Abstract

Tulisan ini mengkaji tentang Pengawasan DPRD terhadap pelaksanakan Perda Nomor 6 Tahun 2020 Tentang Adaptasi Kebiasaan Baru Dalam Pencegahan Dan Pengendalian Covid -19 dilakukan melalui Rapat Kerja Komisi, Kunjungan Kerja, Rapat Dengar Pendapat Umum dan Pengaduan Masyarakat. Kendala pengawasan terhadap pelaksanaan Perda ini dilapangan adalah karakter orang minang yang egaliter, yang tidak mudah percaya. Kendala yang paling amat mendasar adalah polemik pemikiran antara kelompok percaya Covid-19 dan yang tidak percaya adanya covid-19, bahkan yang berpolemik itu bukan saja masyarakat awan, termasuk ahli kesehatan, tokoh agama, tokoh masyarakat, makanya Perda belum maximal pelaksanaannya dilapangan. Dalam hal tindak lanjut Pengawasan yang dilakukan DPRD adalah terus mendorong Pemerintah daerah untuk mengupayakan agar perda berjalan dengan maximal dengan melakukan terus evaluasi dan rapat kerja dengan pemerintah daerah pada tiap bulannya, dan juga urung rembuk dengan tokoh-tokoh masyarakat, agama dan yang lainnya dengan kunjungan kerja kelapangan bersama pemerintah daerah.  Bentuk tindak lamjut lainnya yang dilakukan oleh DPRD dalam menjalankan fungsi pengawasannya terhadap pelaksanaan Perda ini adalah DPRD pernah mengirim surat kepada Gunernur untuk melakukan Peninjauan terhadap perda No. 6 tahun 2020.

Abstract

In human life, land is a very important need because almost all human activities take place on land. Provisions regarding land rights are regulated in Law no. 5 of 1960 concerning Basic Agrarian Regulations. Among the land rights are regarding Building Use Rights and Property Rights. And for this reason, it is necessary to register and upgrade from Building Use Rights to Property Rights. Building use rights have a limited period of time and should be upgraded to property rights in order to have legal certainty for the right holders. The increase in Building Use Rights to become permanent property rights must be registered at the Land Office where the object is located. The specification of this research is descriptive analysis. The approach used in this study is a normative-juridical approach. It is so called because this research is a literature research or document study aimed only at written regulations or other legal materials. Based on the results of the study, it shows that there is no legal protection for holders of Property Rights Certificates that have been canceled by the State Administrative Court Decision. The judge's consideration of the State Administrative Court in canceling land ownership rights is based on existing regulations and efforts made by the owner of the Certificate of Property Rights which has been canceled by the Decision of the State Administrative Court by filing an appeal.

Abstract

Article 127 paragraph (1) in conjunction with Article 128 of Law Number 22 of 2009 concerning Road Traffic and Transportation regulates the use of roads outside their functions. This research is an empirical juridical research. The role of Satlantas Polresta Padang in controlling the use of roads outside the function to prevent traffic accidents is to regulate, guide, and/or supervise. Use of public roads for personal purposes for parties must obtain permission from the Police. The consideration for granting permission to use a road for personal gain by the Police is that there are alternative roads that can be used by the public so that they do not hinder traffic activities and that there are road markings that can provide indications that the road cannot be traversed, that road use cannot be carried out by completely closing the entire body. road. Forms of law enforcement by giving warnings and making forced efforts. Not yet in the jurisdiction of the Padang Police Traffic Unit has been subject to criminal sanctions for this violation. Obstacles in controlling the use of non-functional roads to prevent traffic accidents by the Padang Traffic Police, namely the insufficient number of police personnel to supervise and control the use of non-functional roads, lack of dissemination of laws and regulations regarding criminal threats to the use of roads outside of functions. Lack of coordination and cooperation between the Police and the local government, namely RT/RW, Kelurahan, to the Government of each sub-district within the city of Padang in this case, concrete actions taken by RT/RW, Kelurahan Government, and the National Police as law enforcers to curb the use of way outside the function.

Abstract

Regional Regulation Number 15 of 2016 Concerning the Formation of Regional Structures and Devices, the Fifty Cities District Fire Service has been independent and has effectively carried out its duties since January 2017 which has the task of providing services, one of which is non-rooted services. The results of the study can be explained that the authority of the Fire Department in Non- Fire Services in Fifty Cities District refers to the Fifty Cities District Regulation Number 4 of 2020, namely: Disaster Victim Rescue, evacuation of threats to life or property, evacuation of animal safety and providing support for governance and community services. Constraints faced by the Fire Service of the Lima Puluh Kota Regency in public services in the field of non-fire services a) lack of impartiality in budgeting policies for the implementation of non-fire services b) lack of optimal utilization of non-fire services by related OPDs. c) there is not yet an understanding between OPDs regarding fire fighting duties in these non-fire services. d) Inadequate information and communication in some villages/communities. f) not all people understand the duties of the Fire Service in non-fire services, g) inadequate performance of fire and disaster management apparatus and institutions, and h) lack of effective coordination. And efforts to overcome the obstacles faced by the Fire Department of the Fifty Cities Regency in public services in the field of non-immortal services are a) increasing budgetary policies, b) unifying understanding between OPDs related to fire fighting duties in non-fire services. c) informing and communicating the authority of firefighters in non-fire services. d) outreach to the public in order to understand the duties of the fire department in non-fire services. e) increasing the number of human resources both in terms of quality and quantity.

Abstract

Law Number 1 of 2014 concerning Amendments to Law Number 27 of 2007 concerning Management of Coastal Areas and Small Islands, explicitly explains criminal sanctions for perpetrators of mining coral reefs. This research is Normative Juridical legal research. Criminal Application Against Defendant Mining Coral Reefs in Conservation Areas In Decision Number 73/Pid.B/2017/PN Sit the defendant was charged under Article 73 paragraph (1) letter a of Republic of Indonesia Law No. 27 of 2007 concerning Management of Coastal Areas and Small Islands. Decision Number 592/Pid.Sus/2019/PN Pdg defendant Risal Bin Olleng was proven to have jointly committed the criminal act of destroying coral reef ecosystems in a conservation area as well as defendant I. Usmanto PGL. Brother and defendant II. Muhammad Nur PGL. The act mentioned above has been legally and convincingly proven guilty of committing the criminal act of "participating in committing acts which result in pollution and/or damage to fish resources and/or the environment in the fisheries management area of the Republic of Indonesia." The judge's consideration in imposing a crime on the defendant in Decision Number 73/Pid.B/2017/PN Sit and Number 592/Pid.Sus/2019/PN Pdg is that it has the same elements of consideration, namely each person, and the element of deliberately mining coral reefs, taking coral reefs in Conservation Areas, using explosives and toxic materials, and/or other methods that result in damage to the coral reef ecosystem.
