Abstract

The purpose of this writing is to find out how the law is enforced against the criminal act of Transferring Fiduciary Security Objects Without the Permission of the Fiduciary Recipient based on Law Number 42 of 1999 concerning Fiduciary Guarantees. By using qualitative research methods, it is concluded that this paper aims to determine the rights of fiduciary recipients regarding fiduciary collateral objects and law enforcement against perpetrators of criminal acts of transferring fiduciary collateral objects without the fiduciary recipient's permission based on Law Number 42 of 1999 concerning Fiduciary Guarantees. Fiduciary is the transfer of ownership rights to an object based on trust. However, in practice, problems are often encountered when transferring collateral without the approval of the fiduciary or creditor, causing the creditor to suffer losses. Transferring the object of a fiduciary guarantee is a criminal act regulated in the applicable legal basis, namely Article 23 paragraph (2) and Article 36 of Law of the Republic of Indonesia Number 42 of 1999 concerning Fiduciary Guarantees. The criminal sanctions given are a maximum imprisonment of 2 (two) years and a maximum fine of Rp. 50,000,000 (Fifty Million Rupiah)

Abstract

Creditors cannot execute fiduciary guarantees independently; instead, they must file an execution request with the court until a legally binding decision is made. There is no agreement in this decision regarding the debtor's breach of contract and the debtor's willingness to surrender the fiduciary guarantee. The results of this study are as follows: there are no standards regarding the requirements that must be met in the execution auction application documents; many standards regarding execution titles equivalent to court decisions that have permanent legal force; no special category for execution auctions; fiduciary guarantees no longer pay special attention to the ease of execution; and agreement clauses mentioning the debtor's breach of promise and willingness to surrender have non-legal consequences, such as: a surge in execution applications in court; difficulty obtaining credit if the object of the fiduciary guarantee is executed; and the lengthy court execution process, which requires time and costs that can affect the trust in legal protection policies based on the principle of proportionality between the giver and receiver of the fiduciary guarantee

Abstract

Seorang suami dan istri membentuk ikatan melalui pernikahan mereka, dan anak-anak diberikan kewenangan untuk melaksanakan tugas-tugas yang berhubungan dengan warisan. Masalah sengketa warisan adalah salah satu konflik hukum perdata yang paling banyak terjadi di Indonesia. Dalam artikel ini yang menjadi pokok permasalahannya adalah anak-anak mendiang suami (anak dari perkawinan pertama pewaris dengan istrinya) tidak ingin membagikan harta warisan tersebut kepada istri sah dari perkawinan kedua mendiang ayahnya. Karena istri sah dari perkawinan kedua mendiang ayahnya tidak memiliki keturunan dan mereka merasa harta mendiang ayahnya merupakan harta yang diperoleh oleh mendiang ayah dan mendiang ibunya semasa hidup. Artikel ini bertujuan untuk membahas tentang pengaturan Undang-Undang mengenai hak waris terhadap istri sah dari perkawinan kedua yang tidak memiliki keturunan terhadap pelaksanaan pembagiannya serta masalah hukum dalam pembagian warisan harta gono gini terhadap istri dari perkawinan kedua. Untuk menyelesaikan permasalahan tersebut diatas, maka metode yang digunakan dalam artikel ini yaitu normatif dengan mengkaji /menganalisis perundang-undangan dan bahan pustaka. Sehingga dalam penelitian ini menghasilkan kesimpulan bahwa, walaupun penggugat sesuai dengan Putusan Pengadilan Negeri Medan merupakan istri sah dari perkawinan kedua, ia tetap berhak mewarisi harta peninggalan suaminya walaupun ia tidak memiliki keturunan

Abstract

A family is formed by a legal marriage event both according to religion and the State and in accordance with applicable laws and regulations. In a marriage, it is certain to crave the presence of children to fill a family and produce a complete household. In addition, children are also the successors of their parents' descendants and as the successors of the nation. After having children, parents have the main and important obligations and responsibilities in assisting the growth and development of children. The role of parents is the first teaching in a child's life in the process of shaping and building a good child's character is the obligation of parents in caring for, maintaining and educating until their children grow up. This parental obligation is certainly supported and regulated in Article 45 of Law Number 1 of 1974 concerning Marriage. However, there are many problems in the household that cause conflict between husband and wife in a marriage which causes various problems. One of the problems that occurs as a result of divorce is the transfer of child custody. This research is a type of research normative juridical research on the provisions of Marriage Law number 1 of 1974, with data analysis using a statutory approach and secondary data using scientific journals.

Abstract

Companies play a crucial role in the economy, both in terms of business, social, and environmental aspects. In facing global competition, merger strategies are one way companies use to improve efficiency, competitiveness, and market share. However, mergers also bring significant legal impacts, particularly regarding changes in organizational structure, human resource management, and compliance with applicable regulations. This study aims to analyze the positive legal impacts of the merger carried out by PT Pelindo Regional 1, including its effects on the legal status and ownership of the company, asset transfer, employee rights, and the potential reduction in competition levels. This research uses a normative juridical method with a library research approach, examining relevant regulations such as Law No. 40 of 2007 on Limited Liability Companies and Government Regulation No. 101 of 2021 on Company Mergers. The study finds that while mergers have the potential to enhance company efficiency and competitiveness, this process must be carefully managed to avoid legal issues, especially concerning employee rights and competition supervision. Therefore, companies need to ensure compliance with existing regulations and conduct due diligence to mitigate potential legal risks.

Abstract

A stable and growing economy is crucial for the advancement of a country, but unemployment remains a significant challenge faced by the government. To address this, the Indonesian government has promoted the development of MSMEs to create job opportunities and support the national economy. Since 2018, the People's Business Credit (KUR) program has been launched to support MSME financing through low-interest funding distributed by banks or financial institutions. This study discusses the legal protection of personal data and MSME data in the KUR application process, as well as the role of regulatory institutions such as the Financial Services Authority (OJK) and the Financial and Development Supervisory Agency (BPKP). The study's findings indicate that, despite the existence of Law No. 27 of 2022 on Personal Data Protection, the protection of MSME data remains suboptimal. More specific regulations are needed to ensure the security and confidentiality of data, thereby preventing misuse by irresponsible parties. In the implementation of KUR, OJK is responsible for maintaining the confidentiality of consumer financial data, while BPKP supervises the distribution of KUR funds through an integrated information system. Strengthening the roles of these institutions is vital to enhance accountability and the protection of MSME data, while also supporting the success of the KUR program in driving national economic growth.

Abstract

The use of narcotics, psychotropic substances and other addictive substances has a huge impact if misused. However, on the other hand, these substances can provide benefits for the development of science and the treatment of disease if used according to the instructions of the authorities. Therefore, this scientific legal work discusses two main things: first, how the legal regulations relate to intermediaries in the sale and purchase of class I non-plant narcotics according to positive law, and second, how to apply criminal law to these perpetrators. This research uses a normative method with a statutory approach. Eradicating narcotics faces very complex obstacles, ranging from internal and external factors of perpetrators to the involvement of law enforcement officers in abuse. As a solution, the government needs to optimize the role of society to increase supervision and legal awareness, revise narcotics laws, and tighten supervision of the morality of law enforcement officers.

Abstract

The resolution regarding protecting roads in the community against trucks, especially in the context of coal transportation in Jambi Province, is a complex legal issue. The increasing volume of heavy vehicles, especially trucks carrying coal, causes road damage, severe traffic jams and accidents that are detrimental to the community. Legal protection for road users, especially those affected by coal transportation activities, needs to be considered to reduce the risk of accidents and material loss. This research aims to analyze the legal arrangements for resolving road disputes, as well as the resolution mechanisms available in Indonesia. The research results show that although there are regional regulations governing the transportation of coal, the implementation of these regulations is not optimal. Law enforcement and supervision of coal transportation as well as setting truck operating schedules are very important to improve the safety and comfort of road users.

Abstract

This study examines Gregorius Ronald Tannur's acquittal in a murder case (verdict number 454/Pid.B/2024/PN Sby) and whether it complies with Indonesian legal certainty and justice criteria. Examining the judge's use of legal reasoning in the ruling critically is the aim of this study. Using a normative legal research approach, this study looks at secondary sources in addition to fundamental legal texts like court decisions and the Criminal Code. The findings demonstrate that the judge's decision ignored crucial evidence, such as the visum et repertum detailing the victim's injuries and CCTV footage implicating the defendant. The judge's assertion that the defendant was innocent and had made an effort to help the victim did not align with the evidence that was given throughout the trial. The integrity of the legal system and the possible impact of outside influences on court rulings are seriously called into question by this disparity.Reforming court procedures and enforcing stronger sanctions against judge corruption are crucial for regaining public trust and guaranteeing just and equitable outcomes within the legal system.
