Abstract

Inovasi dalam pengembangan teknologi alat tukar memunculkan aset kripto yang awalnya berfungsi sebagai uang digital. Aset kripto menawarkan inovasi dengan minat dan peran manusia, dengan hal ini berarti tanpa harus melewati otoritas bank sentral dalam pengoperasian dan pembuatannya. Namun dalam Undang-Undang Nomor 7 Tahun 2011 tentang Mata Uang menyebutkan bahwa mata uang yang diterima oleh Indonesia hanya Rupiah, mengakibatkan aset kripto diganti sebagai uang. Disisi lain keidentikan aset kripto dengan anonimitas (tanpa identitas) serta pseudonimitas (identitas palsu), membuat aset kripto sebagai wadah alat untuk menciptakan ancaman atas tindak tindak pidana tindak pidana uang. Dengan menggunakan penelitian hukum yuridis-normatif, penelitian ini menemukan permasalan-permasalahan yang memungkinkan bahkan timbul sebagai tindak pidana terhadap inovasi investasi aset kripto. Masalah-permasalahan tersebut, diantaranya adalah keberadaan aset sebagai uang di Indonesia serta dasar penjeratan bagi pelaku tindak pidana pencucian uang dalam investasi aset kripto. Penelitian ini juga mengungkapkan kepastian hukum perkembangan atas inovasi dalam aset kripto yang masih kabur serta investasi hukum, baik terhadap status uang pada aset kripto yang menyebabkannya tindak pidana pencucian uang. di antaranya adalah keberadaan aset kripto sebagai kategori uang di Indonesia serta penjeratan bagi pelaku tindak pidana tindak pidana uang dalam aset kripto. Penelitian ini juga mengungkapkan kepastian hukum perkembangan atas inovasi dalam aset kripto yang masih kabur serta investasi hukum, baik terhadap status uang pada aset kripto yang menyebabkannya tindak pidana pencucian uang. diantaranya adalah keberadaan aset kripto sebagai kategori uang di Indonesia serta penjeratan bagi pelaku tindak pidana tindak pidana uang dalam aset kripto. Abstract

ABSTRAK Praktik gratifikasi dan suap yang dilakukan oleh pejabat negara merupakan suatu masalah yang saat ini dihadapi bangsa Indonesia. Sepanjang ini perumusan peraturan mengenai perbuatan gratifikasi dan suap dibedakan berdasarkan adanya yang diperjanjikan. Artinya suap dapat berupa janji, sedangkan gratifikasi merupakan pemberian dalam arti luas dan bukan janji. Melalui putusan nomor Nomor 68/Pid.Sus-TPK/2018/PN.Jkt.Pst perlu dipahami lebih lanjut bagaimana putusan tersebut memaknai suap dan gratifikasi dalam konteks tindak pidana korupsi. Penelitian ini bertujuan untuk menggali pemaknaan dan interpretasi hukum terkait suap dan gratifikasi dalam putusan pengadilan tersebut. Metode yang digunakan adalah analisis isi terhadap putusan pengadilan, dengan mengidentifikasi argumen hukum yang digunakan, pendekatan hukum yang diadopsi, dan pertimbangan yang diberikan oleh hakim. Hasil analisis menunjukkan bahwa putusan pengadilan tersebut memberikan pengertian yang jelas mengenai suap dan gratifikasi sebagai tindak pidana korupsi. Dalam konteks ini, suap diartikan sebagai pemberian atau janji pemberian kepada pejabat publik dengan tujuan mempengaruhi keputusan atau tindakan pejabat tersebut. Sementara itu, gratifikasi diartikan sebagai pemberian hadiah atau imbalan kepada pejabat publik sebagai bentuk penghargaan atau imbalan atas tindakan atau keputusan yang telah diambil.

Abstract

This study investigates the regulation of action sanctions through a restorative approach for children in conflict with the law (ABH) within the juvenile criminal justice system in Indonesia. The objective is to analyze the alignment of these regulations with the principles of child protection and restorative justice. Utilizing a normative juridical method that incorporates statutory and conceptual approaches, the findings indicate that Article 82 of the Juvenile Criminal Justice System Law (SPPA Law) embodies a restorative justice approach, striving to balance community protection with the rehabilitation of ABH. However, the implementation is suboptimal, and many ABH continue to receive prison sentences. This suggests that the principles of the best interests of the child, the right to development, and respect for children’s views have not been adequately upheld. There is a need for further refinement of action sanctions to better align with restorative justice and address the needs of ABH.

Abstract

Background: Pondok pesantren sebagai lembaga pendidikan dituntut untuk menjadi wilayah yang ramah terhadap tumbuh kembang anak. Perlu kebijakan dan tindakan khusus untuk membentuk model pesantren ramah anak. Pondok Pesantren Attanwir dapat memainkan peranan yang baik sebagai rintisan pesantren model ramah anak. Kegiatan ini bertujuan untuk memberikan pembinaan terhadap para Pembina pesantren di lingkungan Pondok Pesantren Attanwir menjadi model pesantren ramah anak. Metode: Kegiatan ini di lakukan di Pondok Pesantren Attanwir, Dusun Sumber Gadung, Desa Slateng, Kecamatan Ledokombo, Jember dengan melibatkan seluruh stakeholder dengan metode Participatory Action Research (PAR). Hasil: Terbentuknya model pesantren ramah anak yang bebas dari tindakan kekerasan dan bullying terhadap anak sehingga pesantren sebagai lembaga turut andil menciptakan Kawasan ramah anak. Kesimpulan: Meningkatnya pengetahuan pengelola terkait manajemen pondok pesantren berbasis ramah anak sehingga terbentuk lingkungan ramah anak dan mendukung tumbuh kembang anak.

Abstract

The aim of this thesis research is to analyze the application of suitability between the indictment and subsidiary form made by the Public Prosecutor with the articles in which they are accused, and to analyze the suitability of the description evidence of information witnesses with documentary evidence in the form of Visum et Repertum according to Article 184 Paragraph (1) of the Criminal Procedure Code. The study of the problem formulation and the conclusions are stated based on the author's arguments which were formulated using a deductive method, namely a method that relies on basic principles leading to special principles. The indictment in the form of a subsidiary in Verdict Number 301/Pid.Sus/2019/PN Tte is in accordance with the articles charged, however the indictment in the form of a subsidiary as a prosecution strategy is not in accordance with the procedure for making an indictment which should be in the form of alternative, because the use of each the law is exclusionary at other levels. The evidentiary system according to Article 184 of the Criminal Procedure Code, Visum et Repertum and witness statements remain valid evidence as long as there is no other evidence that disputes their truth. Although there is a discrepancy between the witnesses’ statements and the Visum et Repertum, due to the possibility of quite a large time difference between the criminal incident and the Visum examination, this could result in an examination for bleeding in the ear not being carried out because the wound had dried up.

Abstract

Article 440 of the Health Act formulates criminal penalties for the negligence of medical persons/health workers in health services that result in serious injury or death. This study aimed to examine the urgency of the special provision formulation policy and its prospective law enforcement. This framework creates the general provisions of the Criminal Code applied in dealing with negligent acts of medical personnel/health workers resulting in serious injury or death of patients, which should be overridden based on “lex specialis derogat legi generali” principles. Health act in Article 440 as a material offence has special characteristics, whose assessment is based on professional standards and is oriented towards providing balanced legal protection for patients, health workers, and legal certainty for law enforcement officials. According to proving the elements of negligence and causal relationship in the context of therapeutic transactions, it is based on evidence according to KUHAP. Expert testimony occupies an important position in determining professional standards, including medical records and/or visum et repertum. As a material offense, Health Law Article 440 requires caution to achieve the goals of material truth and justice. It can be concluded that the law enforcement of negligence of medical/health workers must be based on the specificity of the unlawful nature of the act, which is different from general criminal offenses, with the benchmark of professional standards resting on the causal relationship between negligence and consequences through evidence, especially expert testimony.

Abstract

Abstract

Children are the next generation of the nation who must be given attention, supervision, rights and protection from all forms of violence. However, child protection has a very important existence, especially in cases of child crime. Children are indeed vulnerable to crime, therefore children need extra supervision from parents and from the government through a law that regulates the protection of children from a crime. One of the criminal acts committed by children is sexual intercourse. Like the case decided by the Kolaka District Court No. 4 / Pid.Sus-Anak / 2020 / PN.Kka concerning the crime of sexual intercourse committed by children. The public prosecutor charged the child with violating Article 81 paragraph (1) and (2) in conjunction with Article 76D of Law No. 17 of 2016 concerning the Stipulation of Government Regulation in Lieu of Law No. 1 of 2016 concerning the Second Amendment to Law No. 23 of 2002 concerning Child Protection into Law in conjunction with Article 55 paragraph (1) ke-1 of the Criminal Code. Furthermore, the identity of children in conflict with the law must be kept confidential. In the decision of the Kolaka District Court No. 4/Pid.Sus-Anak/2020/PN.Kka which does not obscure the identity of the child. In fact, Article 10 of the Supreme Court Decree No. 144 of 2007 concerning Disclosure of Information in Court regulates the obligation to obscure the identity of children in conflict with the law (ABH). Therefore, this needs to be discussed further. In this study, the author uses a normative legal research type (Legal Research) with a statutory and conceptual regulatory approach. The conclusion of this discussion is that the child perpetrator has fulfilled the elements of "committing violence or threats of violence, forcing children. Furthermore, related to the identity of the ABH, it must be kept confidential in print and electronic media, in order to maintain the confidentiality of the child's identity so that there are no bad assumptions in the public. Abstract

The Covid-19 pandemic, which has become a global epidemic, requires the implementation of health protocols in order to prevent its spread, creating its own social problems, especially for the growth and development of children, so that they are the most affected. This study uses empirical juridical methods and uses a conceptual approach. The results of this study indicate that the problem of fulfilling children's rights during the pandemic is still a priority scale program by the government in Jember Regency which must be resolved immediately, especially in terms of health and education. In the context of health, children still have not received vaccination facilities. On the other hand, online children's education is also not optimal due to limited interaction between teachers and students. This research also formulates recommendations for formulating precise policies in terms of mainstreaming the fulfillment of rights to children during the Covid-19 pandemic, especially in Jember Regency, establishing an accountable and accurate information system regarding the distribution of children affected by the Covid-19 pandemic, and making new breakthroughs related to mechanisms. education, health and the environment in favor of the fulfillment of children's rights

Abstract

Human trafficking constitutes one of the most egregious forms of human rights violations, characterized by extensive criminal networks operating at both individual and group levels. This phenomenon is not new, and certain countries, including Indonesia, report high incidences of human trafficking-related crimes. The purpose of this research is to provide an evaluation and understanding of the legal protections available to victims of human trafficking in Indonesia. This study is classified as normative legal research, involving an examination of theories, concepts, legal principles, and relevant statutory provisions pertaining to the topic. Despite significant efforts by the Indonesian government to combat human trafficking, minimum standards for eradication have not been fully met. While there have been notable advancements compared to previous periods, especially in response to the challenges posed by the COVID-19 pandemic, substantial deficiencies remain. Indonesia's upgrade to Tier 2 reflects progress in the investigation, prosecution, and adjudication of human trafficking offenses, including cases of forced labor in palm oil plantations and cyber fraud operations abroad. Additionally, there have been efforts to enhance compensation for victims of human trafficking.
