Abstract

The controversy surrounding Law No. 6/2023 revolves around the loss of the two-day weekend holiday entitlement for workers, the provision of only one day off in a six-day workweek, changes in working hours, which also affect rest time to only one day per week for a 6-day work schedule. The existence of a law should inherently provide fairness to society and contribute to the happiness of the people, but on the other hand, the government must also strive consistently to foster the economic growth of the population as a means to achieve social welfare. This research aims to investigate the regulation of workers' rest time under Law No. 6/2023 and to assess whether the provisions for rest time under Law No. 6/2023 have met the criteria of fairness for workers. To address these objectives, a normative juridical method with legislative and conceptual approaches is employed. Based on distributive justice theory, Law No. 13/2003 better reflects justice in labor relations in Indonesia as it considers basic needs, equality, and workers' contributions more comprehensively. Conversely, Law No. 6/2023, despite providing benefits to employers and potentially stimulating economic growth, appears to reduce the protection and welfare of workers, which can be deemed less fair according to distributive justice principles. Therefore, strict monitoring and improvements are necessary in the implementation of Law No. 6/2023 to ensure fairness for workers is maintained.

Abstract

The legal and judicial system in Timor-Leste continues to face various structural and substantive challenges that hinder access to justice, particularly for communities in remote areas. The lack of judicial infrastructure, limited human resources, and the imbalance between customary legal mechanisms and the formal legal system are key factors that complicate the effective and equitable enforcement of the law. In the context of protecting vulnerable groups, such as women and children, the existing legal system has yet to fully provide optimal protection as mandated by the Constituição da República Democrática de Timor-Leste and other relevant legislation. This study aims to critically analyze the barriers and challenges to accessing justice in Timor-Leste and to evaluate the prospects for legal reform to enhance the effectiveness of the judicial system. Employing legal research methods and an empirical approach, this study examines the existing legal framework and its practical implementation through case studies and secondary data analysis. The findings reveal that the limited number of courts, the shortage of competent judges and prosecutors, and the unequal distribution of legal aid services constitute major obstacles within Timor-Leste’s judicial system. Furthermore, customary law—often the primary recourse for many communities—frequently conflicts with human rights principles, particularly regarding the protection of women and children. Legal reforms, including investments in judicial infrastructure, capacity building for law enforcement officials, and the harmonization of customary and formal legal systems, are essential to improving access to justice.

Abstract

Penggusuran pedagang kaki lima di Timor-Leste merupakan isu kompleks yang menyoroti ketegangan antara kebutuhan penataan kota dan perlindungan hak-hak dasar warga negara. Meskipun pemerintah memiliki dasar hukum untuk menertibkan ruang publik melalui peraturan perundang-undangan namun tindakan penggusuran sering kali menimbulkan dampak signifikan yang merugikan. Dalam negara hukum, salah satu prinsip yang dipegang teguh adalah penghormatan terhadap hak asasi manusia (HAM). Namun, dalam beberapa kondisi tertentu, negara diberi kewenangan untuk melakukan tindakan yang mungkin bertentangan dengan hak individu, salah satunya adalah penggusuran (pemindahan paksa). Penggusuran nyatanya merupakan beban besar yang harus dipikul oleh masyarakat kelas bawah yang selama ini tidak diperhatikan kondisi kehidupannya oleh pemerintah yang telah berkuasa secara bergantian. Negara memiliki kewajiban untuk menjaga stabilitas dan keamanan negara, memfasilitasi kesejahteraan sosial, serta melindungi hak-hak dasar warganya.

Abstract

Abstract: The presidential threshold is the nomination requirement employed by political parties to select the President and Vice President. In Indonesia, the regulation governing the presidential threshold is outlined in Article 222 of Law No. 7/2017 on General Elections. This article stipulates that candidate pairs must be proposed by political parties or a coalition of political parties participating in the elections, provided they meet the criteria of obtaining at least 20% of the total seats in the DPR (The House of Representatives of the Republic of Indonesia) or obtaining 25% of the national valid votes in the previous DPR elections Purpose: This study aims to determine the political dynamics of threshold presidential regulation law in Indonesia. Design/Methodology/Approach: The type used in this research is normative legal research, and uses several approaches, namely the statute approach, conceptual approach, and historical approach. Findings: In principle, the regulation of the presidential threshold is an open legal policy or open legal policy of the legislator, but its application in Indonesia, the presidential threshold has shortcomings because first, it makes legislative elections a prerequisite for the presidential election, and second, the legislative elections that are used as requirements have occurred in the previous election period, which in terms of political configuration is certainly different from the elections that will take place or are taking place. The application of the presidential threshold in Indonesia is also inappropriate because 1) it eliminates independent Presidential candidates; 2) it excludes the participation of non-parliamentary political parties to determine their own Presidential candidates; 3) it only benefits established/large political parties; 4) it is not suitable if applied in a presidential system, because the President in this system is not responsible to parliament; 5) the emergence of transaction politics; and 6) the limited number of choices of Presidential candidates offered. Originality/Value: There has not been much research on presidential threshold arrangements in their formation, especially based on the political dynamics of law that developed during the formation process

Abstract

Pengelolaan lingkungan hidup merupakan usaha dan upaya yang sifatnya terpadu, komprehensip dan integral, dalam rangka melestarikan fungsi lingkungan hidup melalui tindakan penataan, pemanfaatan, pengembangan, pemeliharaan, pemulihan, pengawasan dan pengendalian lingkungan hidup. Dalam hal ini berbagai peraturantersebut tidakhanya mengatur hubungan antara manusia dan manusia, tetapi juga mengatur hubungan manusia dan lingkungan. Pemerintah Timor-Leste melalui Parlemen Nasional telah meratifikasi United Nation Framwork Convention on Climate Change (UNFCCC), The Kyoto Protocol dan perubahannya – The Doha Amandement to the Kyoto Protocol dan The Paris Agreementdemikian Timor-Leste terikat aktif melakukan langkah-langkah dan tindak lanjut dalam Konvensi dan Protokol tersebut. Perubahan iklim global merupakan persoalan publik secara global. Tidak ada yang memiliki atmosfer dan emisi masing-masing negara yang timbul dari Gas Rumah Kaca berkontribusi kumulatif terhadap peningkatan polusi keseluruhan atmosfer. Struktur Hukum, Substansi Hukum dan Budaya hukum yang baik akan berkontribusi membentuk sistem hukum yang sehat dan tidak ideal.
