Abstract

Abstrak: Perkembangan teknologi informasi dan komunikasi yang semakin pesat memberikan dampak yang sangat signifikan dalam berbagai segi kehidupan manusia tak terkecuali dalam dunia kesehatan. Salah satu terobosan dalam dunia kesehatan saat ini adalah terciptanya bentuk layanan kesehatan secara daring/online melalui sebuah platform yang dikenal dengan istilah telemedicine. Dampak perkembangan tekonologi dan juga wabah Covid 19 yang pernah menyerang Indonesia mendorong masyarakat untuk memilih menggunakan layanan kesehatan online daripada layanan kesehatan konvensional. Kemudahan yang diberikan oleh layanan telemedicine membuat penggunanya semakin meningkat mulai dari biaya murah, hemat waktu, hemat tenaga dan juga akses yang dapat dilakukan kapanpun dan dimanapun. Akan tetapi layanan telemedicine ini apakah terjamin keabsahannya menurut regulasi yang ada? Metode yang digunakan dalam penulisan artikel ini adalah adalah metode penelitian normatif dimana penelitian dilakukan dengan meneliti bahan kepustakaan. Adapun hasil penelitian menunjukkan bahwa layanan telemedicine ditinjau dari segi hukumnya dapat dikatakan legal akan tetapi regulasi yang tersedia masih belum dapat sepenuhnya menciptakan kepastian dan perlindungan hukum bagi pihak-pihak yang terlibat. Sedangkan dilihat dari aspek perjanjian terapeutik, layanan telemedicine merupakan perjanjian yang sah karena telah memenuhi ketentuan Pasal 1320 KUHPerdata tentang syarat sahnya perjanjian. Pada intinya kemudahan yang diciptakan oleh layanan telemedicine ini seharusnya disertai dengan regulasi yang memadai demi terciptanya kepastian hukum.Kata Kunci: telemedicine, keabsahan, perjanjian terapeutik Abstract: The rapid development of information and communication technology has a very significant impact on various aspects of human life, including in the world of health. One of the breakthroughs in the world of health today is the creation of online health services through a platform known as telemedicine. The impact of technological developments as well as the Covid 19 outbreak that once attacked Indonesia has encouraged people to choose to use online health services rather than conventional health services. The convenience provided by telemedicine services has increased its users starting from low cost, saving time, saving energy and also access that can be done anytime and anywhere. However, is the validity of this telemedicine service guaranteed according to existing regulations? The method used in writing this article is a normative research method where research is carried out by examining library materials. The results of the study show that telemedicine services from a legal perspective can be said to be legal, however, the available regulations are still unable to fully create legal certainty and protection for the parties involved. Meanwhile, seen from the aspect of the therapeutic agreement, telemedicine services are a valid agreement because they have fulfilled the provisions of Article 1320 of the Civil Code concerning the terms of the validity of the agreement. In essence, the convenience created by telemedicine services should be accompanied by adequate regulations to create legal certainty.Keywords: telemedicine, validity, therapeutic agreement

Abstract

Around the Koguna Beach area, which is ± 157 meters from the coastline, there is a closed water like a swamp. These waters are brackish and inhabited by red shrimp (Parhippolyte uveae). The purpose of this study was to determine the characteristics of the shrimp habitat. This research was conducted in November–December 2021 in Mopaano Village, Lasalimu Selatan District, Buton Regency. The research location was deliberately set in 2 zones with different habitat characteristics. The results showed that in Zone 1 red shrimp were found with a high relative abundance which indicated that the zone was favored by red shrimp. Habitat in this zone has characteristics in the form of rocks and mangrove roots, higher density of mangrove canopy cover, as well as parameters of the aquatic environment that are suitable for the life of red shrimp. This habitat is anchialine waters which are still influenced by the tides from the sea but are not directly connected to the surface.

Abstract

Indonesia was ranked 61 out of 164 countries (6.32 out of 10) based on the Basel AML Index in 2024. The Basel AML Index score reflects a country's vulnerability to money laundering and terrorist financing. Although not among the countries with the highest risk globally, this score indicates that Indonesia still has work to do to improve the effectiveness of its AML/CFT/CPF framework. Moreover, the newly emerging money laundering schemes, one of which involves untraceable assets like cryptocurrency, make it more difficult to carry out legal proceedings. The novelty in this study is the discovery of assets disguised in money laundering, which is expected to ease the Financial Transaction Reporting and Analysis Center (Pusat Pelaporan dan Analisis Transaksi Keuangan-PPATK) to track hard-to-trace assets. This study was conducted using a juridical-normative method. The result showed various methods in money laundering activities, namely transferring and/or investing funds obtained from illicit activities, corruption, bribery, fraud, irregularities through the banking sector, capital markets, and other means such as deposits, stocks, bonds, and various financial instruments. The various modus operandi carried out by corrupt individuals in money laundering in various sectors require more attention from PPATK.
