Abstract

Penelitian ini menganalisis mekanisme penyelesaian konflik sumbang adat di Jambi melalui hukum adat berbasis nilai restoratif. Menggunakan metode non doktrinal melalui pendekatan kasus, penelitian ini menelaah norma dan nilai hukum adat dalam penyelesaian konflik dan menghubungkannya dengan teori keadilan restoratif. Dengan memfokuskan pada dua contoh kasus dari Desa Babeko dan Desa Olak, hasil penelitian menunjukkan bagaimana penyelesaian konflik adat di masing-masing desa menekankan rekonsiliasi dan pemulihan harmoni sosial, bukan hanya pemberian sanksi. Pengembangan model hukum adat berbasis nilai restoratif seperti ini dapat menjadi referensi untuk diterapkan di wilayah lain, serta memberikan panduan untuk integrasi nilai tersebut dalam pembangunan hukum positif nasional berbasis kearifan lokal.

Abstract

Background: The prevalence of hypertension in Indonesia in 2023 reached 30.8%, but only 18.9% of cases were under control, still below the national target of 63%. In Kediri City, although the coverage of hypertension services reached 100%, only 33% of patients managed to control hypertension. This study aims to identify problems, determine priorities, analyze causes, and formulate alternative solutions for hypertension programs.Methods: This descriptive observational study was conducted from July 8 to August 2, 2024. The study subjects were 30 people consisting of staff of the Health Office, Puskesmas and health cadres in Kediri City. Data were collected through brainstorming, in-depth interviews, and document studies. Problem prioritization was conducted using Urgency, Seriousness, Growth (USG) method, root cause analysis using epidemiological model, and alternative solutions using CARL (Capability, Accessibility, Readiness, Leverage) methodResults: Prioritization with the USG method that has the highest score is the low achievement of controlled hypertension. In 2023, the achievement in Kediri City was 33% increasing to 48% in January-June 2024, but still below the national target of 90%. The South Region health center has the lowest achievement of 31.8%. The main causes are low patient participation in routine control, high workload of health workers, and lack of family support. Alternative solutions include routine socialization, family assistance, and monitoring of control schedules through WhatsApp groups.Conclusion: The Kediri City Health Service is expected to conduct socialization with family support assistance. Keywords: Controlled Hypertension, Kediri, Problem Analysis.

Abstract

This paper aims to evaluate the performance of non-judicial consumer dispute resolution institutions in fulfilling their role as protectors of consumer rights, particularly in light of the growing complexity of contemporary commercial transactions and the proliferation of sector-specific dispute resolution forums. The primary focus of this study is to assess the extent to which these institutions are capable of delivering legal protection that is effective, expedient, and accessible, despite facing various structural and functional limitations such as unclear jurisdictional boundaries, overlapping mandates with other bodies, and weak institutional infrastructure. The research adopts a normative juridical approach, employing doctrinal legal analysis and the examination of relevant case decisions. The findings reveal that, structurally, these institutions continue to encounter fundamental challenges, including the limited binding effect of their decisions, which remain subject to judicial review, the lack of regulatory coherence, and insufficient institutional capacity particularly in addressing disputes arising from digital transactions and financial services. The absence of a uniform national procedural standard further contributes to inconsistencies in implementation across regions. This study underscores the urgent need to strengthen the institutional role through the harmonization of sectoral regulations, restructuring of institutional authority, and the development of an integrated digital complaint system. These findings are expected to contribute to the formulation of institutional policy frameworks that are more adaptive and effective in responding to the evolving challenges of consumer protection.

Abstract

The rapid expansion of e-commerce in Malaysia has raised concerns about the quality of goods transacted through digital platforms. This paper critically examines the legal framework governing product quality in Malaysian online sale of goods contracts, focusing on the Sale and Goods Act 1957 and the Consumer Protection Act 1999. Unlike existing studies, this research provides a doctrinally integrated and comparative analysis that evaluates not only the substantive inadequacies of Malaysian law but also its structural limitations in addressing digital commerce, including the absence of regulatory recognition for digital goods and platform-based transactions. Using doctrinal legal analysis supplemented by comparative insights from the United Kingdom and the European Union, the paper identifies structural and doctrinal inadequacies in Malaysian statutory framework, particularly its failure to regulate digital goods and to provide enforceable remedies. The findings reveal significant enforcement gaps and practical difficulties experienced by consumers in online transactions. The study contributes novel insights by systematically linking doctrinal deficiencies with emerging digital market practices and proposing a reform framework that incorporates platform accountability, digital goods classification, and harmonised quality standards. Accordingly, the study proposes targeted statutory reforms, clearer definition standards for goods, and enhanced enforcement mechanisms, all of which are supported by lessons drawn from the UK Consumer Rights Act 2015 and the EU Consumer Rights Directive and Digital Content Directive. These recommendations aim to align Malaysian law with international best practices, reduce consumer vulnerability and enhance market transparency
