Abstract

This article discusses the injustices experienced by female workers at PT. AFI, where women are often placed in jobs that are not equal to their abilities and are threatened with dismissal if they do not comply. This reflects gender-based discrimination in the world of work. Injustice towards female workers still often occurs even though there are various regulations that protect their rights, such as Law Number 13 of 2003 concerning Employment and other regulations that guarantee the right to leave for menstruation, pregnancy, childbirth and breastfeeding. The implementation of this law is often ineffective, so that many complaints from female workers are ignored. The legal prevalence of female workers must be more enforced and companies must be committed to fulfilling their rights to create a fair and supportive work environment. In this research, the author applies normative juridical research methods through the use of several approaches, namely the Statutory Approach, the Conceptual Approach, and the Case Approach. It is hoped that the resulting research will provide broad benefits to the general public by broadening their understanding regarding the prevalence of women in the workforce or injustice in the work environment based on applicable laws.

Abstract

Penelitian ini bertujuan untuk menganalisis peran kanal YouTube Mahfud MD Official dan Total Politik dalam mempengaruhi dinamika politik dan hukum di Indonesia. Dalam konteks transformasi media digital, kedua channel ini berfungsi sebagai ruang publik baru yang memungkinkan dialog politik dan hukum berlangsung secara lebih terbuka, reflektif, dan partisipatif. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan analisis isi terhadap episode-episode terpilih yang membahas isu-isu konstitusional, praktik kekuasaan, serta partisipasi politik masyarakat. Hasil penelitian menunjukkan bahwa Mahfud MD Official cenderung bersifat edukatif, normatif, dan berbasis pengalaman institusional narasumber utamanya, sementara Total Politik lebih populis dan dialogis dalam mengangkat isu-isu politik kontemporer. Keduanya berkontribusi dalam membentuk persepsi publik terhadap supremasi hukum, etika kekuasaan, hingga ketegangan antar elite politik. Selain itu, kanal-kanal ini juga mendorong peningkatan literasi politik dan kesadaran hukum masyarakat melalui narasi yang bersifat informatif, kritis, dan inklusif. Temuan ini menunjukkan bahwa media digital seperti podcast memiliki potensi besar dalam memperkuat demokrasi deliberatif di Indonesia.

Abstract

Justice is the primary goal of law and serves as the basis for every law enforcement process in Indonesia. The case of the serious assault on Cristalino David Ozora by Mario Dandy Satriyo reflects a test of the value of justice amidst social and power inequality. This study uses a normative method with a literature review to analyze the concept of justice theory from the perspective of legal philosophy, particularly according to Aristotle, John Rawls, and Gustav Radbruch. The results show that the application of justice theory in this case emphasizes the importance of equality before the law and the moral responsibility of the perpetrator. The court's decision to sentence the victim to 12 years in prison and require restitution to the victim reflects the application of commutative and distributive justice. This also shows that law enforcement in Indonesia must balance legal certainty, moral values, and humanity as the basis for achieving substantive justice.

Abstract

This study conducts a juridical analysis of the limitations in law enforcement against transnational human trafficking (TPPO), focusing on the case study of Indonesian citizens (WNI) exploited in Cambodia through online fraud schemes (scam compounds). Although both Indonesia and Cambodia are bound by international (UNTOC, Palermo Protocol) and regional (ACTIP, MLAT) legal instruments, the effectiveness of cross-border cooperation remains far from optimal. The research identifies major obstacles stemming from inconsistencies in the legal definitions of TPPO and standards of proof, weak mechanisms for extradition and Mutual Legal Assistance (MLA), and inadequate information exchange. Specifically in Cambodia, enforcement is hampered by the inconsistent application of the 2008 TSE Law, insufficient victim protection, and high levels of structural corruption. Using a normative juridical approach, this study concludes that human trafficking, as an extraordinary crime, cannot be addressed unilaterally. It requires strengthened and integrated international cooperation including the optimization of MLA, extradition, the formation of Joint Investigation Teams (JITs), and the harmonization of regulations at the ASEAN level to close legal loopholes and enhance the justice response. Recommendations include improving the capacity of investigators, standardizing TPPO definitions, and establishing comprehensive victim protection mechanisms.

Abstract

Indonesia faces significant challenges in balancing energy needs with environmental protection. Coal-fired power plants remain the dominant energy source, yet they generate high emissions and pose public health risks. This study applies a normative-juridical method to analyze the effectiveness of the national legal framework in supporting the achievement of Net Zero Emissions (NZE) and protecting environmental rights. The results show that existing regulations support the energy transition, but implementation remains hampered by coal dominance, weak oversight, and minimal public participation. Legal strengthening, policy integration, and accountability are key to ensuring a sustainable and equitable energy transition.

Abstract

Technological development has transformed many aspects of human life and provided innovations that significantly improve efficiency and convenience. However, the rapid digitalization of society has increased the vulnerability of personal data to cyberattacks and unauthorized access. In Indonesia, public concern over data security escalated following a series of massive data breaches in August 2022, allegedly carried out by an anonymous hacker known as Bjorka. One of the most alarming incidents was the leakage of sensitive data belonging to the Indonesian National Police, revealing critical weaknesses in national cybersecurity systems.This case triggered public distrust and highlighted the urgent need for stronger data protection mechanisms at the state level. Although the government enacted Law Number 27 of 2025 on Personal Data Protection as a legal framework for safeguarding citizens' information, enforcement and implementation remain major challenges. This study aims to analyze the cybersecurity vulnerabilities exposed by the Polri data breach and evaluate Indonesia’s readiness to respond to increasingly complex cyber threats. The research emphasizes the importance of strengthening cybersecurity infrastructure, improving digital literacy, and enhancing regulatory oversight to build a secure, transparent, and trustworthy digital ecosystem.

Abstract

Procedural errors by law enforcement officers that result in wrongful arrests constitute a serious violation of human rights and fundamental principles of justice. This study examines the mechanisms of legal accountability for officers responsible for such errors and analyzes them through the lens of legal philosophy. Using a normative juridical method, this research identifies criminal, civil, administrative, and pretrial remedies as instruments to correct unlawful arrests. Philosophically, the perspectives of Aristotle, Fuller, and Radbruch show that wrongful arrest is not merely a technical mistake but a moral failure that undermines the state's legitimacy in exercising its authority. Therefore, holding officers accountable is essential not only for legal certainty but also for safeguarding substantive justice and restoring public trust in the criminal justice system.
