Abstract

This research discusses the juridical review of the act of accidentally damaging other people's property in the legal context in Indonesia. The main focus of this study is on the provisions of civil and criminal law that regulate responsibility and legal consequences of such actions. In civil law, the act of accidentally damaging property is regulated by Article 1365 of the Civil Code (KUHPerdata) which states that every unlawful act that causes loss is obliged to compensate for the loss, including actions caused by negligence. On the other hand, criminal law, through Article 406 paragraph (1) of the Criminal Code (KUHP), requires an element of intent to be subject to criminal sanctions. This research found that the act of accidentally damaging other people's property generally does not meet the criminal elements because there is no malicious intent, so it is more often resolved in the civil realm with a claim for compensation. Peaceful dispute resolution through mediation or negotiation was also identified as a method frequently used in practice to resolve these types of cases. This research provides a deeper understanding of how the Indonesian legal system handles cases of accidental damage to goods, as well as the legal implications for the parties involved.

Abstract

Reflecting a paradigm shift in the way people look for work as well as a profound transformation in global economic change, the Gig Economy has become a highly sought after labor market. The gig economy is a job market that relies heavily on the role of independent contractors or contract workers and freelancers to fill temporary and part-time positions. Behind the advantages of the Gig Economy phenomenon, significant challenges are often hidden, especially in terms of legal protection. Therefore, the author conducted studies and research on how Labor Law in Indonesia protects workers in the Gig Economy Era. The writing method that the author uses is qualitative with literature study. Based on the results obtained from the literature, the author can conclude that currently, there is no law in Indonesia that specifically regulates worker protection in the gig economy sector, nor has there been any significant regulatory development related to partnership relations in Indonesia. In fact, the growth of gig economy workers in Indonesia is quite rapid. Gig workers may be protected by the Employment Law, which regulates employment relations between workers and employers. Although gig workers are considered partners, they have rights as employees.

Abstract

Penelitian ini bertujuan untuk menganalisis keabsahan hukum penerapan Cyber Notary di Indonesia dalam perspektif Undang-Undang Jabatan Notaris. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa penerapan Cyber Notary di Indonesia memiliki potensi untuk meningkatkan efisiensi dan efektivitas dalam pelaksanaan tugas notaris, namun masih menghadapi berbagai tantangan. Tantangan utama termasuk kepastian hukum, legalitas sistem, dan ketidaksesuaian regulasi yang ada. Meskipun beberapa aktivitas kenotariatan sudah dapat dilakukan secara elektronik, pembuatan akta otentik secara elektronik masih memerlukan rekonstruksi hukum yang lebih komprehensif. Disarankan agar dilakukan pembaruan pada Undang-Undang Jabatan Notaris untuk mengakomodasi penggunaan teknologi elektronik, pengembangan infrastruktur hukum yang mendukung transaksi elektronik, serta peningkatan sosialisasi dan pelatihan kepada notaris. Selain itu, kolaborasi dengan organisasi internasional juga penting untuk memastikan penerapan Cyber Notary di Indonesia diakui secara global.

Abstract

The phenomenon of dynastic politics in Indonesia has become a major highlight in contemporary democratic discourse, especially when the involvement of families of public officials extends into the realm of judicial power. One case that has generated great controversy is the Constitutional Court Decision Number 90/PUU-XXI/2023, which paved the way for Gibran Rakabuming Raka the son of President Joko Widodo to run in a national political contest. The decision was colored by a conflict of interest following the involvement of the Chief Justice of the Constitutional Court, Anwar Usman, who has a direct kinship with the party benefiting from the decision. This situation raises serious questions about the integrity of the judiciary, the neutrality of judges, and the effectiveness of the legal profession's code of ethics in safeguarding democratic principles and the rule of law. Using a normative juridical approach and a case approach, this analysis focuses on relevant legislation and court decisions, to unravel the extent to which Indonesia's legal mechanisms are able to prevent and crack down on the practice of nepotism in constitutional institutions. Violation of the principle of nemo judex in causa sua (not to hear cases involving personal interests) is the main highlight in seeing the fragility of the pillars of democracy due to the dominance of family interests and patronage politics. In this context, strengthening the code of ethics, the role of the Honorary Council of the Constitutional Court, and revitalizing the basic principles of justice such as independence, impartiality and accountability are absolute prerequisites in maintaining public confidence in the constitutional justice system in Indonesia.
