Abstract

This study aims to determine the effectiveness of the role of community leaders in non-litigation mediation of polygamy cases in Parakan District, Temanggung Regency. Non-litigation mediation is an alternative conflict resolution that is often faced by couples who want to practice polygamy, especially in the context of Islamic law and local socio-culture. Community leaders, including religious leaders and traditional leaders, play an important role as mediators in helping couples and families reach agreements without going through the court process. This study uses a qualitative approach with a case study method, involving observation and in-depth interviews with community leaders, couples involved, and families. The study results indicate that community leaders have a significant success in mediating polygamy cases using personal and religious approaches that are by local values. The effectiveness of this non-litigation mediation is determined by community trust in the integrity of the leader, a good understanding of legal and religious aspects, and communication skills used in conflict resolution. However, the challenges faced include differences of opinion between couples and families, as well as the limited authority of community leaders in making binding decisions. In conclusion, the role of community leaders in non-litigation mediation of polygamy cases in Parakan District has proven effective in reducing domestic conflict, although it requires further support and cooperation from various parties to ensure the sustainability and continuity of the mediation results. Abstract

Penelitian ini di latar belakangi oleh kebolehan poligami dengan dalil ayat Qur’an surat An- nisa ayat:3 namun fakta di lapangan menunjukkan bahwa poligami memicu kekerasan terhadap anak dan istri dalam rumah tangga. Penelitian ini bertujuan untuk meninjau hukum poligami di dalam surat An-nisa:3. Metode penelitian ini kualitatif menggunakan studi pustaka (library research). Penelitian ini menggunakan pendekatan lafdziyyah, yang mencakup kaidah Amr, Nahy, Am, dan Khash. Sumber data yang di gunakan adalah buku dan jurnal ilmiah. metode pengumpulan data akan berfokus pada kajian teks Al-Quran dan referensi penafsiran terkait kata atau frasa yang ada di dalam surat An-nisa Ayat 3. Teknik analisis data berfokus pada analisis teks untuk menggali makna kata-kata atau lafadz secara mendalam (semantik lafdz). Hasil penelitian ini bahwa poligami di tinjau dari segi lafaz hukumnya mubah. Hukum ke mubahan poligami tercapai terpenuhinya syarat adil yang sifatnya menuntut dengan sungguh dan memberi peringatan. Temuan penelitian ini bahwa sighat lafaz تُقْسِطُوْا adalah fi’il mudhari yang bermakna sekarang dan masa yang akan datang. Sedangkan manusia tidak selamanya bisa berbuat adil. Sehingga syarat keadilan dalam poligami tidak dapat tercapai. This research is motivated by the permissibility of polygamy with the argument of the Qur'anic verse Surah An- nisa verse: 3, but the facts on the ground show that polygamy triggers violence against children and wives in the household. This research aims to review the law of polygamy in Surah An-nisa:3. The research method is qualitative using library research. This research uses a lafdziyyah approach, which includes the rules of Amr, Nahy, Am, and Khash. The data sources used are books and scientific journals. data collection methods will focus on the study of Al-Quran texts and interpretative references related to words or phrases in Surah An-Nisa Verse 3. The data analysis technique focuses on text analysis to explore the meaning of words or lafadz in depth (semantic lafdz). The result of this research is that polygamy in terms of lafaz is permissible. The law of permissibility of polygamy is achieved by the fulfilment of fair conditions which are demanding in nature and giving warnings. The finding of this research is that the sighat lafaz تُقْسِطُوْا is fi'il mudhari which means present and future. Meanwhile, humans cannot always be fair. So the requirement of justice in polygamy cannot be achieved.

Abstract

This study examines the relationship between husband and wife from the perspective of the Al-Qur'an and Hadith. Using a qualitative approach with a Library Research method, this study explores various sources, including the Al-Qur'an, Hadith, and relevant scholarly works. The research aims to understand the fundamental principles governing marital relationships in Islam, focusing on the rights and obligations of both husband and wife. The findings highlight that the Al-Qur'an and Hadith emphasize mutual respect, love, and cooperation in maintaining a harmonious family life. Additionally, the study underscores the shared responsibility of both spouses in educating and nurturing their children, ensuring a balanced and morally sound upbringing. The comprehensive guidelines provided in Islamic teachings serve as a foundation for building a stable and prosperous household. These insights contribute to a deeper understanding of the marital framework in Islam and its implications for contemporary Muslim families.
