Abstract

Penelitian menunjukkan bahwa pekerja di Indonesia belum memiliki perlindungan hukum yang memadai terhadap keselamatan dan kesehatannya. Hal ini menjadi permasalahan karena banyak kendala yang menyulitkan perlindungan untuk bekerja dengan baik. Tulisan ini bertujuan untuk membahas tentang penerapan dan pengaturan Kesehatan dan Keselamatan Kerja (K3) pada suatu perusahaan, dengan fokus pada aspek hukum kelalaian dalam memberikan perlindungan keselamatan dan kesehatan kerja yang berujung pada meninggalnya pekerja. Selain itu, tulisan ini akan menganalisis putusan perkara Nomor 107/Pid.C/2021/PN.Kis yang relevan dengan topik K3 dan implikasi hukumnya. Dengan mengkaji isu-isu tersebut, tulisan ini bertujuan untuk memberikan kontribusi terhadap pemahaman akan pentingnya K3 di tempat kerja dan implikasi hukum bagi pengusaha yang mengabaikan tanggung jawabnya, yang pada akhirnya berujung pada kematian pekerja.

Abstract

The legal profession of advocacy plays a crucial role within Indonesia’s legal system as a guardian of justice and protector of human rights. However, ethical violations, particularly document forgery, pose significant challenges that threaten the integrity of the profession. This study aims to analyze the regulation of the Advocate’s code of ethics concerning document forgery, the applicable sanctions, and the impact on the judicial system and public trust. Using a normative juridical approach, this research examines provisions from the Advocate Law, the Indonesian Advocate Code of Ethics (KEAI), and the Indonesian Criminal Code (KUHP). The findings reveal that advocates involved in document forgery may face criminal, ethical, and administrative sanctions. Such violations not only harm clients but also establish a negative precedent for the rule of law. Therefore, stricter oversight, consistent enforcement of sanctions, and the enhancement of ethical awareness among advocates are essential to maintain the profession’s integrity. Preventing and addressing ethical violations are critical steps in preserving public confidence in Indonesia’s legal system.

Abstract

This study aims to analyze the dispute settlement mechanism of the World Trade Organization (WTO) through its Dispute Settlement Body (DSB) and to examine its legal implications for Indonesia as a member state. The study uses both conceptual and statutory methods in a normative legal approach.  Primary, secondary, and tertiary legal texts that were qualitatively examined using a descriptive-analytical method comprise the data sources. The findings reveal that the DSB’s dispute settlement mechanism operates systematically, encompassing consultation, panel formation, appeal to the Appellate Body, and binding decision implementation. For Indonesia, DSB rulings have multifaceted legal implications, including obligations to adjust national regulations, impacts on economic sovereignty, and the need to enhance legal and diplomatic capacity in international trade. The study concludes that the DSB plays a crucial role in maintaining a balance between adherence to international law and the protection of national interests.
