Abstract

Pemberlakuan Undang-Undang Nomor 6 Tahun 2014 tentang Desa berimplikasi pada kucuran dana miliaran rupiah langsung ke desa yang bersumber dari alokasi dana desa. Kepala desa sebagai pemimpin desa harus dapat menerapkan fungsi manajemen sejak perencanaan, pengorganisasian, penggerakan, dan pengawasan untuk mengatur desanya supaya lebih maju. Berdasarkan peraturan per-UU-an yang ada, pemerintah desa dibantu oleh Badan Permusyawaratan Desa. Tulisan ini menyajikan peran vital BPD sebagai penerus aspirasi masyarakat di dalam pemerintahan desa. Artinya, BPD bukanlah lembaga yang dapat dengan begitu saja disepelekan, melainkan kepala desa harus senantiasa bekerja sama dengan BPD dalam pembangunan desa. Akhir penulisan ini menjelaskan tentang pengawasan keuangan yang dilakukan oleh BPD. Pelaksanaan pengawasan juga dapat mendeteksi, sejauh mana kebijakan kepala desa untuk menjalankan dan penyimpangan keuangan yang terjadi dalam pelaksanaan kerja tersebut. Tulisan ini juga menegaskan bahwa faktor yang dapat mendukung pengawasan BPD adalah masyarakat, karena masyarakat merupakan faktor penentu keberhasilan BPD dalam melaksanakan pengawasan keuangan desa.The Role of Village Consultative Board in Village Development and Village Finance SupervisionThe enactment of Law Number 6 Year 2014 on Village implies the disbursement of billions of rupiah funds directly to the villages sourced from the allocation of village funds. The village head as a village leader should be able to implement the management function from planning, organizing, mobilizing, and supervising to organize his village to be more advanced. Under the existing law, the village government is assisted by the Village Consultative Board (Badan Permusyawaratan Desa). This paper presents the vital role of BPD as the successor to the aspirations of the people in the village administration. BPD is not an institution that can be underestimated, but the village head should always work with BPD in rural development. The end of this paper describes the financial supervision made by BPD. The implementation of supervision can also detect to what extent the policy of the village head is to run and the financial irregularities that occur in the implementation of such work. This paper also confirms that the factors that can support BPD supervision is the community, because the community is a critical determinant of the success of BPD in implementing village financial oversight.DOI: https://doi.org/10.22304/pjih.v4n3.a10

Abstract

The implementation of village / Nagari head elections in the regions must be in accordance with the characteristics of the local community is in order to realize the implementation of village head elections that are honestly fair, beneficial, and to provide democratic political education to the community, which in turn increases public trust in their leaders , therefore the election of the Village Head must be continuously developed and adapted to the development of the community in the area or village. The Indonesian nation has expressly stated this in the (constitution) opening of the 1945 Constitution, the fourth paragraph which is the purpose of life of the nation and state, which is to protect the entire Indonesian nation and the entire bloodshed of Indonesia, and to promote public welfare, educate the nation's life. The democratic system in Indonesia, the community has the right, even the obligation to play politics to determine its future, play a role in making laws and regulations (law) and oversee its implementation. Laws in Indonesia are formed in the form of laws and regulations, so everyone who inhabits areas within the territory of the Republic of Indonesia must submit to him. Furthermore, from a political point of view, people do not only look at the implementation of an sich law, but also consider the consequences of a decision based on law on the interests of society, nation and state. Abstract

The establishment of Rural Law is mandated by 1945 Constitution which provides recognition, status, law assurance, diversity, democracy and promote rural indigenous cultural traditions. The imple-mentation of Rural Law has implications towards nagari (village) governance which has to adjust it-self to the system and mechanisms stipulated in the Rural Law. Currently, government and West Su-matera Province regional house of representatives (DPRD) has established Regional Regulation draft on Principles of Nagari administration and waiting for Approval by the Ministry of Internal Affairs. The recognition of nagari as a traditional village and law community unit and the Indigenous communities require legal assurance and rights of origin enforcement as well as its authority in the effort of gov-ernance implementation and community empowerment. Nagari management prospects is West Suma-tera Regional Government agenda to empower villages through village budget aid despite its contro-versy  in terms of maintaining traditional culture of Salingka nagari.Keywords : village, village administration, legal instruments

Abstract

Pemerintah Daerah memiliki peran yang sangat vital didalam perlindungan anak. Hal ini tertuang didalam pasal-pasal Undang-Undang Perlindungan Anak. Didalam mewujudkan tata kelola pemenuhan hak anak oleh Pemerintah Daerah haruslah benar-benar direalisasikan dan dijalankan dengan semestinya. Kota Layak Anak merupakan impian dari setiap anak, karena anak akandibesarkan secara layak dan semestinya. Pemerintah Daerah sebagai pemerintah yang bersentuhan lansung dengan kehidupan anak, harusnya lebih aktif dan lebih kritis, untuk menyuarakan hak-hak anak. Menata kelola pemenuhan hak anak oleh Pemerintah Daerah harus diawasi sebuah lembaga sendiri yang fokus untuk melindungi, menjaga, memantau dan mengawasi hak anak. Penanaman pemahaman perlindungan anak berkelanjutan sangatlah perlu diajarkan sejak dini kepada masyarakat, karena apabila sejak dini masyarakat diajarkan memahami perlindungan anak secara berkelanjutan, maka perlindungan anak di Indonesia tidak akan berhenti.

Abstract

The main problems in this research were, first, how is the participation of local governments in realizing children-friendly city/district (KLA) in Indonesia. Second, what are the factors that affect the local governments in realizing children-friendly city/district in Indonesia. This was a normative legal research; legal materials were analyzed using descriptive qualitative approach. The results of the research showed that: first, the forms of participation of the local governments in fulfilling children’s rights so that they deserve to be declared as KLA are: 1) Civil Rights and Freedom; 2) Family and Alternative Nursery; 3) Disability, Basic Health and Welfare; 4) Education, Utilization of Leisure Time and Cultural Activities; and 5) Special Protection. Second, there are several factors that affect how a region becomes KLA: 1) Legislation and policies on the fulfillment of children's rights; 2) Budget for the fulfillment of children's rights; 3) The number of legislations, policies, programs and activities that get input from children forum and other children groups; 4) Availability of KLA-trained human resources who are able to integrate children’s rights into policies, programs and activities; 5) Availability of children’s data by sex, age, and sub-districts; 6) Involvement of community institutions in the fulfillment of children's rights; and 7) Involvement of business in the fulfillment of children’s rights.

Abstract

The prospect of amendments carried out by a country shows that the country is following developments that the present will certainly not be the same in the future. Indonesia, which has undergone the replacement of the Constitution and the Amendment to the Law, has appointed Indonesia as a country to be better than in the past. Article 37 of the 1945 Constitution of the Republic of Indonesia becomes the Fundamental Basis. Related to legal issues and discourses on the terms of office of the President and Vice President for three periods which have led to polemics for and against, however, if it is related to the opportunities that exist in the MPR as a State Institution, amend Article 7 of the Constitution regarding the terms of office of the President and Vice President and fulfill the provisions of Article 37 of the Law. The Constitution and the people's approval so that the past history in this country does not repeat itself, meaning that it is normatively legal for the 2024 Election.

Abstract

This community service activity was carried out on Wednesday, August 21, 2019 with the first aim, to find out and analyse the background knowledge and experience of the nagari device to influence knowledge and abilities (expertise) in the preparation of Nagari Legal Products. Second, to find out and analyse how to increase the capacity of knowledge and abilities (expertise) of the Nagari Tool kit in preparing Nagari Legal Products? Third, to find out and analyse the right strategy to increase the capacity of the nagari government apparatus and members of Bamus Nagari so that they are able to draft a Nagari Regulation that is based on the needs of the nagari community. Community service activities in the form of training are carried out using lecture, question-answer, deepening and training methods. The lecture method is used as a preliminary briefing on several theories, concepts, and laws and regulations relating to nagari legal products, as well as to increase the motivation of nagari devices in the preparation of nagari legal products. While the question-and-answer method provides an opportunity for participants to discuss obstacles that arise during their practice and experience in arranging nagari legal products. The training method is used to practice the formulation of nagari regulations. Based on the activities that have been carried out, it can be concluded that almost all the training participants were very enthusiastic in participating in the training that was held with an indication that the active participants were discussing, the nagari as participants were present from the beginning of the opening until the end of the opening. After the training ended, he was able to understand and practice well all the material delivered during the service activities. The obstacle that arises is the limited space in the Bayang Sub district area, so that the place is done in the Nagari Office Hall which is too large and not soundproof so that the implementation of activities must use a loudspeaker.
