Abstract

The application of Articles in law enforcement against drug addicts that should be imposed on dealers, dealers or couriers, but instead imposed on addicts, causes legal uncertainty for addicts because the rights of addicts to be rehabilitated are not obtained. This paper uses normative legal research methods. The research approach used is a statutory approach and a case study approach. The results of this study are legal uncertainty in law enforcement against drug addicts in Indonesia, which is caused by multiple interpretations between Article 127 and Article 112 of Law Number 35 of 2009 concerning Narcotics, which has created disparities in sentencing that ignore the principle of justice. The use of Article 112 which should be intended for drug dealers is often misused to ensnare addicts, who should receive rehabilitation according to Article 127. The need for legal reconstruction that focuses on harmonizing Article 127 and Article 112 of the Narcotics Law to align the two articles, by providing quantitative limitations and clear criteria to distinguish abusers from dealers.

Abstract

Sungai memegang peran penting bagi kehidupan masyarakat sebagai sumber air bersih, jalur drainase, penyangga eksosistem, serta sarana aktivitas dan sosial ekonomi. Namun, kualitas air di sungai terus menerus mengalami penurunan akibat pembuangan limbah rumah tangga dan industri serta rendahnya kesadaran masyarakat menjaga kebersihan lingkungan sekitar sungai. Salah satu sungai yang menghadapi permasalahan pencemaran adalah Sungai Loji di Kota Pekalongan. Kondisi ini diperparah oleh sampah plastik, dan limbah cair industri seperti industri batik dan pembuatan celana jeans. Seiring dengan meningkatnya permasalahan tersebut, masyarakat membentuk Komunitas Peduli Kali Loji (KPKL) sebagai bentuk partisipasi masyarakat dalam menjaga kelestarian sungai. Tujuan penelitian ini adalah mengetahui bentuk dan tingkat partisipasi Komunitas Peduli Kali Loji (KPKL) dalam upaya mengurangi pencemaran di Sungai Loji. Metode yang digunakan adalah kualitatif deskriptif dengan pengumpulan data berupa wawancara, dokumentasi, dan observasi,. Hasil dari penelitian ini yaitu KPKL dalam mengurangi pencemaran sungai Loji melakukan kegiatan sosialisasi, sekolah sungai, aksis bersih sungai, dan pembuatan IPAL. Tahap perencanaan berupa bentuk partisipasi pemikiran. Tahap pelaksanaan berupa bentuk partisipasi tenaga, sosial, dan keterampilan. Tahap pemeliharaan berupa bentuk partisipasi tenaga. Tahap evaluasi berupa bentuk partisipasi pemikiran. Tingkat partisipasi KPKL dalam upaya mengurangi pencemaran di Sungai Loji berada pada tangga tingkatan tokenism. Kata Kunci: Partisipasi, KPKL, Pencemaran Sungai

Abstract

Ulayat land is land that is controlled jointly by members of a customary law community, where the management arrangements are carried out by the traditional leader (Head of Adat) and its use is intended for both members of the customary law community concerned and outsiders. Indigenous communities tend to live scattered across Indonesia's vast forest areas. With the issuance of the Basic Agrarian Law (UUPA) and development programs, they are threatened with eviction from the forest land they now occupy. This is based on confusion regarding the legal position and rights of indigenous peoples to customary land and other agrarian resources. The existence of indigenous peoples and their rights to land is one of the considerations in renewing the law on agrarian affairs, especially in reforming agrarian law. This research was carried out using a normative juridical method. Data was obtained by collecting from several sources such as books, journal articles and regulations. In conclusion, the recognition of customary land rights has been regulated in the Basic Agrarian Law Articles 3 and 5 of 1960 and is in the process of being implemented. In the field there are many agrarian disputes that are detrimental to customary land and there is no clarity on the process of protecting customary land.
