Abstract

The climate crisis is becoming an increasingly urgent global challenge that profoundly impacts agriculture, ecosystems, and public health. According to the 2024 Intergovernmental Panel on Climate Change (IPCC) report, global temperatures have risen by 1.2°C since the pre-industrial era, and this warming is primarily driven by emissions from the energy sector, particularly the burning of fossil fuels. As one of the largest carbon-emitting countries, Indonesia remains heavily reliant on fossil fuels, especially coal, which accounts for around 60% of its electricity generation in 2024. Although Indonesia is endowed with significant renewable energy potential, various structural challenges, including ineffective policies and regulatory frameworks, hinder the solar, wind, and geothermal transition to clean Energy. The existing laws and regulations do not provide sufficient incentives for the development of renewable Energy, and bureaucratic hurdles, coordination issues among government agencies, and a lack of legal clarity on pricing and incentives further impede progress. This study aims to evaluate the adequacy of Indonesia's energy laws in supporting a clean and sustainable energy transition and to identify key legal barriers that need to be addressed. The findings are expected to contribute to policy recommendations that could strengthen Indonesia's legal framework, thus facilitating a more rapid and effective transition to a greener energy future.

Abstract

Penelitian ini bertujuan untuk mengkaji secara normatif peran serta masyarakat dalam proses legislasi nasional, dengan studi fokus pada Undang-Undang Sistem Pendidikan Nasional (UU SISDIKNAS) dan Undang-Undang Keterbukaan Informasi Publik (UU KIP). Kedua regulasi ini merupakan instrumen hukum strategis dalam menjamin akses masyarakat terhadap layanan pendidikan dan informasi yang terbuka dan akuntabel. Penelitian ini dilatarbelakangi oleh masih terbatasnya efektivitas implementasi kedua undang-undang tersebut dalam menjangkau seluruh lapisan masyarakat secara adil, khususnya kelompok yang rentan terhadap eksklusi sosial dan geografis. Pendekatan yang digunakan adalah kualitatif deskriptif dengan metode studi dokumen, yang mencakup analisis terhadap substansi hukum, proses legislasi, serta pelaksanaan kebijakan di tingkat pusat dan daerah. Hasil penelitian menunjukkan bahwa secara normatif, UU SISDIKNAS dan UU KIP telah memuat prinsip-prinsip partisipasi publik dan akses yang inklusif. Namun, dalam praktiknya terdapat kesenjangan antara ketentuan hukum dan implementasi faktual di lapangan. Kendala utama yang diidentifikasi meliputi minimnya ruang partisipasi publik yang bermakna dalam proses pembentukan undang-undang, dominasi elit dalam agenda legislasi, lemahnya pengawasan pelaksanaan kebijakan, serta hambatan birokrasi dan koordinasi antar lembaga. Selain itu, inkonsistensi kebijakan antara tingkat pusat dan daerah turut memperlemah efektivitas regulasi tersebut. Penelitian ini menegaskan bahwa reformasi sistem legislasi harus diarahkan pada penguatan mekanisme partisipasi publik yang substansial, peningkatan kapasitas institusi pengawas, serta penyelarasan kebijakan lintas sektor dan tingkat pemerintahan. Dengan tata kelola legislasi yang lebih inklusif dan akuntabel, regulasi di bidang pendidikan dan informasi dapat berfungsi secara optimal dalam mendorong pemerataan akses dan kualitas layanan publik yang berkeadilan.

Abstract

This study examines the existence of academic manuscripts in implementing the concept of meaningful public participation as mandated by Law No. 13 of 2022 concerning the Second Amendment to Law No. 12 of 2011 on the Establishment of Laws and Regulations. The main issue addressed is the weak consistency in attaching academic manuscripts to the legislative process, which often renders public participation merely formal and not substantive. The objective of this research is to analyze the urgency of academic manuscripts in ensuring justice, inclusivity, and transparency in law-making, while also evaluating their practical application in drafting Regional Regulations (Perda) in Bontang City during 2018–2024. The research applies a normative legal method (doctrinal research) using statutory, conceptual, and case approaches. The data analyzed consist of primary and secondary legal materials as well as empirical evidence from Bontang City’s e-archive. The findings reveal that academic manuscripts play a strategic role in strengthening public participation; however, in practice, they are often disregarded or prepared only as administrative formality without substantive study. The Bontang case study demonstrates the low consistency of academic manuscripts in the drafting of local regulations, leading to weak legitimacy and regulatory quality. This study concludes that the existence of academic manuscripts must be reinforced through stricter regulation and inclusive legislative practices. The recommendations emphasize the need for a stronger mechanism of public information disclosure, mandatory substantive participation, and institutional capacity building to ensure that every policy enacted is based on scientific analysis and genuinely reflects the aspirations of the people.

Abstract

This research explores the non-military preventive approach as a solution to human rights violations committed by the Armed Violence Group (KKB) in Papua. Using normative juridical methods, this research examines human rights law regulations in Indonesia, literature studies, and analysis of Gus Dur's speeches and writings on the peaceful approach. The conflict in Papua, fueled by a history of discrimination, exploitation of natural resources, and centralized policies, has been exacerbated by an often ineffective military approach. Comprehensive solutions are needed to address the injustice, poverty and human rights violations experienced by Papuans. This research proposes a strategy based on inclusive dialog, local participation, and respect for Papuan identity. This approach is rooted in the principles of justice, equality and human values upheld by Gus Dur. In addition, efforts to empower the economy, education, and infrastructure development in favor of indigenous peoples are considered important for creating sustainable peace. The results show that conflict resolution in Papua requires not only security solutions, but also strategic steps that prioritize social welfare and human rights protection, thus strengthening national cohesion within the framework of the Unitary State of the Republic of Indonesia (NKRI).

Abstract

This study examines the Analysis of Industrial Design Rights Protection in the Supreme Court Decision No. 1865 K/Pdt.Sus-HKI/2022 as mandated by Law No. 31 of 2000 concerning Industrial Designs. The main issue discussed is the application of the principles of novelty and good faith in the legal protection of industrial designs, as well as how the court applies these principles in its judgment. The purpose of this research is to analyze the urgency of applying the principles of novelty and good faith to maintain a balance between the exclusive rights of design owners and the public interest, and to assess the consistency of the Supreme Court in upholding justice and legal certainty within the field of intellectual property rights. The research employs a normative (doctrinal) legal method using statutory, conceptual, and case approaches based on the Supreme Court Decision No. 1865 K/Pdt.Sus-HKI/2022. The data consist of primary, secondary, and tertiary legal materials, including legislation, academic literature, and relevant jurisprudence. The results show that novelty is an essential requirement for obtaining legal protection over industrial designs, while good faith serves as both a moral and juridical filter to prevent the misuse of rights by unqualified parties. The Supreme Court emphasized that legal protection is granted only if the design is genuinely new, aesthetically valuable, and registered with honesty and legitimate intention. The study concludes that the principles of novelty and good faith hold fundamental importance in Indonesia’s industrial design legal system. Both serve as the core foundation in determining the validity of registration and protection of industrial designs. The study recommends strengthening technical regulations and enhancing substantive examination by the Directorate General of Intellectual Property (DGIP) to ensure that industrial design protection becomes more effective, fair, and responsive to the growth of the creative industry.
