Abstract

Residivis refers to the recidivism of criminal acts after serving a prison sentence as determined by the court. The Correctional Institution was established to provide guidance to inmates so that they can return to society with a better character. There are various factors hindering the effective and efficient functioning of the Correctional Institution. Therefore, this study was conducted using a normative method and a conceptual approach, as well as legal regulations. The results of this study show that the Correctional Institution has a rehabilitation program aimed at social reintegration, thus preparing residivis with various training programs to return to society. However, factors such as overcapacity, untrained staff, inadequate facilities, social stigma, and cultural factors hinder the effectiveness of these programs.

Abstract

Justice is the primary goal of law and serves as the basis for every law enforcement process in Indonesia. The case of the serious assault on Cristalino David Ozora by Mario Dandy Satriyo reflects a test of the value of justice amidst social and power inequality. This study uses a normative method with a literature review to analyze the concept of justice theory from the perspective of legal philosophy, particularly according to Aristotle, John Rawls, and Gustav Radbruch. The results show that the application of justice theory in this case emphasizes the importance of equality before the law and the moral responsibility of the perpetrator. The court's decision to sentence the victim to 12 years in prison and require restitution to the victim reflects the application of commutative and distributive justice. This also shows that law enforcement in Indonesia must balance legal certainty, moral values, and humanity as the basis for achieving substantive justice.

Abstract

This study aims to analyze the inequality of healthcare services in Indonesia based on John Rawls’ theory of justice as fairness, which emphasizes the importance of distributive justice and the equal enjoyment of fundamental rights for all citizens. Inequality in healthcare access remains a serious issue in Indonesia due to the uneven distribution of medical personnel, limited infrastructure, and disparities in service quality across regions. This research employs a normative juridical method with philosophical, conceptual, and statutory approaches, using primary legal sources such as the UUD NRI Tahun 1945, Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan, Undang-Undang Nomor 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional (SJSN), and Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja. The collection of legal materials was conducted through library research, and the data were analyzed qualitatively by interpreting legal norms and Rawls’ principles of justice in the context of equitable healthcare distribution. The findings show that the application of justice as fairness can be realized through policies promoting the equitable placement of medical personnel in underdeveloped regions, strengthening JKN, and implementing healthcare digitalization. This aligns with Pasal 28H ayat (1) and Pasal 34 ayat (3) UUD 1945, which affirm the State’s responsibility to guarantee every citizen’s right to adequate and equitable healthcare services.

Abstract

Peningkatan kompetensi guru adalah cara yang sistematis untuk mengidentifikasi, mengembangkan, dan mengevaluasi seperangkat materi dan strategi pembelajaran. Guru memiliki peran sebagai fasilitator dalam kegiatan belajar mengajar, yang membantu siswa dalam mempelajari segala sesuatu. Dengan perencanaan pembelajaran, guru dapat lebih mudah dalam menetapkan tujuan pembelajaran dan bagaimana cara mencapainya. Penelitian ini bertujuan untuk mengetahui fungsi perencanaan pembelajaran dalam mendukung peningkatan kompetensi guru. Metode penelitian yang digunakan dalam penelitian ini yaitu metode penelitian kualitatif, studi kepustakaan (library research). Data diperoleh dengan teknik pengumpulan artikel jurnal yang relevan yang kemudian dianalisis menyesuaikan kebutuhan penelitian. Hasil dari penelitian menunjukkan bahwa perencanaan pembelajaran merupakan hal yang sangat penting dalam kegiatan belajar mengajar, karena perencanaan pembelajaran dapat menjadi acuan bagi seorang guru untuk melaksanakan pembelajaran di kelas. Perencanaan pembelajaran yang efektif dan efisien dapat mendukung dalam peningkatan dan berkembangnya kompetensi guru. Guru lebih siap dan profesional dalam pelaksanaan pembelajaran karena memiliki pedoman dan perencanaan yang jelas.

Abstract

The development of information technology has significantly transformed commercial practices and communication, including the growing prevalence of online gambling promoted on social media by influencers or affiliators. This phenomenon raises legal concerns because such promotions constitute the distribution of gambling-related information, which is explicitly prohibited under Article 303 of the Indonesian Criminal Code (KUHP) and Article 27(2) jo. Article 45(3) of the Electronic Information and Transactions Law (UU ITE). This study aims to analyze the form of criminal liability imposed on influencers acting as online gambling affiliators and examine the application of criminal provisions under the UU ITE in relation to their involvement. Using a normative juridical method with statutory and conceptual approaches, this research finds that any affiliator who intentionally uploads, distributes, or provides access to online gambling websites may be held criminally liable unless a valid excuse eliminates their culpability. Paid promotional activities indicate intent, thereby fulfilling the element of unlawfulness and allowing the perpetrator to be charged based on their level of involvement, whether under Article 303 of the KUHP or the provisions of the UU ITE. However, the enforcement of criminal sanctions remains challenging, particularly in the evidentiary process, as it relies heavily on the validity of electronic evidence such as transaction records, social media uploads, or other digital traces. The absence of detailed technical guidelines for the collection and examination of digital evidence hampers optimal investigation and prosecution

Abstract

This study aims to analyze the form of legal liability for environmental pollution caused by the use of tear gas during the demonstration on August 28–29, 2025, in Jakarta, as well as to examine the environmental impacts resulting from the use of such chemical agents. The research employs a normative juridical method using statutory, conceptual, and case approaches. The legal materials consist of primary sources, including the 1945 Constitution of the Republic of Indonesia, Law Number 32 of 2009 on Environmental Protection and Management, and various relevant police regulations, supported by secondary and tertiary legal materials. The analysis is conducted through a descriptive qualitative approach, comparing the empirical reality of tear gas use that leads to pollution and public health impacts with the legal norms that should guide law enforcement officials in accordance with environmental law principles and human rights standards. The findings indicate that the use of tear gas in crowd control activities has the potential to violate environmental law provisions, cause air pollution, and negatively affect public health and the ecological balance in the affected areas.

Abstract

This study examines the legal issue of whether Indonesia’s policy banning the import of used clothing is consistent with the WTO Non-Discrimination principles, namely the Most Favoured Nation and National Treatment obligations under GATT 1994. This issue is significant because Indonesia prohibits imported used clothing on the grounds of protecting public health and maintaining trade order, while domestically sourced used clothing remains permitted, raising concerns of unequal treatment toward foreign products. The research employs a normative juridical method through a statutory approach by analyzing the Trade Law, relevant Ministry of Trade regulations, and customs provisions, as well as a conceptual approach to assess the application of WTO principles. Legal materials were gathered through library research and analyzed qualitatively. The findings show that the import ban does not violate the Most Favoured Nation principle because it applies uniformly to all WTO members. However, the policy potentially conflicts with the National Treatment obligation since similar domestic products are still allowed to circulate. Nevertheless, GATT provides justification through Article XX if Indonesia can demonstrate that the ban is necessary to protect public health and consumer safety. The study concludes that Indonesia’s ability to defend the policy depends on meeting the necessity test, presenting scientific evidence, and ensuring consistent enforcement to avoid being perceived as protectionist.
