Abstract

Arus globalisasi adalah arus yang tidak bisa dihentikan oleh negara mana pun, tidak terkecuali dengan Indonesia. Kondisi tersebut tentu akan berdampak pada nilai-nilai bangsa. Terdapat penyimpangan nilai yang masif dan membuat jati diri bangsa luntur, bahkan perlahan menghilang. Penelitian ini secara umum menggunakan metodologi kualitatif dengan pendekatan studi literatur. Hasil dari penelitian ini mengungkapkan bahwa, sejauh masa globalisasi ini muncul, masyarakat Indonesia telah banyak meninggalkan nilai-nilai Pancasila. Adapun cara menggugah implementasi Pancasila di era global adalah dengan menerapkan pendidikan kewarganegaraan dan Pancasila di setiap lini pendidikan, melaksanakan hari besar dan memberikan nilai-nilai Pancasila pada masyarakat, melakukan pertunjukan seni berkarakter nasionalis. Dengan cara tersebut masyarakat diharapkan menyerap setiap nilai Pancasila dan mampu mengamalkan nilai-nilai tersebut di keseharian masyarakat.

Abstract

This paper analyzes the application of fiduciary guarantees following the issuing of Constitutional Court Decision Number 18/PUU-XVII/2019. This ruling upholds the debtor's entitlement to legal protection against the wrongful execution of fiduciary obligations that contravene legal stipulations within the framework of Indonesian law. This research employs a normative juridical approach by examining documents and interpreting legal statutes, Constitutional Court rulings, and pertinent field activities. The study's findings indicate that, following the Constitutional Court's ruling on enforcing fiduciary assurances, numerous changes have transpired, particularly on procedural aspects and safeguarding debtors' rights. The current issues are legal ambiguity and the necessity for more comprehensive rules. This report advocates for amending regulations and enhancing law enforcement officers' capabilities to ensure the execution of fiduciary assurances aligns with legal provisions.

Abstract

The Public Prosecutor, as the representative of the State, holds dominant authority in regulating the course of criminal trials (dominus litis). The role of the Prosecutor inevitably places them in direct opposition to the interests of the Defendant. This clearly demonstrates a disparity in how the law treats the summoning of witnesses: while the Prosecutor’s witnesses are compelled by law, those of the Defendant are not equally supported or guaranteed by the legal framework. As a result, the Defendant’s right to present mitigating witnesses remains a theoretical entitlement (lex scripta) without enforceability. This research conducts a normative juridical analysis of relevant legal texts, scholarly literature, and journal sources. A significant imbalance is evident in the process of summoning witnesses those summoned by the Prosecutor aim to incriminate (a charge), while those proposed by the Defendant seek to mitigate or exculpate (a de charge). Incriminating witnesses are bound by legal obligations and face sanctions under Article 224 in conjunction with Article 552 of the Indonesian Penal Code if they fail to appear, and their testimony is considered valid evidence in court. The findings indicate that this legal imbalance significantly affects the objectivity of criminal proceedings, often leading to a tendency to disadvantage the defendant. In contrast, exculpatory witnesses are treated merely as a "right" of the Defendant, without any enforceable obligation to appear, as no legal consequences exist for their absence.

Abstract

Drug trafficking in Cirebon City showed a significant increase between 2019 and 2021, with the modus operandi of the outboard system growing rapidly. In this mode, the perpetrator hides the drugs in a specific location for the buyer to pick up without direct interaction. This study aims to evaluate the judge's decision against the perpetrators of narcotics crimes who apply the modus operandi of the sticky system and examine the law's application in the case. The method used is normative juridical, with an emphasis on reviewing the provisions of laws and regulations, especially Law Number 35 of 2009 concerning Narcotics. The data analyzed is secondary data obtained from various legal references, such as books, court rulings, and other relevant documents. Data collection is carried out through literature studies and legal document reviews. The study results show that the outboard mode in Cirebon reduces direct contact between perpetrators and buyers by involving organized crime that utilizes technology. Law enforcement against this mode faces various challenges, including the difference in punishment in the Cirebon District Court decision Number 90/Pid.Sus/2021/PN Cbn sentenced him to four years in prison and a fine. Law enforcement against the modus operandi of the drug trafficking outboard system in Cirebon faces challenges in proving and disclosing the perpetrator network, even though intelligence strategies, undercover operations, and inter-agency collaboration have been implemented.

Abstract

The widespread use of marketplace platforms in online buying and selling activities has brought significant convenience to consumers in Indonesia. However, this phenomenon also presents complex legal challenges, especially related to the circulation of illegal products that are increasingly difficult to monitor. This research examines the legal responsibility of marketplace providers in dealing with the sale of illegal goods based on Law Number 8 of 1999 concerning Consumer Protection (UUPK) and Law Number 11 of 2008 as well as Law Number 19 of 2016 concerning Electronic Information and Transactions (UU ITE). Using a normative juridical approach and descriptive-analytical method, this research explores how the current regulatory system responds to the issue. The research findings show that although the existing legal framework has provided formal protection, in practice there are still many gaps, especially in the aspects of seller verification, content monitoring, and consumer complaint mechanisms. Marketplaces often play a passive role on the grounds that they are facilitators, even though they have operational control over the system. Therefore, it is necessary to strengthen regulations and increase the active role of platform providers in ensuring the legitimacy of the products being traded. This research also recommends cross-sector collaboration to strengthen supervision and build a safer and more responsible e-commerce ecosystem in 2025 and beyond.

Abstract

The rapid development of e-commerce in Southeast Asia, particularly in Indonesia and Singapore, has opened up new economic opportunities, but it has also raised serious concerns regarding the circulation of counterfeit products on digital marketplace platforms. Counterfeit products not only harm the original manufacturer economically, but also endanger consumers in terms of health and safety. This research aims to evaluate and compare the legal responsibility of marketplaces for consumer losses due to counterfeit products based on regulations in Indonesia and Singapore. The method employed was a normative, juridical, and macro-comparative approach, involving the analysis of laws and regulations, legal doctrines, and interviews with stakeholders in the consumer protection sector. The results indicate that Indonesia lacks a robust legal framework for holding marketplaces accountable, which hinders consumers' access to effective legal protection. In contrast, Singapore has developed a progressive legal system through the Consumer Protection (Fair Trading) Act, which requires marketplaces to apply the precautionary principle and provide efficient dispute resolution mechanisms. The findings confirm that marketplaces should be positioned as active business actors who can be held legally liable when harm occurs to consumers due to the sale of counterfeit products. This research recommends revisions to Indonesia's Consumer Protection Law and Government Regulation No. 80/2019 to align with the development of modern e-commerce practices, including the implementation of digital product certification and reverse proof to ensure fairness for consumers.

Abstract

Penelitian ini bertujuan untuk mengkaji secara normatif peran serta masyarakat dalam proses legislasi nasional, dengan studi fokus pada Undang-Undang Sistem Pendidikan Nasional (UU SISDIKNAS) dan Undang-Undang Keterbukaan Informasi Publik (UU KIP). Kedua regulasi ini merupakan instrumen hukum strategis dalam menjamin akses masyarakat terhadap layanan pendidikan dan informasi yang terbuka dan akuntabel. Penelitian ini dilatarbelakangi oleh masih terbatasnya efektivitas implementasi kedua undang-undang tersebut dalam menjangkau seluruh lapisan masyarakat secara adil, khususnya kelompok yang rentan terhadap eksklusi sosial dan geografis. Pendekatan yang digunakan adalah kualitatif deskriptif dengan metode studi dokumen, yang mencakup analisis terhadap substansi hukum, proses legislasi, serta pelaksanaan kebijakan di tingkat pusat dan daerah. Hasil penelitian menunjukkan bahwa secara normatif, UU SISDIKNAS dan UU KIP telah memuat prinsip-prinsip partisipasi publik dan akses yang inklusif. Namun, dalam praktiknya terdapat kesenjangan antara ketentuan hukum dan implementasi faktual di lapangan. Kendala utama yang diidentifikasi meliputi minimnya ruang partisipasi publik yang bermakna dalam proses pembentukan undang-undang, dominasi elit dalam agenda legislasi, lemahnya pengawasan pelaksanaan kebijakan, serta hambatan birokrasi dan koordinasi antar lembaga. Selain itu, inkonsistensi kebijakan antara tingkat pusat dan daerah turut memperlemah efektivitas regulasi tersebut. Penelitian ini menegaskan bahwa reformasi sistem legislasi harus diarahkan pada penguatan mekanisme partisipasi publik yang substansial, peningkatan kapasitas institusi pengawas, serta penyelarasan kebijakan lintas sektor dan tingkat pemerintahan. Dengan tata kelola legislasi yang lebih inklusif dan akuntabel, regulasi di bidang pendidikan dan informasi dapat berfungsi secara optimal dalam mendorong pemerataan akses dan kualitas layanan publik yang berkeadilan.

Abstract

The use of e-commerce in trade has had a big impact on Indonesian society, especially in terms of very important legal issues. Legal protection in e-commerce is crucial to protect consumers who make buying and selling transactions via the internet. This development is driven by high demand and acceptance from the public, as evidenced by the emergence of various online stores such as Kaskus, Tokopedia, Bukalapak, Shopee, and Lazada. Rapid advances in technology have changed the method of buying and selling from physical stores to online transactions via the internet. E-commerce, as an information technology innovation, allows consumers to make transactions with just the touch of a finger without having to leave the house. However, the variety of e-commerce platforms available increases the potential for legal issues in online transactions. This research aims to understand how to legally protect consumers and help them if losses occur in e-commerce transactions. The method used is a normative approach, by reviewing literature and secondary data related to consumer legal protection in e-commerce transactions.

Abstract

Within the field of medicine, practitioners are guided by teachings on ethics and morals to fulfill their duties and responsibilities in serving the community. Imagine a scenario when a doctor breaches the relevant ethical and moral standards. If such a situation arises, the discipline will be enforced either by the professional association responsible for setting the ethical guidelines or by legal authorities who will process and impose penalties to prevent doctors from neglecting their duty to get informed permission and engaging in malpractice. Informed consent serves a dual purpose for both patients and doctors. For doctors, it provides a sense of assurance when performing medical procedures on patients and acts as a form of protection against potential legal claims or lawsuits that may arise from any unforeseen accidents. Regarding informed consent, it refers to the patient's entitlement to receive comprehensive information regarding their medical condition, the recommended medical procedures, and the potential outcomes associated with each decision.

Abstract

The Complete Systematic Land Registration (PTSL) is a thorough procedure of registering all unregistered land parcels in every region of the Republic of Indonesia, inside a single village/sub-district or other administrative unit at the same level, conducted concurrently. The PTSL method is a government project spearheaded by the Ministry of ATR/BPN to cater to the basic needs of the community, such as clothing, food, and shelter. The research methodology used is juridical-empirical, which is a type of qualitative research. This study made use of both primary and secondary legal information. The potential obstacles in executing the Complete Systematic Land Registration (PTSL) program encompass unresolved PPH and BPHTB taxes, absentee land ownership concerns, surplus and neglected land, human resource constraints, insufficient facilities and infrastructure, and challenges in acquiring precise physical and legal data.
