Abstract

AbstrakJurnal ini bertujuan untuk menganalisis dan membandingkan sistemketatanegaraan di Amerika Serikat dan Indonesia, serta mengkajiimplikasinya terhadap stabilitas politik nasional masing-masing negara. Kedua negara, meskipun memiliki latar belakang sejarah dan budaya yangberbeda, sama-sama menganut sistem pemerintahan presidensial. Namun, terdapat perbedaan signifikan dalam struktur kelembagaan, mekanismepemilu, serta hubungan antara lembaga-lembaga negara. Analisis komparatifini akan mengidentifikasi persamaan dan perbedaan mendasar dari keduasistem tersebut, dengan fokus pada prinsip-prinsip pemisahan kekuasaan, sistem check and balances, serta peran partai politik. Selain itu, jurnal ini jugaakan mengeksplorasi bagaimana perbedaan-perbedaan tersebut berdampakpada stabilitas politik di masing-masing negara. Studi ini menyimpulkanbahwa meskipun kedua negara memiliki sistem pemerintahan yang serupa, terdapat perbedaan yang signifikan dalam praktik politiknya. Perbedaantersebut memiliki implikasi yang kompleks terhadap stabilitas politik nasional. Melalui studi komparatif ini, diharapkan dapat memberikan kontribusi dalampemahaman yang lebih mendalam mengenai dinamika politik di kedua negara, serta memberikan masukan bagi upaya penguatan stabilitas politik diIndonesia. The two countries, even thoughthey have different historical and cultural backgrounds, both adhere to apresidential system of government. However, there are significant differencesin institutional structures, electoral mechanisms, and relationships betweenstate institutions. This comparative analysis will identify the basic similaritiesand differences between the two systems, focusing on the principles ofseparation of powers, the system of checks and balances, and the role ofpolitical parties. Apart from that, this journal will also explore how thesedifferences have an impact on political stability in each country. This studyconcludes that although the two countries have similar government systems, there are significant differences in political practices. These differences havecomplex implications for national political stability. Through this comparativestudy, it is hoped that it can contribute to a deeper understanding of politicaldynamics in the two countries, as well as provide input for efforts tostrengthen political stability in Indonesia. Abstract

The increasing number of medical malpractice cases is ironic, because with the current Health Law it is hoped that malpractice cases can be reduced in number. The Health Law and other regulations must be obeyed by all parties in the world of health, especially hospital corporations so that apart from medical personnel or health workers, hospitals, directors and hospital management must also take legal responsibility, in accordance with their respective roles in the event of malpractice in the hospital environment. On the other hand, the stakeholders of this hospital will receive legal protection if they have implemented all their rights and obligations in accordance with applicable legal provisions. The specific purpose of this research is to prove that hospital corporations are also eligible for criminal sanctions if malpractice occurs in the hospital environment, through the application of strict liability principle, compiled with the interconnection of various related legislation products. This research uses normative juridical research methods that are descriptive prescriptive, using data and information from relevant literature sources, primary legal sources in the form of statutory provisions and jurisprudence, corporate theories used to analyse the problems, as well as research data obtained from the internet/website of related agencies. Abstract

This study analyzes the empowerment of members of the Indonesian House of Representatives (DPR RI) through the perspectives of constitutional law and mass psychology, highlighting its impact on public perceptions of justice. Through a framework of understanding the principles of good governance, this study assesses aspects of transparency, accountability, and participation in granting permits. Normatively, allowances should reflect public ethics and social justice, but empirically, they actually give rise to dissatisfaction and negative perceptions due to economic disparity and poor legislative performance. Using a qualitative-descriptive approach, the study finds that weak implementation of good governance principles reinforces polarization and erodes public trust, resulting in allowances being perceived as a form of injustice.
