Abstract

This research aims to explain judges' legal considerations from the perspective of procedural and substantive justice. This is because the decision 124/Pdt.G/2023/MS.Bna, which was a case where the application for a marriage registration was rejected and caused problems with the purpose of the marriage ceremony, thus affecting the position of the parties before and after the decision. In this research the author used qualitative research methods and a normative juridical approach, namely by examining the judge's decisions (content analysis). The judge's legal considerations are analyzed using the theory of justice (procedural and substantive) and compared with several other decisions. The results of the research show that the decision of the Banda Aceh Syar'iyah Court which was based on the provisions of the Compilation of Islamic Law resulted in everyone having the right to become heirs except the applicant, whereas if it was based on the provisions of fiqh the applicant had the right to become an heir because the applicant's marriage was valid in harmony and according to the requirements of Islamic law. . In considering decision 124/Pdt.G/2023/MS.Bna the judge sided with the nature of procedural justice only and ignored substantive justice, resulting in formal justice which was only guided by the law. If the judge uses extra-legal considerations and substantive justice, the itsbat application is very worthy of being accepted.

Abstract

Calculating the value or benefits present in a particular area is a crucial strategy in providing valuable information for decision-makers and is also an effort that can be undertaken to enhance the management of natural resources and environmental protection. The objective of this study is to analyze the economic value of utilizing candlenut trees in the KTH Batu Kura area using a use value approach, which encompasses both direct use value and indirect use value. Data collection was carried out through an inventory of candlenut trees in the KTH Batu Kura land, interviews with KTH Batu Kura managers, and the Tanah Laut Forest Management Unit (KPH). The research findings reveal the total economic value of candlenut trees in the KTH Batu Kura Protected Forest Area amounting to Rp.1,006,619,433.82 per year, consisting of the direct use value (candlenut production and candlenut wood) of Rp.817,405,363.82 per year and the indirect use value from carbon sequestration by candlenut trees amounting to Rp.189,214,070.00 per year.Menghitung nilai atau manfaat yang ada dari suatu wilayah adalah strategi penting dalam menyediakan informasi berharga bagi para pengambil keputusan, dan juga merupakan Upaya yang dapat dilakukan untuk meningkatkan pengelolaan sumber daya alam dan perlindungan lingkungan.. Tujuan dari penelitian ini adalah untuk menganalisis nilai ekonomi pemanfaatan tanaman kemiri di KTH Batu Kura dengan pendekatan nilai guna yang terdiri dari nilai guna langsung dan nilai guna tidak langsung. Pengambilan data dilakukan dengan inventarisasi pada tanaman kemiri di lahan KTH Batu Kura, wawancara dengan pengelola KTH Batu Kura dan KPH Tanah Laut. Hasil penelitian menunjukkan nilai ekonomi total dari tanaman kemiri yang terdapat di Kawaasan Hutan Lindung KTH Batu Kura yaitu sebesar Rp.1.006.619.433,82/tahun, yang terdiri dari nilai guna langsung (produksi kemiri dan kayu kemiri) sebesar Rp.817.405.363,82/tahun dan nilai guna tidak langsung dari karbon pohon kemiri sebesar Rp.189.214.070,00/tahun.
