Abstract

The shifting of holidays has become an important issue in labor regulation in Indonesia. This policy is often carried out to increase productivity or to comply with government policies. However, shifting holidays can impact overtime wages for workers. This journal aims to analyze the legal regulations regarding holiday shifts and their implications for overtime wages in Indonesia. The research method used is normative analysis of regulations related to labor and overtime wages. The results show that the legal regulations regarding holiday shifts in Indonesia are mainly regulated in Law Number 13 of 2003 concerning Manpower. However, the implementation of these regulations has not fully accommodated the interests of workers, especially regarding overtime wages. This is due to inaccuracies in the definition and provisions related to overtime wages in the applicable law. The implications of holiday shifts on overtime wages for workers in Indonesia can be felt in various aspects, such as a reduction in overtime wages or ambiguity in calculating overtime wages due to holiday shifts. Therefore, improvements in legal regulations are needed to provide better protection for workers regarding overtime wages

Abstract

The phenomenon of dynastic politics in Indonesia has become a major highlight in contemporary democratic discourse, especially when the involvement of families of public officials extends into the realm of judicial power. One case that has generated great controversy is the Constitutional Court Decision Number 90/PUU-XXI/2023, which paved the way for Gibran Rakabuming Raka the son of President Joko Widodo to run in a national political contest. The decision was colored by a conflict of interest following the involvement of the Chief Justice of the Constitutional Court, Anwar Usman, who has a direct kinship with the party benefiting from the decision. This situation raises serious questions about the integrity of the judiciary, the neutrality of judges, and the effectiveness of the legal profession's code of ethics in safeguarding democratic principles and the rule of law. Using a normative juridical approach and a case approach, this analysis focuses on relevant legislation and court decisions, to unravel the extent to which Indonesia's legal mechanisms are able to prevent and crack down on the practice of nepotism in constitutional institutions. Violation of the principle of nemo judex in causa sua (not to hear cases involving personal interests) is the main highlight in seeing the fragility of the pillars of democracy due to the dominance of family interests and patronage politics. In this context, strengthening the code of ethics, the role of the Honorary Council of the Constitutional Court, and revitalizing the basic principles of justice such as independence, impartiality and accountability are absolute prerequisites in maintaining public confidence in the constitutional justice system in Indonesia.

Abstract

Sebagai bentuk diskriminasi gender, kekerasan seksual menjadi salah satu bentuk diskriminasi yang meracuni dunia pendidikan. Meskipun berbagai negara telah merumuskan kebijakan anti-seksisme dan anti-diskriminasi gender di berbagai instansi pendidikan, sayangnya, laporan akan kekerasan seksual masih sering menghantui perguruan tinggi. sebagai contoh nyata bahwa perjuangan melawan ketidakadilan masih jauh dari selesai. Untuk mengurai permasalahan tersebut maka kajian ini menggunakan metode penelitian yuridis normatif, yang melibatkan pemeriksaan sumber-sumber hukum seperti peraturan, keputusan, teori hukum, dan pandangan ahli. Hasil penelitian menunjukkan bahwa: pertama, terdapat berbagai faktor yang dapat membuat peningkatan kasus kekerasan seksual, baik itu dari segi tidak adanya hubungan yang seimbang dengan mahasiswi dengan akses pelaporan kekerasan seksual di kampus yang baik, lemahnya posisi kekuasaan superior seperti dosen ataupun koordinat kampus yang menjadi sumber pelaporan bagi para korban kekerasan seksual tersebut. Kedua, banyak juga yang disebabkan karena peraturan dan sanksi bagi pelaku kekerasan seksual masih dapat disuap dengan uang dan menurut pihak kampus tersebut adalah hal yang menguntungkan, sehingga para pelaku kekerasan seksual di kampus dapat semakin marak dan memanipulasi fakta yang diberikan bagi para umum. Penulis berharap pemerintah maupun pihak yang terlibat dapat membentuk aparat yang bermoral sehingga kasus ini tidak semakin merajalela khususnya di lingkungan Pendidikan.
