Abstract

Media sosial adalah sebuah media online, dengan cara penggunanya bisa dengan mudah berpartisipasi, berbagi dan menciptakan isi. Perkembangan media sosial akhir-akhir ini sangat pesat. Sehingga menjadi topik hangat untuk dibahas karena banyaknya masyarakat yang menggunakan media sosial namun kurang memahami makna medianya itu sendiri. Perkembangan media sosial secara langsung berdampak terhadap tatanan dari perilaku manusia, baik sebagai sarana informasi maupun sebagai sarana sosialisasi dan interaksi antar manusia. Media sosial seakan menjadi tempat menumpahkan segala aktivitas yang tidak jarang mengesampingkan beragam etika yang ada. Hal ini dilihat dari penggunaan bahasa non baku dan tidak resmi dalam berkomunikasi. Komunikasi adalah suatu proses penyampaian informasi (pesan, ide, gagasan) dari satu pihak kepada pihak lainnya. Komunikasi akan lebih efektif apabila pesan yang disampaikan dapat ditafsirkan sama oleh penerima pesan. Adapun Etika komunikasi yang baik dalam media sosial adalah jangan menggunakan kata kasar, provokatif, porno ataupun SARA; jangan memposting artikel atau status yang bohong; jangan mencopy paste artikel atau gambar yang mempunyai hak cipta, serta memberikan komentar yang relevan. Kata kunci: Media Sosial, Etika, dan Komunikasi

Abstract

Penelitian ini bertujuan menganalisi persoalan rangkap jabatan Aparatur Sipil Negara yang merangkap sebagai komisaris atau dewan pengawas di Badan Usaha Milik Negara (BUMN). Tujuan penulisan ini untuk meninjau regulasi Pegawai Negeri Sipil yang merangkap jabatan sebagai komisaris atau dewan pengawas di BUMN. Penelitian ini menggunakan pendekatan penelitian kualitatif dengan analisis deskriptif-argumentatif. Tipe penelitian hukum adalah normatif dengan pendekatan perundang-undangan. Tahapan analisis berupa kondensasi data, display data, dan kesimpulan serta verifikasi. Temuan dari tulisan ini antara lain tidak adanya aturan rangkap jabatan mengenai Pegawai Negeri Sipil yang menjadi komisaris atau dewan pengawas pada Badan Usaha Milik Negara. Undang-Undang Pelayan Publik tidak menerangkan secara jelas mengenai Pegawai Negeri Sipil rangkap jabatan sebagai komisaris. Peraturan pelaksana juga tidak menjelaskan mengenai rangkap jabatan, tetapi hanya menyinggung perihal pengunduran diri dari jabatan lain bagi yang menjabat sebagai komisaris atau dewan pengawas Badan Usaha Milik Negara. Abstract This study aims to analyze the problem of concurrent positions of ASN who also serve as commissioners or supervisory boards in State-Owned Enterprises (BUMN). This issue is still in the public spotlight. For this reason, the purpose of this paper is to focus more on reviewing regulations regarding ASN issues, especially Civil Servants who hold concurrent positions as commissioners or supervisory boards in BUMN. This paper was compiled qualitatively in a descriptive-argumentative manner using a statute approach, the analysis technique with several stages: data condensation, data display, and conclusion/verification. The findings of this paper include; First, there is no concurrent rule regarding civil servants becoming commissioners or supervisory boards of BUMN. Second, the Law on Public Servants does not clearly explain PNS had concurrent positions as commissioners. Third, the implementing regulations do not explain concurrent functions but only mention resignation from other posts for those who serve as commissioners or BUMN supervisory boards.

Abstract

According to Article 29 paragraph (1) of Law Number 38 of 2014, nurses have several duties, namely as providers of nursing care, counselors and client counselors, managers of nursing services, nursing researchers, and task performers based on delegated authority and/or tasks in specific limited circumstances. One of the nurse's tasks that receives focused attention is "as a task performer based on delegated authority." According to Article 32 paragraph (2) of Law Number 38 of 2014, the implementation of nurse tasks based on delegated authority regulated in Article 29 paragraph (1) letter e of Law Number 38 of 2014 is carried out by nurses in a "delegative and mandate" manner. The aim of this research is to identify and analyze misconceptions and legal problems in performing medical actions in nursing administrative law. The research method used is a normative juridical research method. The research results are as follows: First, the term "delegated authority" is not accurately used in the context of nurse task implementation for performing medical actions. Second, the more appropriate term is "cooperation." Suggestions that can be put forward are as follows: First, Law Number 38 of 2014 concerning Nursing needs to be amended. Second, the term "delegated authority" in the legal relationship between medical personnel and nurses regulated in Article 29 paragraph (1) letter 3 of Law Number 38 of 2014 needs to be changed and replaced with the term "cooperation.

Abstract

In order to use advances in information and technology in the world of justice, the Supreme Court issued Perma Number 7 of 2022. Before this regulation came into force, summons for court proceedings and notification of decisions were carried out by court officials called bailiffs, but with the enactment of Perma Number 7 of 2022, summons for court and notification of the decision or decision is made via electronic domicile or by the post office, in which case the Supreme Court has collaborated with PT Pos Indonesia (Persero) to use a document delivery service to the intended case party. The principles of justice that are simple, fast and low cost have not been achieved properly because after the summons document or decision notification has been made by the bailiff then the summons is carried out through the intermediary of the post office officer, here the post office in the delivery process has not been on target, so it is returned to Court. The post is actually fast, but many letters are returned for reasons such as the house in question is empty, the address is not known and the person in question has moved, so the judge will deliberate to make a general summons. Thus, the principles of justice that are simple, fast and low cost are not achieved.
