Abstract

Philosophy of law provides a deep theoretical foundation, while legal research methods provide the conceptual and technical tools needed to explore a deeper understanding of legal phenomena.  The importance of exploring this linkage is especially evident in the increasingly complex and dynamic era of contemporary legal research. In facing the challenges of legal complexity, researchers need a strong philosophical outlook to guide their approach in designing and conducting research. This research aims to outline the philosophical concepts in the philosophy of law that provide the theoretical basis for the formation of legal research methods and outline the main challenges faced by researchers in the integration of philosophical concepts in the development of legal research methods and how to overcome them. This research will use the type of normative research, with a conceptual approach method, using a literature review related to the philosophy of law, legal research methods, and the contribution of philosophical concepts in legal research. The data sources used, secondary data sources in the form of philosophy of law books, the main object of this research are contemporary legal research documents. The philosophy of law provides a philosophical foundation for legal science and after the birth of legal theory as an independent discipline, legal philosophy also becomes the philosophical foundation of legal theory. In legal research methods, legal ontology helps determine the scope of the research, map the body of law to be studied, and determine the relationship between elements in the research context. This process involves critical reflection and analysis to find meanings that may be hidden, then determine the value of the reality. The integration of philosophical concepts in the development of legal research methods presents significant challenges. Some of the main challenges involve the complexity and abstraction of philosophical concepts, the gap between legal research theory and practice, the heterogeneity of interpretations, and ethical dilemmas.

Abstract

Kerjasama antar negara sangat dibutuhkan mengingat era globalisasi yang semakin kompleks sehingga kerjasama antar subjek hukum internasional dapat membantu menyelesaikan konflik dan meningkatkan keamanan di tingkat internasional. Hubungan antarnegara menjadi semakin erat dan terjalin melalui berbagai perjanjian internasional. Perjanjian internasional berfungsi sebagai instrumen penting untuk mengatur berbagai aspek kerjasama antarnegara. Namun, meskipun prinsip-prinsip ini diakui secara luas, implementasinya dalam pelaksanaan perjanjian internasional sering kali menghadapi berbagai tantangan. Perbedaan interpretasi hukum, perubahan keadaan internasional, serta kepentingan nasional yang berubah dapat mempengaruhi cara negara-negara mengimplementasikan prinsip-prinsip ini. Selain itu, meskipun ada mekanisme penyelesaian sengketa internasional, efektivitasnya sering kali tergantung pada kemauan politik negara-negara yang terlibat  Penelitian ini akan mengangkat prinsip-prinsip umum hukum dalam hukum internasional untuk memastikan bahwa perjanjian-perjanjian ini dilaksanakan dengan baik dan efektif, Penelitian ini bertujuan untuk untuk mengeksplorasi bagaimana prinsip-prinsip umum hukum diakui dan diterapkan dalam berbagai perjanjian internasional.  Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Adapun sumber data yang digunakan adalah sumber data sekunder, yaitu data yang diperoleh dari studi pustaka dengan mempelajari dua bahan hukum yaitu: bahan hukum primer, berupa peraturan perundang-undangan Negara Republik Indonesia, perjanjian-perjanjian internasional, dan sebagainya. Bahan hukum sekunder, yaitu buku-buku yang berkaitan dengan tema perjanjian internasional, dan hukum  internasional, baik cetak maupun elektronik. Jurnal, hasil penelitian, baik dari surat kabar maupun internet yang relevan dengan penelitian. Keseluruhan bahan hukum yang diperoleh akan klasifikasi data disistematiskan, kemudian data yang telah disistematiskan dianalisis untuk dijadikan dasar dalam mengambil kesimpulan

Abstract

This study examines how restorative justice (RJ) and formal legal procedures compare in handling minor crimes at the police level in Jakarta, Indonesia. Using a qualitative legal-methods approach, it analyzes Indonesian laws and regulations (KUHP, KUHAP, Perkapolri, etc.), official police data, and recent case studies (2021–2025) from Jakarta police divisions. Key findings indicate that, under Perkapolri No. 8/2021 and Law No. 8/2021 (amending KUHAP), Indonesian police can now resolve many non-violent minor offenses via RJ. For example, Polres Metro Jakarta Barat reported resolving 525 cases through RJ in 2022. Compared to formal prosecution (which proceeds to court and possible imprisonment), RJ often brings faster, amicable settlements and reduces case backlogs. However, strict criteria apply: RJ is limited to relatively minor crimes with victim consent, and excluded are serious offenses or those injuring public justice. An illustrative case in South Jakarta involved a laptop theft on public transit resolved by RJ after the victim reclaimed her property and withdrew charges. This comparative analysis finds that while RJ has effectively resolved many petty cases (with support from police policies and victim participation), formal procedures remain necessary for severe crimes to ensure legal certainty and social justice. The study concludes that Indonesia’s dual approach—relying on formal law for serious offenses and RJ for minor disputes—offers practical benefits, provided safeguards (e.g. clear guidelines and voluntariness) are maintained.

Abstract

Political asylum has long been a sensitive issue in international relations, especially when granted to defectors or figures labelled as traitors by their home countries. This study aims to analyze the shift in meaning and function of political asylum in modern international relations, explain the geopolitical impact of defection accompanied by the granting of asylum, examine the foreign policy responses of the country of origin and the asylum-granting country, and provide an understanding of the dynamics of diplomatic tensions and foreign policy strategies related to the practice of granting asylum. This study uses a normative (doctrinal) juridical method, with a conceptual approach, legislation, and case studies. The data sources used are secondary data obtained through literature studies, consisting of primary legal materials, and tertiary Legal Materials. The results of the analysis show that political asylum has evolved from mere protection against persecution to an instrument of negotiation and geopolitical influence. Granting asylum to defectors has been proven to worsen diplomatic relations between countries, but on the other hand it is also used as a strategy of political pressure on the defector's country of origin. Therefore, countries need to balance between their commitment to protecting human rights and national interests, especially amidst increasing multi-regional geopolitical tensions. It is recommended that international legal norms be strengthened to clearly regulate the boundaries between the right to protection of individuals and the potential for political exploitation of asylum practices.
