Abstract

This study aims to investigate the dynamics of legal politics in the creation of a particular judicial body with the power to resolve election disputes in local government elections (elections); the influence of constitutional interpretation, which has the potential to become the main legal politics governing the power of state institutions. This study examines normative legal issues, the evolution of legal politics, legislation, historical context, constitutional court rulings, and the idea of the institution's ability. Beginning with the interpretation of the constitution about the dynamics of the meaning of the implementation of elections and the process for resolving election result disputes, the prospect for the legitimacy of the Constitutional Court's ability to settle disputes over election results is impacted by the evolution of the interpretation of article 22E paragraph (2) of the 1945 Constitution, which most recently surfaced. The reason for this is that the definitions of elections and general elections have become synonymous. As a result, article 24C of the 1945 Constitution systematically covers the ability to resolve disputes over election results.Penelitian ini bermaksud menggali dinamika politik hukum dalam pembentukan badan peradilan khusus yang berwenang menyelesaikan perselisihan hasil pemilihan gubernur dan wakil gubernur, bupati dan wakil bupati, serta walikota dan wakil walikota (pemilihan); serta pengaruh penafsiran konstitusi yang berpeluang menjadi politik hukum dasar kewenangan lembaga negara menyelesaikan perselisihan hasil pemilihan. Penelitian ini merupakan penelitian hukum normatif yang menganalisis perkembangan politik hukum peraturan perundang-undangan, latar belakang dan pertimbangan Penafsiran konstitusi dalam Putusan MK serta konsep kewenangan lembaga yang menyelesaikan perselisihan hasil pemilihan. Hasil penelitian menunjukan adanya pasang surut politik hukum penyelesaian perselisihan hasil pemilihan, ditandai dengan adanya perkembangan penafsiran konstitusi yang berdampak pada beberapa kali perubahan perundang-undangan. Dinamika pemaknaan penyelenggaraan pemilihan serta mekanisme penyelesaian sengketa hasil pemilihan diawali adanya penafsiran konstitusi yang memasukkan pemilihan dalam rezim pemilihan umum (pemilu); kemudian menegaskan pemisahannya; hingga terakhir adanya peluang peng­gabungan kembali pemilihan dalam rezim pemilu sebagai pilihan model keserentakan yang konstitutional berdasarkan Putusan Nomor 55/PUU-XVII/2019. Perkembang­an penafsiran Pasal 22E ayat (2) UUD 1945 yang terakhir muncul berpengaruh pada peluang adanya legitimasi kewenangan MK menyelesaikan sengketa hasil pemilihan. Pasalnya, pemaknaan pemilu dan pemilihan telah melebur menjadi satu, sehingga secara sistematis kewenangan penyelesaian sengketa hasil pemilu dalam Pasal 24C UUD 1945 dapat melingkupi kewenangan penyelesaian sengketa hasil pemilihan.

Abstract

This study aims to understand the legal aspect of digital investment in Indonesian crypto assets which is linked to the theories of legal certainty, justice, and benefit. Currently, Indonesian people are very fond of the cryptocurrency digital investment trend. The Indonesian government has provided several regulations regarding the physical crypto market mechanism. However, the rules regarding cryptocurrencies cannot guarantee that problems will not arise in the future. Moreover, cryptocurrency and its rules are still very new. There is still a lot of confusion in society about whether crypto investment is safe or not. This study is normative juridical study using a statutory and conceptual approach, which is summarized by examining statutory regulations and related legal doctrine. The results of this study explain that the Indonesian government is opening up opportunities by legalizing digital crypto investment activities to strengthen the economic sector. Crypto in Indonesia can only be used as an investment instrument, not currency. The implementation of crypto asset trading is regulated in the Commodity Futures Trading Supervisory Agency (Bappebti) Regulation Number 5 of 2019 concerning Technical Provisions for the Implementation of Physical Crypto Asset Markets. This regulation regulates the use of Good Corporate Governance principles in the context of carrying out buying and selling of crypto assets on the Crypto Futures Exchange (CFX). Bappebti's regulations were then changed with the enactment of Law Number 4 of 2023 concerning Development and Strengthening of the Financial Sector (UU P2SK) which expanded the authority and responsibility of the Financial Services Authority (OJK) to include digital financial assets, crypto assets and Financial Technological Innovation Sector. (ITSK).

Abstract

One of the important points of criminal law reform in the Criminal Code is the regulatory provision regarding living law. The Criminal Code authentically determines that living law is customary criminal law, which is declared valid and further regulated through Local Regulations. The absence of limitations related to customary criminal law standards that can be qualified as a living law has the potential to cause injustice. This study aims to analyze the urgency and the formulation of limitations on living law arrangements in the Criminal Code in realizing justice. The results of the study show that the urgency regarding limitations on living law arrangements in the Criminal Code is meant to protect human rights while at the same time preventing potential criminalization. The formulation of limitations of the living law arrangements in the Criminal Code is to realize justice. Therefore, the limitations of customary criminal law can be categorized as a living law according to the Criminal Code, that are: indigenous people still practice the law; these customary crimes do not conflict with the principles of the rule of law; they do not conflict with Pancasila values; and the crimes are further formulated by local regulations.

Abstract

The escalating environmental crisis and pressing water resource conservation issues globally necessitate comprehensive research. This study investigates urban green space regulations and water resource conservation challenges in Indonesia and Australia. Employing a comparative analysis, it examines the legal frameworks, policies, and implementations in both countries. The research aims to identify innovative and sustainable strategies for water resource protection. Findings reveal substantial disparities in regulatory approaches, public involvement, and the integration of green technologies in green space management between the two nations. Indonesia needs help enhancing institutional capacity and integrating green space policies into urban planning, while Australia focuses on climate change adaptation and sustainable water resource management. The study advocates cross-sectoral collaboration and ecosystem principles in green space regulations for practical water conservation objectives. It contributes fresh perspectives on legal and policy frameworks for addressing water resource conservation challenges through urban green space management, offering recommendations for cohesive and sustainable policy development.

Abstract

Tidak hanya dirasakan oleh perusahaan-perusahaan besar, tantangan dalam persaingan dunia usaha yang semakin ketat juga dialami oleh Usaha Menengah Kecil dan Mikro semenjak hadirnya e-commerce. Usaha Menengah Kecil dan Mikro sebagai pelaku usaha harus dapat melakukan adaptasi yang tepat dengan menggunakan fitur strategi pemasaran yang tedapat pada e-commerce. Optimalisasi dilakukan dengan cara melaksanakan kegiatan Pemberdayaan Kepada Masyarakat secara dari daring dengan melibatkan peran pemerintah melalui kementerian dan juga para ahli. Dari pelaksanaan kegiatan tersebut ditemukan bahwa dengan menggunakan e-commerce, user memperoleh informasi berupa hal-hal yang dapat mempengaruhi penjualan, waktu penjualan yang tepat, serta kebiasaan pasar. Pelaku Usaha Menengah Kecil dan Mikro perlu untuk diberikan suatu program peningkatan kualitas terkait penggunaan e-commerce agar membuat mereka berdaya saing dalam dunia transaksi elektronik

Abstract

Regulations regarding the development of Sharia Business Units (UUS) often experience changes, for example in Law Number 21 of 2008 concerning Sharia Banking in Article 68 paragraph 1. This advice aims to provide clear and specific legal references. Then, the latest regulation regarding UUS issued by the OJK. The Sharia Financial Services Authority (OJK) has issued a regulation regarding the spin-off of Sharia Business Units from Conventional Commercial Banks (BUK). This study aims to analyze OJK regulations regarding Sharia Business Units that have undergone spin-offs from the perspective of the legal system according to Lawrence M. Friedman, focusing on structural, substance, and cultural aspects, as well as the perspective of Islamic law regarding sharia compliance and ethical considerations. The method used is qualitative descriptive, with a sociological juridical approach that evaluates regulations based on legal principles and ethical considerations. Data was collected by means of documentation from Indonesian laws related to spin-offs, including Law Number 21 of 2008 concerning Sharia Banking. This regulation has a positive impact on the development of Sharia Business Units during the spin-off by increasing budget transparency, integrity, and operational efficiency leading to sustainable growth and compliance with Islamic principles.

Abstract

This study examines the constitutional limits of delegating normative authority to non-structural religious bodies in Indonesia, focusing on the National Sharia Council of the Indonesian Ulema Council (DSN-MUI). As a private religious institution, DSN-MUI issues fatwas that are adopted by the Financial Services Authority, Bank Indonesia, and Sharia financial institutions as binding references in the regulation of Islamic finance. This delegation model raises fundamental constitutional questions regarding legality, accountability, and the distribution of power under the 1945 Constitution. Employing a normative legal method with statutory and conceptual approaches, the study finds that while DSN-MUI enjoys functional legitimacy in Sharia economic regulation, the absence of direct statutory basis and public oversight mechanisms poses risks to the principle of legality and checks and balances. The study recommends a co-regulation model where DSN-MUI fatwas must be formally adopted through state regulations and subject to transparent accountability mechanisms to ensure compliance with the rule of law and constitutional democracy.

Abstract

The vast economic turnover in the showbiz industry, which consistently involves numerous celebrities in merchandising activities as a form of product and service marketing, does not always yield positive impacts for the celebrities themselves. Numerous cases involve the unauthorized use of a celebrity persona, often resulting in legal disputes. This study aims to delve deeper into the legal protection of celebrity personas, particularly regarding their use by third parties, which may cause economic and moral losses for the persona owners. Employing normative legal research methods with a statute approach and conceptual approach, this research examines the issue from the perspective of intellectual property law in Indonesia. The study concludes that the protection of celebrity personas under intellectual property rights can be accommodated within copyright law by categorizing personas into "natural persona" and "created persona," enabling their protection under Indonesia's Copyright Act.
