Abstract

Background: The rapid advancement of technology has led to a significant increase in transnational cybercrime, posing serious challenges to existing criminal procedure laws. Traditional legal frameworks often fall short in addressing the complexities and borderless nature of cybercrimes, necessitating comprehensive reforms to enhance international cooperation and effective law enforcement. Objective: This research aims to analyze the current inadequacies in criminal procedure laws regarding transnational cybercrime and propose necessary reforms to strengthen legal frameworks, ensuring efficient cross-border cybercrime management. Methodology: This study employs a qualitative research method, including a comprehensive literature review, analysis of existing legal frameworks, and expert interviews. The comparative analysis of different countries' approaches to cybercrime legislation provides insights into best practices and potential improvements. Results: The research findings reveal significant gaps in the current legal procedures, such as jurisdictional challenges, lack of standardized definitions, and inadequate international cooperation mechanisms. The study identifies key areas for reform, including harmonization of cybercrime laws, enhancement of mutual legal assistance treaties, and adoption of advanced technological tools for investigation. Conclusion: The reform of criminal procedure laws is imperative to effectively address transnational cybercrime. The proposed reforms emphasize the need for a unified legal framework, improved international collaboration, and utilization of modern technologies to ensure robust and adaptive legal responses to the evolving nature of cyber threats.

Abstract

Abstrak Penelitian ini bertujuan untuk menganalisis penerapan prinsip maslahah mursalah dalam kewajiban sertifikasi halal bagi Usaha Mikro, Kecil, dan Menengah (UMKM) penjual jajanan pasar, dengan fokus pada studi di Pasar Tempel Way Dadi, Kota Bandar Lampung. Subfokus penelitian ini adalah Analisis Maslahah Mursalah Terhadap Kewajiban Setifikasi Halal Bagi UMKM Penjual Jajanan Pasar di Pasar Tempel Way Dadi Kota Bandar Lampung. Metode yang digunakan dalam penelitian ini adalah pendekatan kualitatif dengan metode observasi dan  wawancara mendalam kepada pemilik UMKM. Hasil penelitian menunjukan bahwa kendala utama yang menghambat UMKM untuk mematuhi kewajiban ini terletak pada kurangnya pengetahuan tentang sertifikasi halal, mengira biaya sertifikasi yang tinggi, dan kompleksitas prosedur. Analisis maslahah mursalah menunjukkan bahwa kewajiban ini bertujuan untuk melindungi konsumen dari produk yang tidak sesuai dengan syariat Islam yang mana hal ini merupakan kebutuhan mendasar bagi kelangsungan hidup mereka.  Penelitian ini juga telah berhasil membantu UMKM untuk mendaftarkan produk mereka dalam proses sertifikasi halal, memberikan dukungan praktis untuk mengatasi kendala yang ada. Berdasarkan temuan tersebut, penelitian ini memberikan rekomendasi kebijakan untuk menyederhanakan prosedur sertifikasi, memberikan bantuan untuk menerbitkan sertifikasi, serta meningkatkan sosialisasi mengenai pentingnya sertifikasi halal. Kata kunci : maslahah mursalah, sertifikasi halal, UMKM.   Abstract This study aims to analyze the application of the principle of maslahah mursalah in the obligation of halal certification for Micro, Small and Medium Enterprises (MSMEs) selling market snacks, focusing on studies at Tempel Way Dadi Market, Bandar Lampung City. The subfocus of this research is the Maslahah Mursalah Analysis of the Obligation of Halal Certification for MSMEs Selling Market Snacks at Tempel Way Dadi Market, Bandar Lampung City. The method used in this research is a qualitative approach with observation methods and in-depth interviews with MSME owners. The results showed that the main obstacles that prevent MSMEs from complying with this obligation lie in the lack of knowledge about halal certification, considering the high cost of certification, and the complexity of the procedure. The maslahah mursalah analysis shows that this obligation aims to protect consumers from products that are not in accordance with Islamic law, which is a fundamental need for their survival.  This research has also successfully helped MSMEs to register their products in the halal certification process, providing practical support to overcome existing obstacles. Based on these findings, this study provides policy recommendations to simplify certification procedures, provide assistance to issue certification, and increase socialization on the importance of halal certification.
