Abstract

Kehadiran teknologi sangat membantu dan mempermudah kegiatan manusia. Peranan teknologi informasi yangsedemikian besar harus dimanfaatkan maksimal dalam pembangunan kekayaan intelektual. Kekayaan intelektualmerupakan hak yang diberikan kepada pemilik atas hasil kreatifitas intelektualnya yang diekspresikan dalam bentukhasil karya yang bermanfaat karena mempunyai nilai ekonomis. Hak eksklusif yang melekat pada kekayaanintelektual diberikan negara melalui pendaftaran. Keberadaan kekayaan intelektual sangat penting karenamendorong perekonomian dan mensejahterakan manusia. Indonesia meratifikasi persetujuan TRIP’s melaluiUndang-Undang No. 7 Tahun 1994 tentang Pengesahan Pembentukan Organisasi Perdagangan Dunia. PersetujuanTRIP’s merupakan norma global yang memuat standar perlindungan bagi kreasi intelektual dan pelaksanaanpenegakan hukum di bidang kekayaan intelektual. Konsekuensi terhadap ratifikasi tersebut adalah penyesuaianhukum nasional, penyesuaian sistem administrasi, kerjasama dengan luar negeri, serta sosialisasi serta penegakanhukum kekayaan intelektual. Penelitian ini berada dalam ranah ilmu hukum empiris yang dipengaruhi olehkenyataan dalam masyarakat. Pemahaman norma hukum berawal dari realitas masyarakat, fakta sosial menjadi titiktolak menjelaskan persoalan hukum. Teknologi informasi membantu proses pembangunan kekayaan intelektualdalam proses permohonan pendaftaran dan publikasi kekayaan intelektual. Direktorat Jenderal Kekayaan Intelektualmengembangkan sistem e-filing dan ‘layanan data dan informasi’ di bidang kekayaan intelektual sebagai saranainformasi dan pengajuan permohonan terhadap hasil karya intelektual bagi masyarakat.Keyword : Kekayaan Intelektual, TRIP’s, Teknologi Informasi

Abstract

Tidak hanya dirasakan oleh perusahaan-perusahaan besar, tantangan dalam persaingan dunia usaha yang semakin ketat juga dialami oleh Usaha Menengah Kecil dan Mikro semenjak hadirnya e-commerce. Usaha Menengah Kecil dan Mikro sebagai pelaku usaha harus dapat melakukan adaptasi yang tepat dengan menggunakan fitur strategi pemasaran yang tedapat pada e-commerce. Optimalisasi dilakukan dengan cara melaksanakan kegiatan Pemberdayaan Kepada Masyarakat secara dari daring dengan melibatkan peran pemerintah melalui kementerian dan juga para ahli. Dari pelaksanaan kegiatan tersebut ditemukan bahwa dengan menggunakan e-commerce, user memperoleh informasi berupa hal-hal yang dapat mempengaruhi penjualan, waktu penjualan yang tepat, serta kebiasaan pasar. Pelaku Usaha Menengah Kecil dan Mikro perlu untuk diberikan suatu program peningkatan kualitas terkait penggunaan e-commerce agar membuat mereka berdaya saing dalam dunia transaksi elektronik

Abstract

Penyelenggaran Pemilihan Umum diatur dalam Undang-Undang Nomor 7 Tahun 2023 dan Peraturan Badan Pengawas Pemilihan Umum. Pada tingkat pelaksanaannya, masih banyak terdapat kesenjangan informasi maupun pemahaman oleh penyelenggara dan peserta pemilu di daerah. Sosialisasi dilaukan dalam rangka memberikan informasi yang cukup serta kedalaman pemahaman yang memadai. Metode yang digunakan adalah sosialisasi secara langsung kepada subjek Pemilihan Umum. Ditemukan bahwa sebelum sosialisasi dilakukan terdapat kekurangan pengetahuan akan pengawasan penyelenggaraan Pemilihan Umum dalam konteks peraturan. Setelah sosialisasi dilakukan, diketahui terdapat peningkatan pemahaman atas pengawasan penyelenggaraan Pemilihan Umum. Pada prinsipnya pengawasan penyelenggaraan Pemilihan Umum perlu dilakukan dengan tunduk pada koridor peraturan perundang-undangan dan aturan turunannya seperti Peraturan Badan Pengawasan Pemilihan Umum

Abstract

Treaty on intellectual property, genetic resources and traditional knowledge 2024 approved an international agreement that is a breakthrough for the development of intellectual property. This paper aims to analyze the form of protection for indigenous peoples in the utilization of genetic resources used in patented research according to the international treaty WIPO and the urgency of the treaty for the development of patents in Indonesia. The approach used in this study is the statute approach and the analytical approach. The international treaty that began negotiations in 2001 is a strategic step for the development of intellectual property, especially indigenous peoples as holders of rights to genetic resources and traditional knowledge. Its use is often used in research to produce new inventions that are protected by patents. In such conditions, the applicant must disclose indigenous peoples as providers of traditional knowledge. The treaty is very important for the development of patents in Indonesia as well as strategic protection for traditional knowledge and genetic resources owned by Indonesia. Patented inventions containing genetic resources and traditional knowledge clearly disclose their material sources, thereby increasing the transparency of patent protection.

Abstract

The Consumer Protection Law in Indonesia has so far focused more on transactions between consumers and business actors without distinguishing between commercial products and subsidized products . In fact, subsidized products such as clean water from PDAM, subsidized electricity, and subsidized fuel have different legal characteristics because The price is set by the government and monitored by certain bodies . This difference has implications for price transparency, service quality standards, and dispute resolution mechanisms which is not fully regulated in the UUPK. This article aims to analyze the incompleteness of consumer protection regulations for subsidized products and propose a fairer and more effective legal reconstruction . By using normative approach , this research to study national regulations, WTO principles related to subsidies, and comparative studies with other countries . The results of the study indicate that consumer protection for subsidized products requires a more specific legal framework. to guarantee consumer rights without ignoring the interests of the government as a regulator and service provider as a special business actor . Therefore, it is necessary regulatory reconstruction that accommodates price transparency, improved service quality, and clearer dispute resolution mechanisms for consumers of subsidized products

Abstract

This study examines the constitutional limits of delegating normative authority to non-structural religious bodies in Indonesia, focusing on the National Sharia Council of the Indonesian Ulema Council (DSN-MUI). As a private religious institution, DSN-MUI issues fatwas that are adopted by the Financial Services Authority, Bank Indonesia, and Sharia financial institutions as binding references in the regulation of Islamic finance. This delegation model raises fundamental constitutional questions regarding legality, accountability, and the distribution of power under the 1945 Constitution. Employing a normative legal method with statutory and conceptual approaches, the study finds that while DSN-MUI enjoys functional legitimacy in Sharia economic regulation, the absence of direct statutory basis and public oversight mechanisms poses risks to the principle of legality and checks and balances. The study recommends a co-regulation model where DSN-MUI fatwas must be formally adopted through state regulations and subject to transparent accountability mechanisms to ensure compliance with the rule of law and constitutional democracy.

Abstract

The implementation of parking at Samarinda City Mall is carried out using the parking model and parking space leases, with variations in standard clauses. Potential disputes between the parties in this legal relationship can occur due to damage or loss caused by the actions of third parties, which have an impact on consumer losses. Variations in the implementation of parking have an impact on legal uncertainty which results in non-optimal legal protection for consumers of parking services. The research method used is empirical juridical supported by factual data obtained from research at the Samarinda City Mall. The results of the study show that the management and arrangement of parking at the Samarinda Mall is constructed as a parking agreement, the manager is responsible for damage and loss of vehicles using parking services. The standard clause on parking tickets is an exoneration clause, while the standard clause on parking space leases is not an exoneration clause. Even though BPSK Kota Samarinda has supervisory authority for standard clauses, its implementation is less effective. Supervision can be carried out by the permit giver for effective guidance and administrative sanctions. The implementation of parking space leases at the Samarinda Mall must be disciplined, because it is an avoidance of the responsibility of business actors, as an effort to optimize consumer protection.

Abstract

Indonesia is a country that has abundant natural resources; unfortunately, some areas are vulnerable to food insecurity. Such conditions indicate that food development has not reflected justice for the community. This study aims to examine the value of justice in the fulfillment of the right to food. This research applied the statutory approach, the conceptual approach and the philosophical approach. The fulfillment of the right to food for all Indonesians is an obligation of the state, therefore; the values of justice need to be put forward in order to realize national food sovereignty. Social justice is the focus for the direction of development policies to achieve the community welfare. Legal arrangements are needed in the development of food law, such as by drafting laws and regulations in the food sector based on Pancasila values and the constitution, changing the paradigm of food development to food sovereignty, using international legal instruments on food that have a positive impact on people's welfare, and diversifying food as a support for food sovereignty.
