Abstract

Perspektif Islam tentang akad utang-piutang masuk dalam akad sosial.Akad utang dibolehkan berdasarkan Alquran, hadis, dan ijmak para ulama.Hanya saja, para ulama tidak pada dalam menetapkan kedudukan hokum pencatatan utang. Jumhur ulama menyatakan pencatatan utang tidak wajib, sementara pendapat sebagian lainnya menyatakan wajib. Mutawallī Al-Sya’rāwī merupakan salah satu tokoh yang berpendapat wajibnya mencatat utang. Hal ini cenderung berbeda dengan pendapat mayoritas ulama. Pendapat al-Sya’rāwī menarik diteliti karena ada relevansinya dengan konteks akutansi modern. Fokus yang menjadi perhatian penelitian ini adalah untuk mengetahui Mutawallī al-Sya’rāwī mewajibkan pencatatan hutang, danmengetahui dalil dan metode istinbāṭ yang digunakan Mutawallī al-Sya’rāwī. Penelitian ini dilakukan dengan pendekatan study dipustaka (library research). Data-data yang dikumpulkan dianalisis melalui cara deskriptifanalisis. Hasil penelitian menunjukkan bahwa menurut Muḥammad Mutawallī al-Sya’rāwī, kedudukan hukum pencatatan utang adalah wajib. Hal ini didasari oleh perintah dalam Alquran QS. al-Baqarah ayat 282 yang mewajibkan menulis utang, serta beberapa manfaat dan kegunaan catatan utang.Dalil yang digunakan Muḥammad Mutawallī al-Sya’rāwī mengacu pada ketentuan QS. al-Baqarah ayat 282 dan QS. Yūsuf ayat 55. Ketentuan QS. al-Baqarah ayat 282 digunakan dalam soal perintah wajib mencatat utang. Sementara ketentuan QS. Yūsuf ayat 55 menurut Muḥammad Mutawallī al-Sya’rāwī berkaitan dengan syarat pencatat utang. Adapun metode istinbāṭ yang ia gunakan cenderung pada dua penalaran sekaligus, yaitu bayanī dan istiṣlāḥī. Metode bayanī tempat pada telaah atas lafaz “فَٱكۡتُبُوهُۚ”, yaitu sebagai lafaz amar “أمر” yang menunjukkan makna perintah wajib. Sementara penalaran istiṣlāḥī yang ia gunakan terlihat saat ia menerangkan kegunaan dan manfaat dari pencatatan utang. Menurutnya, pencatatan utang digunakan untuk melindungi hak dari pemilik harta, atau demi manfaat dan kemaslahatan kedua pihak yang melakukan akad.

Abstract

Banyaknya sekarang selebgram di Banda Aceh yang sudah menjadi endorsement terhadap berbagai produk skincare. Pada praktiknya, masing-masing selebgram memiliki prinsipnya sendiri dalam menjalankan endorsement skincare. Disamping kepatuhan dan ketelitian mereka dalam memilih dan menerima endorse, ternyata terdapat selebgram yang mengandung unsur gharar dalam menjalankan endorsement produk skincare. Seharusnya bagi para pihak yang akan melakukan endorsement dan menjadi endorser hendaknya berlaku jujur dalam menyampaikan informasi. Pihak yang melakukan endorsement tidak boleh mengesampingkan etika guna mendapatkan penghasilan. Selebgram endorser dalam menawarkan produk harus memberikan informasi yang benar dan tidak boleh ada unsur penipuan, karena akan menjadi gharar jika hal tersebut dilakukan. Islam mengajarkan dalam bermuamalah tidak hanya berorientasi pada uang, namun juga pada keberkahan. Tujuan penelitian ini untuk mengetahui praktik endorsement skincare di Banda Aceh serta untuk meneliti tentang perlindungan hukum para pihak pada praktik endorsement skincare di Banda Aceh dan untuk menganalisis tinjauan Fiqh Muamalah terhadap praktik endorsment skincare di Banda Aceh kajian terhadap keberadaan unsur gharar. Jenis penelitian ini adalah penelitian kualitatif menggunakan metode deskriptif analisis dengan pendekatan studi kasus. Data dikumpulkan melalui teknik wawancara dan observasi. Hasil riset membuktikan bahwa setiap selebgram memiliki prinsipnya sendiri dalam menerima endorse produk skincare. Disamping itu masih terdapat selebgram endorse yang hanya mementingkan keuntungannya saja. Prinsip endorsement selebgram ini jelas mengandung unsur gharar yang dapat merugikan konsumen. Pada dasarnya, Islam tidak membatasi inovasi dan kreatifitas dalam bermuamalah, namun ada ketegasan dalam batasan-batasan yang tidak boleh dilakukan. Pihak yang melakukan endorsement tidak boleh mengesampingkan etika guna mendapatkan penghasilan. Hal ini dapat dicapai bila antara para pihak menunjukkan kebaikan diantara mereka.

Abstract

This article examines the implementation of consumer rights and responsibilities in motorcycle purchase transactions via leasing at PT Mandala Multi-Finance, focusing on those that apply murabahah contracts. Mandala multi-finance, with a focus on transactions involving murabahah contracts. This research uses a juridical-empirical approach, with primary data obtained through interviews with leasing owners, users, and experts in Islamic economic law. The study results indicate that, when leasing is implemented, there are often cases of default, usually committed by the lessee (the borrower). These defaults can take various forms, such as subleasing, using the goods as collateral for debt, failing to pay late fees, failing to pay due instalments, and delaying lease payments. In some cases, the lessee deliberately misappropriates the goods by selling them. As a result of these breaches of contract, financing companies may suffer losses and have the right to file lawsuits under applicable laws. PT Mandala Multifinance, as a financing institution, must ensure that Islamic standards and relevant regulations are followed in all transactions. The company must draft transparent and balanced contracts and provide consumers with sufficient information regarding their rights and responsibilities. Furthermore, the company must ensure that the vehicle repossession process is carried out by legal procedures, including registering fiduciary guarantees and notifying consumers adequately. By applying the principles of transparency, fairness and compliance with existing regulations, motorcycle leasing at PT Mandala Multi-finance is expected to run smoothly and provide the best legal protection for consumers. Mandala Multifinance will run smoothly and provide consumers with legal protection.

Abstract

The advancement of digital technology has introduced cryptocurrency as a new form of asset used in transactions and investments. The emergence of this asset raises questions among Muslims, particularly regarding the obligation of zakat. Using MUI Fatwa Number 13 of 2011 as a point of departure, this study explores the Islamic legal perspective on zakat for cryptocurrency, which discusses the prohibition of buying and selling digital currency due to elements of uncertainty and speculation. Employing a qualitative research strategy, this study adopts a normative legal framework. Data were obtained through a literature review of both classical and contemporary fiqh on zakat, as well as scholars' opinions concerning the legal status and zakat obligation on digital assets. The study finds that cryptocurrency is classified as māl (property) with an exchangeable value, and thus is subject to zakat if it meets the requirements of full ownership, nishāb, and hawl. However, since the MUI fatwa does not explicitly address zakat on such assets, further interpretation and ijtihad are necessary to fulfil the requirements of Islamic law. This study recommends that a more specific fatwa be issued regarding zakat on cryptocurrency, so that Muslim communities can have clear guidance on managing digital assets in accordance with Sharia.

Abstract

This research examines the role of the Financial Services Authority (OJK) in protecting fintech Peer-to-Peer (P2P) lending customers in Aceh from a maqashid sharia perspective. P2P lending services, which are part of the development of financial technology (fintech), have proliferated in Aceh as an alternative financing solution that is faster and more flexible than conventional financial institutions. However, this growth also presents new risks, especially to consumer protection. This research employs a descriptive qualitative approach, utilizing interviews, literature reviews, and observational methods. The results show that OJK has made various efforts to supervise fintech P2P lending, including through regulations, digital monitoring systems, and public education. From the perspective of maqashid sharia, the protection carried out by OJK against customers reflects efforts to protect the soul (hifz al-nafs) and property (hifz al-mal), which are part of the primary objectives of Islamic law. Based on the analysis, the author considers that OJK's role in supervising and protecting fintech P2P lending customers has shown significant alignment with the principles of maqashid sharia, especially in the aspects of hifzh al-nafs (guarding the soul) and hifzh al-mal (guarding wealth).
