Abstract

The existence of the Constitutional Court in the life of the nation and state is in order to guarantee and prove the existence of positive law, especially laws, so that these laws remain in accordance with the constitution so that later the constitutional rights of citizens can be maintained. The purpose of this research is as evaluation material and learning material for law enforcers, students and other parties. This type of research is included in the juridical-normative category, namely research carried out by examining theories, concepts, legal principles and regulations that are appropriate and related to the object of research. The Constitutional Court decision that has been issued against Anwar Usman cannot be challenged in the State Administrative Court because the Constitutional Court's decision is not a state administrative decision so it does not fall within the scope of what can be litigated in the state administrative court. Another reason that could be the basis for approval or inaccuracy of the State Administrative Court's lawsuit in relation to the Constitutional Court's decision is related to the ad hoc nature inherent in the Constitutional Court. Compliance with ethical standards in the decision-making process in law enforcement agencies is a crucial element in maintaining the trust and reputation of state administration in the eyes of the public. The presence of ethical standards in the Constitutional Court is considered the basis for upholding constitutional principles which are moral and behavioral guidelines for all members of the judiciary.

Abstract

Human trafficking constitutes one of the most egregious forms of human rights violations, characterized by extensive criminal networks operating at both individual and group levels. This phenomenon is not new, and certain countries, including Indonesia, report high incidences of human trafficking-related crimes. The purpose of this research is to provide an evaluation and understanding of the legal protections available to victims of human trafficking in Indonesia. This study is classified as normative legal research, involving an examination of theories, concepts, legal principles, and relevant statutory provisions pertaining to the topic. Despite significant efforts by the Indonesian government to combat human trafficking, minimum standards for eradication have not been fully met. While there have been notable advancements compared to previous periods, especially in response to the challenges posed by the COVID-19 pandemic, substantial deficiencies remain. Indonesia's upgrade to Tier 2 reflects progress in the investigation, prosecution, and adjudication of human trafficking offenses, including cases of forced labor in palm oil plantations and cyber fraud operations abroad. Additionally, there have been efforts to enhance compensation for victims of human trafficking.

Abstract

This scientific article provides an in-depth analysis of the regulatory framework and legal consequences surrounding online gambling in Indonesia, with a specific focus on the provisions outlined in Law Number 19 of 2016 on Information and Electronic Transactions. The primary goal of this research is to examine the legal mechanisms in place to combat cybercrime, particularly online gambling, and their effectiveness in curbing illicit activities in the digital realm. To achieve this, the study employs a comprehensive legal analysis, scrutinizing Pasal 27(2) and Pasal 45(2) of the aforementioned law, which pertain to penalties for online fraud and the legal implications of such actions. The results of this analysis shed light on the legal consequences that individuals engaging in online gambling may face, emphasizing the seriousness with which Indonesian authorities regard such activities. Moreover, the implications of these findings underscore the need for stricter enforcement of cybercrime legislation, highlighting the importance of a robust legal framework in the digital age to ensure a secure and accountable online environment in Indonesia. This study contributes to the scholarly understanding of the legal aspects of online gambling and provides a foundation for further research and policy development in the field of digital law and cybercrime prevention. Highlights: Stringent Cybercrime Laws: Indonesian legislation (Law No. 19/2016) includes provisions to combat online gambling, emphasizing the severity of cybercrimes and penalties. Abstract

Tujuan artikel ini untuk menelaah dan mengevaluasi tentang pengintegrasian mediasi penal sebagai penyelesaian perkara pidana di tinjau dari perspektif pembaharuan hukum di indonesia. Jenis penelitian ini termasuk kedalam kategori yuridis-normatif, yaitu penelitian yang dilakukan dengan cara menelaah teori-teori, konsep-konsep, asas hukum serta peraturan perundang-undangan yang sesuai dan berkaitan dengan objek penelitian. Hasil penelitian ini menunjukan bahwa dalam rangka menegakkan keadilan restorative dan pelaksanaannnya dilakukan dengan kesepakatan antara pelaku dan korban. Dikarenakan mediasi penal sebelumnya tidaklah pernah dilakukan di Indonesia maka sejatinya mediasi penal harus di integrasikan kedalam system peradilan pidana di Indonesia dan pengintegrasian tersebut sendiri dapat dilakukan dengan bentuk non penal policy yang dalam hal ini berarti dilakukan tanpa legislasi dan dapat pula dilakukan dengan lebih proper yaitu dengan penal policy yang pelaksanaannya dilaksanakan dengan penyusunan aturan mengenai mediasi penal mulai dari pengertian, asas, dan juga bentuk pelaksanaan integrasi penal di Indonesia. Kata Kunci:Mediasi, Penal, Perkara Pidana  Abstract The purpose of this article is to examine and evaluate the integration of penal mediation as a resolution of criminal cases from the perspective of legal reform in Indonesia. This type of research is included in the juridical-normative category, namely research carried out by examining theories, concepts, legal principles and statutory regulations that are appropriate and related to the object of research. The results of this research show that in order to uphold restorative justice and its implementation, it is carried out with an agreement between the perpetrator and the victim.
