Abstract

Karimunjawa merupakan salah satu kepulauan daerah yang berada di Indonesia dengan beragam keindahan alamnya, terletak pada Laut Jawa yang masih dalam wilayah Kabupaten Jepara, Jawa Tengah. Dengan luas daratan ±1.500 hektare dan perairan ±110.000 hektar. Karimunjawa menjadi tempat wisata laut yang mulai banyak digemari wisatawan lokal maupun mancanegara. Oleh karena karakteristik dari karimunjawa sendiri serta hasil alamnya yang berlimpah, maka menjaga lingkungan dan melestarikannya adalah keharusan bagi semua orang. Kenyataan ini menjadikan pentingnya masyarakat maupun siapa saja yang menggunakan bahkan memanfaatkan sumber daya yang ada pada Karimunjawa wajib mengikuti segala peraturan hukum yang diterapkan untuk menjaga kelestarianya. Pengembangan kesadaran serta pendampingan hukum yang nyata dan jelas dalam pelestarianya memerlukan daya dukung dari masyarakat, penegak hukum, maupun penggerak usaha baik tambak maupun lainya yang memanfaatkan kelestarian alamnya, sehingga perlu adanya edukasi serta pendampingan yang diharapkan dapat memberikan pencerahan maupun hasil luaran masyarakat yang sadar akan hukum mengenai pelestarian karimunjawa. Kelompok perkumpulan yang potensial untuk dilatih adalah Perkumpulan Lingkar Juang Karimunjawa yang berkedudukan di Dusun Telaga Rt.003/Rw.003, Des. Kemujan, kec. Karimunjawa, Kabupaten Jepara, Provinsi Jawa Tengah. Perkumpulan tersebut bertujuan dalam meningkatkan kesadaran masyarakat serta sapek aspek pendukung lainya dalam Pelestarian Sumber Daya Alam Karimunjawa, namun dibalik tujuan mulia yang dimiliki Mitra terdapat ancaman persekusi yang dialami Mitra yang dilakukan oleh oknum-oknum perusak alam Karimunjawa, dalam kata lain pemberdayaan hukum terhadap Masyarakat dan Mitra pada Kecamatan Karimunjawa. Oleh karena itu perlu adanya edukasi serta pendampingan dalam pelaksanaan pelestarian Sumber Daya Alam dalam segi hukumnya, serta mencegah terhadap adanya ancaman persekusi yang dialami oleh Mitra dan Masyarakat Karimunjawa. Optimalisasi fungsi   dan   tujuan   dari   Perkumpulan   Lingkar   Juang Karimunjawa diharapkan akan berdampak terhadap masyarakat dalam meningkatkan pelestarian Sumber Daya Alam, Lingkungan, dan Budaya pada Karimunjawa dari segi Hukum seperti legalisasi pemanfaatan alamnya serta juga perizinannya Untuk itu Tim Pengabdian Masyarakat Unissula yang memiliki kemampuan dalam bidang  hukum dan sosialisasi dapat memberikan gambaran serta arahan maupun pendampingan dalam pelegalan serta pelestarian alam pada karimunjawa dari segi hukum. Adapun dalam pengabdian masyarakat ini menerapkan metode ceramah dan diskusi interaktif yang dihadiri lebih dari 20 masyarakat Karimunjawa dari berbagai wilayah. Karimunjawa is one of the regional islands in Indonesia with a variety of natural beauty, located in the Java Sea which is still within the Jepara Regency, Central Java. With a land area of ±1,500 hectares and waters of ±110,000 hectares. Karimunjawa has become a marine tourist destination that is becoming increasingly popular with local and foreign tourists. Due to the characteristics of Karimunjawa itself and its abundant natural products, protecting the environment and preserving it is an obligation for everyone. This fact makes it important for the community and anyone who uses or exploits the resources available in Karimunjawa to follow all legal regulations that apply to maintain their sustainability. Developing awareness and real and clear legal assistance in its conservation requires support from the community, law enforcers, and business drivers, both fish farms and others, that utilize natural conservation, so there is a need for education and assistance which is expected to provide enlightenment and outcomes for people who are aware of it. law regarding the preservation of Karimunjawa. The potential association group to be trained is the Karimunjawa Fighting Circle Association which is located in Telaga Rt.003/Rw.003, Kemujan. Karimunjawa, Jepara Regency, Central Java Province. This association aims to increase public awareness and support other supporting aspects in the Conservation of Karimunjawa Natural Resources, but behind the noble goals that Mitra has, there is the threat of persecution experienced by Mitra by elements destroying Karimunjawa's nature, in other words legal empowerment of the Community and Partners in Karimunjawa District. Therefore, there is a need for education and assistance in implementing the preservation of natural resources from a legal perspective, as well as preventing the threat of persecution experienced by Partners and the Karimunjawa Community. Optimizing the functions and objectives of the Karimunjawa Fighting Circle Association is expected to have an impact on the community in increasing the preservation of Natural, Environmental and Cultural Resources in Karimunjawa from a legal perspective, such as legalizing the use of nature and also permits. For this reason, the Unissula Community Service Team has capabilities in the field of law and Socialization can provide an overview direction and assistance in legalizing and preserving nature in Karimunjawa from a legal perspective. The method of implementing activities is a group-based method that is carried out comprehensively which is able to inventory all legal aspects from developing the association's mindset, providing facilities and equipment, community service team activities are carried out in a measurable manner and the monitoring and evaluation process is to measure target achievement, legal product outcomes and the creation of a healthy society. reliable and understand the law which will be published in community service journals.

Abstract

Fiduciary is a transfer of ownership of a certain object by juridical levering from the original owner (debtor) to complete a debt agreement to the new owner based on trust alone (creditor), which is essentially a guarantee for the debtor's debt. On the other hand, the object remains under the debtor's control. The problem that occurs in a bankruptcy case is that in the settlement of bankruptcy assets, creditors holding fiduciary guarantees have the authority to execute their rights, as if bankruptcy had not occurred. The aim of writing this article is to analyze the settlement of bankruptcy assets to avoid regulatory conflicts between the Curator and Separatist Creditors. This type of research is normative legal research, namely legal research carried out by solving legal issues and at the same time providing prescriptions. It is prescriptive in nature, where it is legal research. That the position of separatist creditors in the bankruptcy process will take priority even if a bankruptcy occurs. This is stated in Article 27 paragraph (3) of the Fiduciary Guarantee Law which clearly states that priority rights are not extinguished even if bankruptcy occurs and Article 21 of the Mortgage Rights Law which states that the rights of separatist creditors are not lost in the event of bankruptcy and one of the rights Separatist creditors have the right to precede other creditors as stated in Article 20 paragraph (1) of the Mortgage Rights Law.

Abstract

The application of Articles in law enforcement against drug addicts that should be imposed on dealers, dealers or couriers, but instead imposed on addicts, causes legal uncertainty for addicts because the rights of addicts to be rehabilitated are not obtained. This paper uses normative legal research methods. The research approach used is a statutory approach and a case study approach. The results of this study are legal uncertainty in law enforcement against drug addicts in Indonesia, which is caused by multiple interpretations between Article 127 and Article 112 of Law Number 35 of 2009 concerning Narcotics, which has created disparities in sentencing that ignore the principle of justice. The use of Article 112 which should be intended for drug dealers is often misused to ensnare addicts, who should receive rehabilitation according to Article 127. The need for legal reconstruction that focuses on harmonizing Article 127 and Article 112 of the Narcotics Law to align the two articles, by providing quantitative limitations and clear criteria to distinguish abusers from dealers.
