Abstract

”Maliek Bulan” is the annual tradition which is held by the Tareqat Syattariyah people in West Sumatera. Ulakan Padang Pariaman and also Koto Tuo Agam are the locations that usually become places in order to held “Maliek Bulan”. This study was going to observe in depth about the process of “Maliek Bulan” that was held by Syattariyah people in Koto Tuo Agam. This study was explorative research which is focused on finding the phenomenon with the qualitative approach. In studying the social phenomenon is to explain and analyze human’s and group’s behavior. “Maliek Bulan” for Syatthariah people in West Sumatera generally and especially for the group of Syattariyah people who come to Koto Tuo is becoming a routine ocassion in every beginning of Ramadhan or the moment in deciding when to begin fasting in Ramadhan. Morover, it is become a tradition which is held by the most people in Ulakan Padang Parriaman and Koto Tuo Agam. “Maliek Bulan” merupakan tradisi tahunan yang dilaksanakan oleh pengikut tareqat Syattariyah di Sumatera Barat. Lokasi yang biasanya menjadi tempat “maliek bulan” selain di Ulakan Padang Pariaman juga di Koto Tuo Agam. Penelitian ini ingin melihat lebih jauh tentang prosesi melihat bulan yang dilaksanakan oleh pengikut Syattariyah di Koto Tuo Agam tersebut. Penelitian ini merupakan suatu penelitian penjajagan (eksplorative research) yang memfokuskan studinya pada berupaya menemukan dengan pendekatan kualitatif. Dimana untuk mempelajari fenomena sosial dengan tujuan menjelaskan dan menganalisa perilaku manusia dan kelompok. Melihat Bulan bagi jam’ah Syattariyah umumnya di Sumatera Barat dan lebih khususnya bagi kalangan jama’ah Syattariyah yang datang ke Koto Tuo sudah menjadi agenda rutin setiap awal bulan ramadhan atau penentuan kapan dimulainya berpuasa. Bahkan lebih jauh dari itu sudah menjadi tradisi dilakukan dengan porsi jam’ah yang banyak di Ulakan Padang Pariaman dan Koto Tuo Agam.

Abstract

Tareqat Syatthariyah has long grown and developed in Minangkabau, along with the entry of Islam into Minangkabau. One of developed local ‘urf and still survive and sustainable even become an annual event and habits of the fellow Syatthariyah worshipers is moon sighting ("maliek bulan") as one of the models in hisab science. This is in accordance with their 21 basic teachings for followers of tareqat Syatthariyah particularly in West Sumatra. In which to determine the initial entry of fasting month of Ramadan with "ru'yatul hilal". Crowded locations are in Koto Tuo Agam and Ulakan Padang Pariaman. This habits often make them fasting two days after the Government's decision and this become a different source of religious. This study was conducted to explore or probe about this group habit as well as the methods they did to "maliek bulan" or ru'yatul hilal. So it will get an idea about the reason why (undeniably) the existence of these activities carried out by followers of tareqat Syatthariyah in West Sumatra until now.

Abstract

The public road is a facility for those who passed by the public to support mobility. Islamic teachings determine that the public road is right to base humans who don't can in the sky by anyone. However,some people has utilise the public road for interest marriage party and events personal other so that disturb and hinder activity society. This paper aims to study the legality of Islamic law in middle take effect law positive in Indonesia regarding with use of public roads for doingmarriage reception (walimah) with a focus on two questions: First, what difference among legalization of Islamic law with law positive in case usage the public road for interest carry out party marriage? Second, is regulation of government about settings use the public road for interest party marriage in accordance with the legalization of Islamic law? Type this study is a research library with an approach qualitative. Data collection is carried out with read news, books, and related articles with problem study and analysis with the deductive method. Results of this study show that Islamic law has considered legal when already ijtihad by scholars, different with law positive that the legislation must be validated by the government, and government regulation that regulates using the public road for interest party marriage has produced benefits in accordance with the desired goal achieved in legalization Islamic law.

Abstract

Discussion of the obligations of mahram for women in carrying out the pilgrimage has been discussed since the period of classical scholars to modern age. In fact, for women the pilgrimage is a means of jihad for them. Various thoughts have been put forward by scholars to interpret the Hadith about mahram, starting from textual understanding, which still requires mahram, to the discovery of ‘illat. This last understanding leads to the conclusion that having mahram is no longer necessary because the security as ‘illat can be realized. It is in this connection that this paper aims to compromise between textual understanding and the study of ‘illat so that it can be a solution for women pilgrims. This study used a descriptive analytical method with ‘illat study approach. The results showed that security for women pilgrims can be realized by using the meaning of mahram in terms of language, namely people who are forbidden to marry each other, so that fellow women is also a mahram. Therefore, their departure together with other women can realize the demands of nash without leaving nash textually. Perbincangan kewajiban mahram bagi perempuan dalam melaksanakan perjalanan haji sudah dibicarakan sejak periode ulama klasik sampai kontemporer. Bahkan, bagi seorang perempuan ibadah haji merupakan sarana jihad bagi mereka. Berbagai pemikiran dikemukakan oleh ulama untuk memaknai hadis tentang mahram, mulai dari pemahaman tekstual, yang masih tetap mewajibkan bermahram, sampai kepada penemuan ‘illat. Pemahaman terakhir ini membawa kepada kesimpulan bahwa bermahram tidak diperlukan lagi karena keamanan sebagai ‘illat sudah dapat direalisasikan.  Dalam kaitan inilah tulisan ini bertujuan mengkompromikan antara pemahaman tekstual dengan kajian ‘illat agar bisa menjadi solusi bagi jamaah haji perempuan.  Penelitian ini menggunakan metode deskripstif analitis dengan pendekatan kajian ‘illat. Hasil penelitian menunjukkan bahwa keamanan bagi jamaah haji perempuan dapat terealisir dengan menggunakan makna mahram dari segi bahasa, yaitu orang-orang yang haram saling menikah, maka sesama perempuan juga termasuk mahram. Oleh karena itu kepergian mereka bersama-sama dengan perempuan lainnya sudah dapat merealisasikan tuntutan nash tanpa meninggalkan nash secara tekstual.

Abstract

This article aims at restrengthening the implementation of the al-ba’ah concept in maisi sasuduik tradition of some Minangkabaunese marriage customs because some people think that this tradition is just a custom and has nothing to do with Islamic teachings. Maisi sasuduik is an obligation for a prospective groom before marriage. This research uses a qualitative approach by which the data were collected through interviews with several community figures and from relevant literature. The descriptive and inductive theories were used in analyzing the data. The results of the research showed that some people believe that this custom has nothing to do with Islamic teachings. The finding reveal that marriages are sometimes postponed and some are even annulled because the men do not agree to fulfill maisi sasuduik custom. According to the concept of al-ba’ah in Islam, a man must prepare a house for his wife to live in because he will take her there after marriage. For Minangkabaunese men, they are not required to prepare a house to live in before marriage because they will live in the wives’ house. Based on the concept of al-ba’ah, Maisi sasuduik describes a man’s al-ba’ah (ability) to perform a marriage. Therefore, the custom of maisi sasuduik is an implementation of Islamic teachings regarding the necessity of having an al-ba’ah before marriage.

Abstract

The status of witnesses in a marriage contract plays an important role in Islamic law, but the application of the requirement of moral probity for witnesses in service practices at the Offices of Religious Affairs (KUA) continues to face challenges, particularly in determining its indicators and assessment mechanisms. This study aims to analyze the perceptions of Islamic marriage registrars (penghulu) regarding the requirement of moral probity for witnesses and its implementation in the solemnization of marriage contracts at KUA offices throughout Bukittinggi City. The study employed a qualitative approach with a field research design. Data were collected through observation, interviews with Islamic marriage registrars, documentation, and a literature review and were subsequently analyzed through the stages of data collection, cleaning, organization, presentation, interpretation, and verification. The findings indicate that Islamic marriage registrars no longer interpret the concept of moral probity normatively and strictly as formulated in classical Islamic jurisprudence but assess it based on outward conditions, social reputation, and the principle of husnuzan. The implementation of the requirement of moral probity for witnesses tends to be administrative and social in nature, without an in-depth verification of the witnesses’ morality. The assessment focuses more on fulfilling formal requirements, including being Muslim, having reached puberty, being of sound mind, possessing clear identification, and being able to participate in the marriage contract process. These findings indicate a transformation in the interpretation of witness probity from a normative-theological concept toward a practical, administrative, and contextual approach. This study emphasizes the need for more detailed guidelines or standard operating procedures to standardize assessments of witness eligibility without disregarding service accessibility and the objectives of Islamic law.
