Abstract

Tindak pidana penganiayaan, terutama yang berujung pada kematian, merupakan isu serius daIam sistem hukum Indonesia yang memerlukan perhatian mendalam. PeneIitian ini mengkaji regulasi hukum mengenai penganiayaan berat yang mengakibatkan kematian dan perlindungan hukum bagi korban serta keluarganya. Dalam konteks ini, penganiayaan tidak hanya berdampak fisik, tetapi juga menimbulkan efek psikologis yang signifikan, seperti trauma dan beban finansial. Pengaturan hukum mengenai penganiayaan berat diatur daIam Buku Kedua Bab XX PasaI 351 hingga PasaI 358 Kitab Undang-Undang Hukum Pidana (KUHP), dengan berbagai pasal yang mengatur sanksi berdasarkan unsur kesengajaan, kekerasan, dan akibat kematian. Selain itu, hak-hak korban diatur dalam Undang-Undang Nomor 13 Tahun 2006 tentang PerIindungan Saksi dan Korban, yang menjamin perIindungan fisik, psikis, kompensasi, serta pendampingan hukum. Lembaga PerIindungan Saksi dan Korban (LPSK) berperan penting daIam menyediakan perIindungan serta bantuan kepada saksi dan korban selama prosedur hukum berlangsung. Meskipun terdapat tantangan dalam implementasinya, LPSK berupaya menciptakan sistem peradilan yang adil dan berpihak pada korban. Penelitian ini menekankan pentingnya sistem hukum yang ideal tidak hanya menjatuhkan hukuman kepada peIaku, tetapi juga berupaya melindungi dan memulihkan hak-hak korban untuk mencapai keadilan yang lebih menyeluruh.

Abstract

Cyberbullying in Indonesia has become a serious concern in recent years, with the increased use of digital technologies such as social media and instant messaging applications as the main platforms. This phenomenon not only includes various forms such as insults and threats, but also seriously impacts the mental health of victims, including high levels of stress, anxiety, and depression. The ITE Law and the Criminal Code provide the legal foundation to address cyberbullying, although implementation still faces challenges in consistency and effectiveness of law enforcement. Effective prevention strategies, such as education on digital etiquette and public awareness raising, are needed to reduce the incidence of cyberbullying in Indonesia. Active cooperation between the government, educators, technology platforms, and communities is key to creating a safe and supportive online environment for all technology users, particularly the younger generation who are most vulnerable to the negative impacts of cyberbullying.

Abstract

Legal notice is the first step in resolving civil disputes through non-litigation. A formal notice serves as a written warning from the creditor to the debtor to correct their mistake or negligence before the case is brought to court if the formal notice is ignored based on Article 1238 of the Civil Code and the principle of good faith in Article 1338 paragraph (3) of the Civil Code. This study aims to analyze the extent to which legal notice plays a role in non-litigious civil dispute resolution and the extent to which legal notice accelerates the civil dispute resolution process. This study uses a normative juridical approach by examining the written legal norms that apply in the positive legal system in Indonesia, as well as considering the legal principles and doctrines of legal experts relevant to the issues under study. The results of the study show that legal notice has a significant psychological, moral, and procedural impact, as it can foster legal awareness, encourage voluntary compliance, and accelerate dispute resolution without having to go through litigation. Thus, legal notice plays a strategic role as a legal instrument that supports effective, efficient, and socially just dispute resolution.
