Abstract

Islam is a religion that runs according to human nature, so that it has mapped out the rules to fulfill human inner urges, including sexual desire, through the institution of marriage. Islam as a religion of nature is in harmony with the basic nature of humans. The purpose of this study is to dissect the concept of "sexual nature" and determine its parameters, how the concept of Muslim families in maintaining sexual nature and the analysis of cases of sexual deviation against the concept of Muslim families in maintaining sexual nature. The method in this study is qualitative non-interactive analytical concept. This study discusses sexual nature which is a tendency to follow Islamic rules in sexual life, because in Islam there is no monastic life, and at the same time Islam also prohibits the exposure of nudity and free sexual activities. There are stages in the concept of Muslim families in maintaining children's sexual nature, all of which require the role of parents, from age 0 until pre-marriage. These concepts are then linked to analyze cases of sexual deviation. It can be concluded that the factors involved in sexual deviation are not separated from the loss of parental roles in maintaining their children during their growth stages.   Keywords: deviation, sexual, maintenance. human nature.

Abstract

Abstrak. Kehidupan santri di pesantren menuntut kemampuan adaptasi tinggi. Dalam konteks Hukum Keluarga Islam, komunikasi orangtua memiliki peran penting sebagai bagian dari kewajiban pendidikan dan pembinaan anak. Penelitian ini bertujuan untuk menganalisis pengaruh intensitas komunikasi orangtua terhadap resiliensi santri di Pondok Pesantren Al-Irsyad Tengaran dari perspektif Hukum Keluarga Islam. Metode penelitian yang digunakan adalah kuantitatif dengan desain survei terhadap 671 santri putra yang dipilih melalui teknik purposive sampling. Instrumen penelitian berupa kuesioner skala Likert yang telah teruji validitas dan reliabilitasnya, sedangkan analisis data dilakukan menggunakan uji korelasi Pearson dan regresi linear sederhana dengan bantuan SPSS. Hasil penelitian menunjukkan adanya hubungan positif yang signifikan antara intensitas komunikasi orangtua dan resiliensi santri (r = 0,682; p < 0,01), di mana komunikasi orangtua mampu menjelaskan 46,5% variasi resiliensi santri. Aspek komunikasi yang paling berpengaruh adalah dukungan emosional dan nasihat spiritual, yang sejalan dengan prinsip pembinaan anak dalam Hukum Keluarga Islam. Temuan ini menegaskan urgensi peningkatan kualitas komunikasi orangtua-santri dan perlunya kebijakan pesantren yang mendukung interaksi tersebut guna memperkuat ketahanan mental santri di lingkungan pesantren. Abstarct. Life as a santri (Islamic boarding school student) demands a high level of adaptability. In the context of Islamic Family Law, parental communication plays a crucial role as part of the parents’ obligation to educate and nurture their children. This study aims to analyze the influence of parental communication intensity on the resilience of santri at Al-Irsyad Tengaran Islamic Boarding School from the perspective of Islamic Family Law. The research method used is quantitative, employing a survey design involving 671 male santri selected through purposive sampling. The research instrument was a Likert-scale questionnaire that had been tested for validity and reliability, while data analysis was conducted using Pearson correlation and simple linear regression with the help of SPSS. The results showed a significant positive relationship between the intensity of parental communication and santri resilience (r = 0.682; p < 0.01), where parental communication could explain 46.5% of the variance in santri resilience. The most influential aspects of communication were emotional support and spiritual advice, which are in line with the principles of child-rearing in Islamic Family Law. These findings emphasize the urgency of improving the quality of parent-santri communication and the need for pesantren policies that support such interaction in order to strengthen the mental resilience of students in the pesantren environment.

Abstract

ABSTRACT The practice of bribery is not new in society. Bribes have become an alternate pathway to those who want to make their business whether in the public or private services sector. According to the 2020 GCB survey in Indonesia, 30% of the public claim to have paid bribes in the last year when accessing public services. In Islam, the practice of bribery is clearly forbidden by Allah and His Messenger. On the other hand, there are conditions where some agencies in public and private services are forcing a person to bribe because of the prevailing system. If someone does not bribe, then his rights will not be given or slowed down. From this study, the researchers want to know the legal status of bribing in order to take rights. This research uses a qualitative approach with literature study techniques in collecting data and analyzing it with a descriptive method. The result of this study is that bribery given in conditions of taking rights or avoiding injustice is permissible with several conditions. Keywords: rights; take rights; bribery

Abstract

The concept of gender equality often raises issues in the division of household tasks and responsibilities, especially when confronted with Islamic jurisprudence, which generally establishes functional roles for husbands and wives. This study aims to analyze Islamic views on gender equality, detail the diversity of jurisprudential views (ikhtilaf) regarding the division of roles between husband and wife, and examine the application of gender equality principles in household management. This research uses a library research method with a qualitative approach, collecting data from cross-madhhab fiqh literature, interpretations, and scientific articles. The results show that Islam promotes the principle of proportional justice (equity, i.e., the balanced fulfillment of rights and obligations according to capacity) while acknowledging equal human value (equality before the Sharia). Role differentiation is based on biological and psychological fitrah (innate characteristics of creation), rather than absolute kodrat (rigid determinism), thereby avoiding the creation of a hierarchy of values. While the majority of scholars establish the husband as the leader (qawwam) and main breadwinner, and the wife as the primary manager of the household, Islamic jurisprudence also recognizes flexibility and diverse perspectives regarding women's public roles and household management through the principles of mutual consultation (musyawarah) and benefit (maslahah). This division is positioned as a functional differentiation. In conclusion, the application of gender equality aligns with Islam if interpreted as proportional justice that considers the fitrah of each individual, rather than a rigid division that ignores the diversity of Sharia perspectives and the actual conditions of the family.
