Abstract

Abstract: Traditional knowledge is knowledge owned by the hereditary community. In its development, there is traditional knowledge that is used as the origin of a patent invention so in Article 26 of Law No. 13/2016 concerning Patents, it is required that patent applications originating from traditional knowledge must state the origin of the traditional knowledge as determined by an official institution recognized by the government. Currently, the management of traditional knowledge is carried out by 3 (three) institutions, namely the Ministry of Education and Culture, the Ministry of Law and Human Rights, and the Ministry of Environment and Forestry. Still, from the activities of these institutions, none have been officially recognized by the government to issue a determination of traditional knowledge that is the origin of a patent registration application. The system in mentioning the origin of conventional knowledge in patent registration applications needs to be studied through 3 aspects: structure, substance, and legal culture.Keywords: Traditional Knowledge, Patent, System.

Abstract

Abstract: Computers initially began to develop in 1940 in the first generation. Along with the development of the computer also helped develop which was called a computer program. Computer programs are a matter that cannot be separated from the computer itself, therefore many people do piracy against these computer programs. The computer program itself is one form of copyrighted work regulated in Law No. 28 year 2014 about Copyright. But in practice there are still many people who pirate the Computer Program so that it requires a law enforcement, especially the enforcement of criminal law against piracy of computer programs.Keywords: Computer Program, Copyright, Criminal Law

Abstract

Pengetahuan tradisional merupakan pengetahuan yang dimiliki oleh masyarakat yang bersifat turun-temurun. Dalam perkembangannya terdapat pengetahuan tradisional yang dijadikan asal suatu invensi paten sehingga dalam Pasal 26 Undang-Undang No. 13/2016 tentang Paten mensyaratkan bahwa permohonan paten yang berasal dari pengetahuan tradisional wajib menyebutkan asal pengetahuan tradisional yang ditetapkan oleh lembaga resmi yang diakui oleh pemerintah. Saat ini pengelolaan pengetahuan tradisional dilakukan oleh 3 (tiga) lembaga yaitu Kementerian Pendidikan dan Kebudayaan, Kementerian Hukum dan Hak Asasi Manusia, dan Kementerian Lingkungan Hidup dan Kehutanan namun dari kegika lembaga tersebut belum ada yang diakui resmi oleh pemerintah untuk mengeluarkan penetapan suatu pengetahuan tradisional yang menjadi asal suatu permohonan pendaftaran paten. Apakah terdapat ketidakpastian hukum dalam pendaftaran paten tradisional. Dalam mengkaji kepastian hukum terhadap pendaftaran paten tradisional penelitian ini menggunakan metode normatif dengan menggunakan data sekunder yang dianalisis secara deskriptif.

Abstract

Abstract: Trademark protection in Indonesia currently applies the first to file principle as stipulated in Article 3 of Law Number 20 of 2016 concerning Trademarks and Geographical Indications. However, in practice, the application of the first-to-file principle has not been able to provide legal certainty for trademark owners. As a result, several countries have adopted the first-to-use principle in their trademark protection systems. Although Law Number 20 of 2016 does not explicitly regulate the first-to-use principle, several provisions within the law reflect elements of this principle, including Article 21 paragraph (1), Article 21 paragraph (3), and Article 78 paragraph (1). The application of the first-to-use principle can also be observed in several court decisions in which judges consider the first use of a mark when determining trademark ownership. On the other hand, there are also court decisions that remain consistent with the first to file principle as mandated by the law. This research is a normative legal study analyzed using a qualitative method. The study employs the theory of legal certainty and the theory of legal systems. It concludes that the implementation of the first to use principle in Indonesia is still highly abstract and therefore does not yet reflect legal certainty for trademark owners.Keywords: Trademark, Legal Certainty, First to Use.
