Abstract

This study examines the constitutional limits of delegating normative authority to non-structural religious bodies in Indonesia, focusing on the National Sharia Council of the Indonesian Ulema Council (DSN-MUI). As a private religious institution, DSN-MUI issues fatwas that are adopted by the Financial Services Authority, Bank Indonesia, and Sharia financial institutions as binding references in the regulation of Islamic finance. This delegation model raises fundamental constitutional questions regarding legality, accountability, and the distribution of power under the 1945 Constitution. Employing a normative legal method with statutory and conceptual approaches, the study finds that while DSN-MUI enjoys functional legitimacy in Sharia economic regulation, the absence of direct statutory basis and public oversight mechanisms poses risks to the principle of legality and checks and balances. The study recommends a co-regulation model where DSN-MUI fatwas must be formally adopted through state regulations and subject to transparent accountability mechanisms to ensure compliance with the rule of law and constitutional democracy.

Abstract

Corruption in Indonesia has evolved into a systemic crisis that threatens democratic institutions, hinders economic progress, and erodes social justice. This study aims to develop a theoretical framework for cultivating anti-corruption moral habits by integrating philosophical ethics with legal structural reform. Employing a normative legal research methodology, the analysis draws upon classical moral philosophies—Socrates’ reflective accountability, Plato’s model of moral leadership, and Aristotle’s concept of the state as a moral educator—alongside contemporary anti-corruption theories. The study identifies four key pillars necessary for sustainable anti-corruption strategies: systemic certainty in governance, habitual ethical reflection in daily decision-making, moral exemplarity among public leaders, and institutional arrangements that nurture civic virtue. The findings suggest that combating corruption effectively requires not only legal reform but also moral reconstruction across individuals, leadership, and institutions. This integrative approach offers meaningful insights for legal philosophy and public governance reform in Indonesia and similar developing contexts.

Abstract

The term "ethics court" has become one of the most interesting terms in Indonesia, given the existence of various institutions that enforce ethical codes within the public official sphere and various specific professions. Despite this, there are issues regarding the status of ethical courts in Indonesia, with debate over whether such courts exist or not. This research aims to analyze and reflect on the development of ethics courts in Indonesia, including their problems and future regulations, from a legal philosophy perspective. This research is normative legal research with philosophical, conceptual, case, and legislative approaches. The research findings confirm that from the perspective of positive law in Indonesia, ethics courts still function as administrative instruments subject to the formal legal system, and are therefore not yet able to play an autonomous role in substantively upholding the integrity and morality of the profession. The lack of a clear distinction between the domains of ethics and law obscures the function of ethical courts as protectors of professional dignity and public morality. From a legal philosophy perspective, forward-looking regulations are needed to balance the principles of morality and legal certainty with the strengthening of a solid legal foundation, recognition of independence, and the final authority of ethics courts. Thus, the forward-looking regulatory strategy aims to make the ethics court a pillar of substantive justice that respects universal moral values while also providing legal certainty in the conduct of an integrated state.
