Abstract

There are bussiness competition doing by the bussiness performer in bussiness activity. From the benefit side, the competition in bussiness activity is an effective way to reach the optimalization of resources usability. Indonesian bussiness development has brought a lot of conglomerate groups which would also bring the negative effect, such as the low protection to the consument and the small industry. These kind of monopoly thing have become the crucial topic in this country nowadays. If we observe from the Islamic perpective, the small benefits that we got from our bussiness is a lot better than doing the bussiness monopoly things since it is reflected the fairness itself. How is the concept of good Bussiness competition according to the islamic law ? How is the bussiness' code of ethics according to the islamic perspective to create the proper bussiness competition as the purpose of Undang-Undang Tahun 1999 no. 5 ? Abstract

ABSTRACT The Fiduciary Guarantee makes it easy for those who use it. However, in the current practice, there are several violations of law committed by debtors and creditors, for example, there are still creditors who do not register fiduciary deeds to fiduciary registration offices, debtors who transfer, mortgage, and lease fiduciary collateral objects without the creditor's permission and others. -other. From the problems above, of course there must be a solution for Debtors and Creditors. The creditor must really understand the tendency of the debtor as the fiduciary giver, and must follow the mandate of the law in order to register the fiduciary deed made before a notary public and register it with the Ministry of Law and Human Rights so that when something unexpected happens, the creditor has permanent legal force.

Abstract

Both the digital signature and the conventional signature both have different media, but basically the use of a digital signature or a conventional signature is an act that has the same legal consequences, namely giving birth to a legal relationship between the parties making the agreement. Now with the existence of the ITE Law as positive law, electronic deeds are considered the same as conventional deeds, as well as electronic signatures whose power of proof will be considered the same as manuscript signatures. Abstract

Abstract The development of technological advances has changed everything, including the pandemic that hit the world from 2020. Advances in the digital world besides the payment method that was originally only with cash turned into cashless or e-money, shopping that was previously face-to-face between sellers and buyers can now be done online. . The government through Bank Indonesia and the Financial Services Authority as the agency authorized to regulate Financial Technology. In accordance with the category, has issued technical regulations in regulations related to financial technology. In its development, many fintechs have had problems, both legal fintech and illegal fintech because they are not in accordance with government regulations. Legal protection is a description of the workings of legal functions to realize legal goals, namely justice, expediency and legal certainty. Efforts to modernize the legal framework to provide a legal landscape started with many people thinking that this online loan was an easy and fast solution to get money. The development of the fintech industry is also attached to the negative stigma of the community, especially in the way of billing. launching the Fintech Innovation Hub as a development center and becoming a national one stop contact for Fintech. In addition, following up on the agreement with Kominfo, OJK has prepared a Certificate Authority (CA) in the financial services sector. CA as a certificate issuer for a digital signature of financial service actors, can guarantee that an electronic transaction that is digitally signed has been secured and has legal force.

Abstract

ABSTRACT The existence of products that have not been halal certified has resulted in consumers, especially Muslim consumers, finding it difficult to distinguish which products are truly halal and can be consumed in accordance with Islamic law from products that are not haram. advances in science and technology which are the driving force for the productivity and efficiency of producers of the goods or services they produce in order to achieve business targets. Muslim consumers in Indonesia have received protection for the products they will consume, both food and beverages, through regulations written in law number 34 of 2014 concerning Halal Product Guarantee. From the things mentioned above, how is the legal protection for Muslim consumers in obtaining halal guarantees for food delivery service applications? The research in this paper is normative juridical research. To achieve its objectives, the consumer protection law sub-system cannot be separated from other legal sub-systems. for example with health law. For business actors or producers, they need to realize that the survival of their business is very dependent on consumers. For this reason, they have an obligation to produce goods and services as good and as safe as possible and try to provide satisfaction to consumers.

Abstract

Jenis tindak kejahatan dapat terjadi selama wabah virus corona ( Covid-19). Salah satunya, yakni jenis kejahatan yang dilakukan hanya untuk memenuhi kebutuhan hidup sehari-hari. Sebab tak dipungkiri, pembatasan aktivitas berskala besar untuk mencegah penyebaran virus corona berdampak pada turunnya mata pencaharian orang. Terjadinya PHK karena covid menyebabkan mereka kesulitan mencukupi kebutuhan sehari-sehari, akibatnya menggunakan jalan pintas dengan melakukan pencurian, perampokan atau kriminalitas yang lain. Melihat situasi serba darurat seperti sekarang ini menyebabkan banyak perubahan prilaku kehidupan. Rumusan masalah Bagaimana kendala yang dihadapi oleh pihak kepolisian terhadap kejahatan pencurian ditengah pandemi Covid 19?Bagaimana strategi kepolisian dalam menanggulangi kejahatan pencurian di tengah pandemi Covid 19. Metode yang digunakan yuridis normatif.

Abstract

Pemberitaan palsu yang marak terjadi tersebar di dunia maya yang dimana terkadang pemberitaan palsu tersebut menimbulkan konflik yang berefek perpecahan di berbagai kalangan masyarakat sehingga akibat beberapa doktrin yang tersebar luas dari pemberitaan palsu (hoax). Sehingga memilki dua permasalahan yaitu 1. Bagaimana penegakan hukum dapat di optimalkan untuk penyebaran berita hoaks diera digital? 2. Apa kendala yang dihadapi aparat penegak hukum dalam menindak penyebaran berita hoaks?, dengan menggunakan penelitian yuridi normatif. Hasil Penyebaran berita hoaks merupakan masalah serius di era digital yang dapat merusak tatanan sosial, politik, dan keamanan masyarakat. Berita hoaks, yang sering kali disebarkan melalui media sosial dan platform digital, dapat menyesatkan publik, memperburuk polarisasi sosial, dan bahkan menimbulkan keresahan atau kerusuhan. Penanggulangan terhadap hoaks memerlukan pendekatan yang komprehensif, melibatkan peran aktif dari pemerintah, aparat penegak hukum, penyelenggara platform digital, dan masyarakat.
