Abstract

Introduction: The Fit and Proper Test (FPT) is an important process in assessing potential leaders in the democratic country of Indonesia, which aims to ensure that candidates meet the requirements of morality, intellectuality and electability. Based on Law no. 17 of 2014 and Law no. 8 of 2015, the morality aspect requires prospective leaders to have integrity and a good track record. However, challenges arise from politicization which often ignores these values.Purposes of the Research:  The aim of this research is to analyze the effectiveness of the Fit and Proper Test in the context of morality, intellectuality and electability, as well as provide recommendations for improving the leader selection process in Indonesia.Methods of the Research: This research uses a qualitative approach with descriptive analysis, collecting data through literature studies and expert interviews. The results are expected to provide an overview of the effectiveness of the fit and proper test regarding morality, intellectuality and electability, as well as recommendations for future improvements. Historical and conceptual approaches are also applied to systematically understand legal philosophy.Results of the Research: The conclusion of this research confirms that the Fit and Proper Test (FPT) has a vital role in selecting quality leaders in Indonesia. This process must consider morality, intellectuality and electability in accordance with the provisions of the law. Although challenges in implementation often arise due to politicization, transparent and accountable FPT reform is very important to produce leaders who are able to advance the nation.

Abstract

Raja Ampat, sebuah kawasan United Nations Educational, Scientific and Cultural Organization Global Geopark (UNESCO Global Geopark), kini terancam degradasi ekologis oleh ekspansi tambang nikel. Penelitian ini menganalisis dasar hukum pencabutan izin tambang melalui perspektif hukum lingkungan, dengan menitikberatkan pada prinsip kehati-hatian (precautionary principle). Metode yang digunakan ialah yuridis-normatif dengan pendekatan perundang-undangan dan konseptual. Hasil kajian menegaskan bahwa keputusan pemerintah pusat mencabut izin tidak sekadar tindakan administratif, melainkan implementasi nyata prinsip kehati-hatian yang berakar pada Undang-Undang (UU) No. 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup, serta dipertegas lewat yurisprudensi terkini. Kebaruan riset ini terletak pada pemetaan hubungan normatif antara prinsip kehati-hatian dan perlindungan geopark, sehingga memperluas cakupan teoretis prinsip tersebut bagi ekoregion khusus sekaligus memperkuat legitimasi kebijakan di wilayah sensitif. Rekomendasi meliputi penyusunan regulasi khusus geopark, penguatan zona penyangga dalam Rencana Tata Ruang Wilayah (RTRW), dan pelibatan masyarakat adat sebagai pengawas partisipatif.

Abstract

Penelitian ini bertujuan untuk menganalisis kedudukan, dasar hukum, serta kecenderungan penggunaan Instruksi Presiden (Inpres) yang berimplikasi pada perluasan kekuasaan eksekutif di luar batas kewenangan konstitusional. Inpres selama ini digunakan sebagai alat kebijakan presiden, namun dalam praktiknya seringkali menimbulkan efek normatif ke luar, meskipun tidak termasuk dalam hierarki peraturan perundang-undangan. Fenomena ini menimbulkan ketidakpastian hukum dan membuka peluang penyalahgunaan wewenang, terutama ketika Inpres dipakai sebagai dasar tindakan publik tanpa pengawasan legislatif maupun yudisial. Penelitian ini bersifat yuridis normatif dengan pendekatan terhadap peraturan perundang-undangan dan teori hukum, didukung dengan analisis dua studi kasus Inpres, yaitu Inpres No. 6 Tahun 2020 dan Inpres No. 3 Tahun 2023. Kebaruan dari penelitian ini terletak pada penilaian kritis terhadap efek normatif Inpres dalam kerangka teori Hans Kelsen serta identifikasi kekosongan mekanisme kontrol terhadap tindakan eksekutif berbasis Inpres. Hasil penelitian menunjukkan bahwa Inpres cenderung digunakan melebihi fungsi administratifnya, berpotensi menimbulkan regulasi semu (quasi-regulation), dan memerlukan pembatasan yang tegas melalui reformulasi norma dalam sistem hukum nasional.

Abstract

This study aims to compare the Constitutional Court of Indonesia (Mahkamah Konstitusi Republik Indonesia or MKRI) and the French Constitutional Council (Conseil Constitutionnel) in terms of their historical foundations, legal authority, structural composition, and judicial review mechanisms. The objective is to assess their effectiveness in upholding constitutional governance and propose adaptive models for better protection of fundamental rights. The research method employs a normative juridical approach, incorporating statutory, conceptual, and analytical perspectives. It analyzes primary and secondary legal materials, including constitutions, statutory laws, court decisions, and doctrinal writings. The study focuses on positive legal norms and compares the implementation of judicial review practices in both legal systems using a qualitative analysis framework. The study reveals key differences in the scope and timing of constitutional review: Indonesia employs a posteriori review, which permits legal correction after enactment, while France utilises a priori review to prevent unconstitutional laws before promulgation, later supplemented by the Question Prioritaire de Constitutionnalité (QPC) for limited a posteriori review. Structurally, the Indonesian Court is a judicial organ, while the French Council functions more as a political-legal oversight body. The novelty lies in proposing a hybrid model that incorporates both a priori and a posteriori mechanisms to strengthen constitutional protection, particularly for Indonesia, by recommending the integration of preventive review authority within its existing system.
