Abstract

Banyak bentuk rumah tangga dan sistem relasi suami-istri di dunia ini. Islam meresponnya juga beragam melalui dan sesuai latar belakang pemikirnya baik itu Islam tradisional, modernis-reformis, dan neo-tradisionalis. Konsep ḥuqūq al-zaujain oleh Islam tradisionalis mendapatkan perlawanan dari kalangan modernis-reformis dengan tuduhan bias gender dan konsep otoriter didalamnya. Pemikiran itu mendapati reaksi dari golongan Islam neo-Tradisionalis yang mencoba menjelaskan ulang konsep kalsiknya secara utuh dan komprehensif. Penelitian ini adalah library research dengan pendekatan kualitatif dan menggunakan metodologi content analisis. Penelitian ini menghasilkan bahwa Konsep ḥuqūq al-zaujain fikih tradisional masih menjadi konsep yang relevan diterapkan. Penjelasan ulang secara utuh dan komprehensip oleh golongan Islam neo-tradisionlis memberikan gambaran dan nuansa baru pada konsep yang selama ini banyak disalah fahami. Serta menolak kesan negative yang selama ini disematkan, bahwa konsep qawwāmah seorang pria adalah simbol kesewenang-wenangan dan otoriter.

Abstract

Dalam Islam, wanita yang telah ditalak bain kubra tidak boleh diruju’ kembali oleh suaminya. Namun suami boleh menikahi kembali setelah mantan istrinya itu nikah lagi dengan laki-laki lain dan kemudian ditalak lagi. Praktek nikah yang kedua ini disebut nikah muhallil yang secara umum masuk adlam kategori nikah yang dilarang. Dalah literasi fikih klasik, terutama empat madzhab, madzhab hanafiy menganggap nikah ini tetap sah, menyalahi madzhab-madzhab lainnya. Penelitian ini adalah library research dengan pendekatan kualitatif dan menggunakan metodologi content analisis. Penelitian ini menghasilkan bahwa Nikah muhallil perspektif madzhab Hanafiy adalah boleh dan dapat menghalalkan terhadap suami pertamanya untuk menikahi istrinya kembali. Adanya syarat tenggang waktu didalamnya tidak dapat merusak keabsahan nikah muhallil. Akan tetapi keabsahan tersebut tidaklah tanpa resiko, karena dalam hadis Nabi jelas ada sindiran keras atas praktek tersebut. Sesuai kandungan hadits tersebut, pelaku nikah muhallil mendapatkan dosa berupa laknat Allah subhanahu wa ta’ala

Abstract

Islam has divided the roles of husband and wife in the household in detail. This includes the task of fulfilling family finances (breadwinner), where this is the responsibility of the husband, while the wife is obliged to regulate the domestic sector in the household. However, the reality exists, many wives participate in the task of financial maintenance. This phenomenon is important to continue to discuss because disputes over duties in the household will have an impact on life together. This research is a library research with a qualitative approach and uses a content analysis methodology. This research aims to reveal the phenomenon of wife's participation in the fulfillment of family support, such as factors, impacts, and reviews of Islamic law. This research produces the phenomenon of wife's participation in the task of family finances has several factors, internal from the wife's own personal self and external factors that cause a wife to need to do it. This phenomenon also has positive and negative impacts that affect the lives of married couples, children, and families. Meanwhile, according to a review of Islamic law, the participation of the wife in the fulfillment of the maintenance which is the husband's duty is allowed but with several conditions. The most important requirement is to maintain her main duties as a wife and housewife.

Abstract

Artikel pengabdian ini bertujuan untuk meningkatkan kesadaran masyarakat dan remaja di Desa Karangbayat Kecamatan Sumberbaru Kabupaten Jember tentang risiko pernikahan dini. Kegiatan pengabdian ini menggunakan metode Participatory Action Research (PAR), dengan melibatkan siswa-siswi kelas 8-9 MTS Sunan Ampel dan MTS Nurul Huda melalui penyuluhan dan sosialisasi tentang risiko pernikahan dini. Hasil dari kegiatan pengabdian ini adalah peningkatan kesadaran siswa-siswi dalam menunda pernikahan dan pentingnya melanjutkan pendidikan. Pembahasan kegiatan ini adalah perlunya kolaborasi pemerintah desa, lembaga pendidikan, dan masyarakat dalam upaya mencegah pernikahan dini di Desa Karangbayat.

Abstract

This jurnal examines the relevance of Islamic ethics as an alternative perspective in contemporary law, which is currently facing moral crises, degradation of human values, and global challenges such as human rights, bioethics, economic injustice, and ecological crises. This research employs a qualitative approach through library studies, analyzing classical sources such as al-Ghazālī and al-Syāṭibī, as well as contemporary thought from scholars including M. Hashim Kamali, Abdulaziz Sachedina, M. Umer Chapra, and Seyyed Hossein Nasr. The findings indicate that the principles of maqāṣid al-sharī‘ah—covering the protection of religion, life, intellect, lineage, and property—are highly relevant in addressing the problems of modern law. Regarding human rights, Islamic ethics emphasizes the balance between rights and responsibilities through the concept of karāmah insāniyyah (human dignity). In bioethics, the principles of lā ḍarar wa lā ḍirār and ḥifẓ al-nafs provide moral guidance in responding to modern biotechnology. In the economic sphere, Islamic ethics offers distributive justice through instruments such as zakat and the prohibition of usury, serving as a corrective to the weaknesses of capitalism and socialism. Meanwhile, in environmental law, the paradigms of khalīfah (stewardship) and al-mīzān (balance) emphasize humanity’s responsibility to preserve the sustainability of nature as a divine trust. The article concludes that Islamic ethics can serve as a constructive partner to positive law through an interdisciplinary approach and the reinterpretation of maqāṣid in accordance with contemporary contexts. The study recommends the need for dialogue between positive law and Islamic ethical values to create a legal system that is more humane, just, and sustainable.
