Abstract

Settlement of civil disputes through a negotiation process (mediation) in order to achieve peace between the disputing parties is actually regulated in Article 130 HIR/154 RBg, but the implementation of the provisions in these two articles is not yet optimal so it is necessary to optimize it by integrating mediation into the formal judicial process. With this integration, dispute resolution through a negotiation process to achieve peace is expected to be faster, simpler and less costly, so that the principle of simple, fast and low-cost justice can be realized. The problem is whether this integration can realize the trilogy of justice principles (simple, fast and low cost) and whether peaceful resolution of civil disputes can actually be realized. The research method used in this research is normative juridical, using secondary data supported by primary data obtained through interviews. The author concludes that integrating mediation in the formal justice process can realize the principles of simple, fast and low-cost justice, as long as peace is achieved between the disputing parties, but mediation does not by itself achieve peace

Abstract

Penyelesaian sengketa di luar pengadilan atau Alternative Dispute Resolution (ADR) semakin diminati masyarakat sebagai solusi atas proses peradilan yang panjang, maha, dan kompleks.  Undang-Undang No.30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa mengatur mengenai prosedur penyelesaian sengketa diluar pengadilan. Beberapa metode penyelesaian sengketa diluar pengadilan, yaitu konsultasi, negosiasi, mediasi, konsiliasi dan penilaian ahli. Lima cara metode penyelesaian sengketa ini merupakan bagian dari sistem penyelesaian sengketa non litigasi yang bertujuan untuk mencapai solusi yang lebih cepat, efisien, dan dapat diterima oleh semua pihak yang bersengketa. Mediasi melibatkan pihak ketiga yang netral yang membantu para pihak mencapai kesepakatan secara sukarela. Negosiasi mengutamakan komunikasi langsung antara pihak yang bersengketa untuk menemukan solusi yang menguntungkan kedua belah pihak tanpa melibatkan pihak ketiga. Sementara itu, konsiliasi melibatkan konsiliator yang menengahi dengan memberikan saran dan rekomendasi dalam penyelesaian sengketa. Penyuluhan hukum ini bertujuan untuk meningkatkan pemahaman masyarakat mengenai metode penyelesaian sengketa diluar pengadilan guna mengurangi ketergantungan pada proses litigasi.  Penyuluhan hukum yang dilaksanakan di Kecamatan Serpong mendapat respon dan partisipasi yang aktif dari masyarakat dan pemerintah setempat. Evaluasi menunjukan peningkatan pemahaman peserta terhadap manfaat dan prosedur ADR. Hasil kegiatan ini diharapkan dapat mendorong implementasi ADR secara lebih luas dalam penyelesaian sengketa.

Abstract

The significance of legal education, particularly in the realms of civil law and civil procedure law, cannot be overstated in fostering legal awareness among the public. This paper aims to examine the role of civil law education and civil procedure law education in enhancing public legal consciousness within economic transactions. By employing a qualitative analytical approach, this study delves into the theoretical frameworks that support legal education and explores empirical evidence from various studies published in the past five years. The analysis demonstrates that a robust understanding of civil law and civil procedure law can empower individuals to navigate economic transactions more effectively, thereby reducing legal disputes and enhancing economic stability. The paper also discusses the challenges and barriers in implementing effective legal education programs and proposes recommendations for improving the public's legal awareness. Ultimately, this research underscores the necessity of integrating comprehensive legal education into public education systems to build a more legally informed society
