Abstract

In Religious Courts, numerous cases within the sphere of absolute authority are not exclusively fortified by material legal sources through legislation. The ingenuity of judges becomes indispensable in extracting the essence of the law from various sources, including the rich tapestry of local cultural customs inherent within the community. The concept also leads to the emergence of cases decided through the discretionary methods employed by judges. Therefore, this study aimed to discuss the local cultural forms that served as points of reference for judges when exercising their discretion in rendering verdicts on inheritance disputes within the Religious Courts of South Kalimantan. The existence of judicial discretion in the decision-making process was unravelled, particularly when legal considerations aligned with the mandates of the heirs, emanating from the local culture of the Banjar people residing in the region. Furthermore, the translation of the heir's mandate, resembling a testament, exemplified the exercise of unrestrained discretion by the judges. Local culture was viewed as an indispensable component of the living law that pervaded society, with its ability to adapt and engage with the ever-changing landscape.

Abstract

Artikel ini membahas analisis tafsir dan fikih mengenai pertengkaran terus-menerus dan syiqāq sebagai alasan perceraian. Penelitian ini menyoroti pengertian dan ruang lingkup syiqāq melalui tafsir Al-Qur’an serta prinsip-prinsip fikih, serta evaluasi ketentuan hukum yang berlaku, terutama dalam konteks Pasal 19 huruf f Peraturan Pemerintah Nomor 9 Tahun 1975 jo. Pasal 116 huruf f Kompilasi Hukum Islam. Penelitian ini adalah penelitian kepustakaan, dengan pendekatan doktrinal dan perundang-undangan. Hasil penelitian menunjukkan bahwa secara teoritik dan praktek pengaturan dalam Buku II huruf b yang memisahkan antara pertengkaran terus menerus dengan syiqāq tersebut sarat dengan problematika hukum. Dalam tinjauan berbagai pendekatan dan teori analisis, yaitu melalui pendekatan tafsir Al-Qur’an dan fiqih, melalui teori mashlahat, teori maqashid syariah dan teori sinkronisasi hukum, pemisahan tersebut tidak tepat dan berakibat kepada ketidaksinkronan dalam praktek hukum penanganan perkara perceraian dengan alasan pertengkaran terus-menerus. Karena itu dalam rangka memberikan solusi atas problematika hukum tersebut ketentuan dalam Buku II huruf b tersebut harus ditinjau ulang dan dilakukan rekonstruksi hukum. Perubahan/ revisi terhadap Buku II/SEMA Nomor 7/2015 yang mengatur penangan perkara cerai gugat dengan alasan syiqaq harus diajukan sejak awal gugatan diajukan, bukan perkara pertengkaran yang kemudian syiqaq-kan. Dirubah/direvisi  menjadi kewenangan untuk menilai syiqaq atau tidaknya sepenuhnya menjadi kewenangan hakim.
