction arises as a result of human wickedness and the absence of legislative acknowledgement of environmental integrity. Historically, the anthropocentric conception of law resulted in legislation serving as a tool for taming and othering nature, with nature existing only as a means to an end: human wellbeing (in terms of human rights). As a legal tool, it might be regarded as natural legitimacy degrading the environment, particularly through anthropocentric power relations, in the name of developing a risk management measuring tool that does not safeguard, but rather perpetuates, this ecological business. If the law remains dominated by an anthropocentric perspective, it will continue to be a mechanism for promoting and legitimizing environmental destruction; environmental law is still biased in favor of human wellbeing, not ecological integrity. As a result of this research, it is important to develop a additional learning model for CLE, one that is based on the Ecosophy (Ecological Philosophy) paradigm, which underpins the Deep Ecology perspective with Pedagogy Place Based Education (PBE). This is a qualitative descriptive-analytical method for expressing the legal situation & needs. The study’s findings indicate that the predominance of anthropocentric perspectives in law, particularly in determining the personality of legal subjects who are exclusively human and human interests (such as companies), must be reinterpreted. This perspective establishes the role of law as a way of taming and othering nature, and more precisely, as a means of instrumentalizing and legitimizing environmental destruction under the guise of exploiting nature. Humans are, philosophically speaking, a component of the ecology. Human equality with nature is consistent with Deep Ecology beliefs. Thus, the expansion of the personality of legal subjects to include non-humans ensures that they receive their rights and are classified as vulnerable groups. Deep Ecology can be used to demonstrate that this PBE model for CLE must have a non-anthropocentric perspective and be more open-minded through the Ecosophy education model: PBE, in order for students to critically and empathetically see the world from a deep-holistic perspective, that vulnerable groups are not limited to humans, but also include nature. This understanding will result in law students who become environmental activists, ensuring that the future of law recognizes environmental integrity and does not justify environmental destruction.

Abstract

The world has changed into a reality engineered through logic digital known as artificial intelligence. When the intelligence develops in rapid fashion into conscience like human, the potential game, website and other network and digital facility will drastically be increasing. Methods used is a participative-mixed method model of research with four approaches which are philosophical, conceptual, socio-legal and textual-critique approaches with literature study data collecting technique. In this era of artificial intelligence, legal education should be reborn with new face, education with commitment to respond digital development without ignoring the value of wisdom. Legal education will lead to the development of practical skill and is based on values of wisdom. Legal education should establish cultural-based curriculum as legal education is an education of behavior. Legal education should be adapted with global values but paying attention to local aspects or on the other hand maintaining rational education and constructing sense of logic and retaining good practical skill and the concern to marginalized community.
